Tap Oil and Gas refuses to honor a wage garnishment on employee Cecil calloway. Cecil works for Tap Oil and Gas for commission selling shares. Tap Oil and Gas admits that cecil Calloway has received money from their company but continually ignores the wage garnishment served on the by Denver County Child Support Inforcement. Cecil Calloway is currently in arrears to his children in the amount of $11,450.00. He has not paid his child support payments since January 2006. Colorado Child Support enforcement was able to get 2 payment by way of garnishment on his bank account. One payment for $194.95 and one payment for $1400.00 in September. Cecil Calloway owes $550.00 per month and has continually fallen behind on his child support. Tap Oil and Gas should be ashamed of themselves for not only dealing with such a man as this, but also for allowing him to shirk his family responsibility to his children.

Steve, I am not on the street, thanks to my current husband. My husband works 10+ hours a a week overtime to provide for Cecil's children. Is this fair to my husband? Cecil's ex girlfriend has confirmed that Cecil brags about making $10,000.00 per share sold for TAP Oil and Gas. In May of 2006 he sold 5 shares. I have confirmed this with one of his associates. His child support is based on a 1993 court order for $550.00 a month.

I, myself, have been close to being on the street, working two jobs (16 hours a day) to provide for Cecil's children. I have worked as a janitor, housekeeper, delivery person, and even shoveled horse manure to provide for my children.

According to his ex, Cecil lives behind a gated community, enjoys $500.00 meals at resturants, and travels all over the world. A far cry from being homeless wouldn't you say? He also has two college degrees, degrees he paid for with the money that he should have been paying in child support.

When Cecil and I divorced, I didn't ask for alimony or any of his retirement, I only wished for him to support his children. He reciprocated by clearing out our bank account, leaving me with no money to feed the children or pay my rent.

So perhaps child support rules are not something what you dislike, but thank men like Cecil who continually skip out on any responsibilty regarding their children, the courts have to order child support.

One last comment; Cecil has no idea how his children are living or even if they will have Christmas this year. Don't his children deserve better than that?

$550 a month for 3 kids??

This sounds like a ridiculously small amount, and I don't know of anyplace in this country where that would be a majority of the support expenses for even 1 child, much less 3 of them. 26 years ago, when my parents divorced, the order was $600/month for the 2 of us. In most cases, the amount of support is based on the non-custodial parent's income.

The bottom line is that he owes the money, and his employer is violating more than one law by refusing to enforce the garnishment order. Furthermore, if he would pay up on his own, and on time, there would be no need for a garnishment order. I would say that she needs to find an attorney, even one through legal aid, if necessary, to determine if she has grounds for a lawsuit against the employer for failure to comply with the order.

Gloria,

I read the word garnishment and went on that. I am programmed to think on the lines of debt collection, etc. Sorry.

FYI..I do not believe that men should make babies and have no responsibility for them. I just dislike our system that automatically places a larger burden on the man. It is a biased system.

How about the women who re-marry to money or have a live in boyfreind and that money is just spending money when the father paying it is living in the car eating dog food.

What if that money you took from his bank account was his rent money, etc. that could not be replaced? Then he is on the street. Are you on the street? Is your child on the street?

Refusing to pay, and being unable to pay are totally different things.

That is my point.

Texas Wage Withholding Statues

TexasFamily Code: Chapter 158. Income Withholding

Texas Family Code 231.302. INFORMATION TO ASSIST IN LOCATION OF PERSONS OR PROPERTY.

(a) The Title IV-D agency of this or another state may request and obtain information relating to the identity, location, employment, compensation, benefits, income, and property holdings or other assets of any person from a state or local government agency, private company, institution, or other entity as necessary to establish, modify, or enforce a support order.



(b)A government agency, private company, institution, or other entity shall provide the information requested under Subsection (a) directly to the Title IV-D agency, without the requirement of payment of a fee for the information, and shall, subject to safeguards on privacy and information security, provide the information in the most efficient and expeditious manner available, including electronic or automated transfer and interface. Any individual or entity disclosing information under this section in response to a request from a Title IV-D agency may not be held liable in any civil action or proceeding to any person for the disclosure of information under this subsection.


SUBCHAPTER A. INCOME WITHHOLDING REQUIRED; GENERAL PROVISION


158.001. Income Withholding; General Rule

In a proceeding in which periodic payments of child support are ordered, modified, or enforced, the court or the Title IV-D agency shall order that income be withheld from the disposable earnings of the obligor as provided by this chapter.

SUBCHAPTER E. RIGHTS AND DUTIES OF EMPLOYER

8.201. Order or Writ Binding on Employer

(a) An employer required to withhold income from earnings under this chapter is not entitled to notice of the proceedings before the order of withholding is rendered or writ of withholding is issued.
(b) An order or writ of withholding is binding on an employer regardless of whether the employer is specifically named in the order or writ.

8.209. Penalty for Noncompliance

(a) In addition to the civil remedies provided by this subchapter or any other remedy provided by law, an employer who knowingly violates this chapter by failing to withhold income for spousal maintenance or to remit withheld income in accordance with an order or writ of withholding issued under this chapter commits an offense.

(b) An offense under this section is punishable by a fine not to exceed $200 for each violation.

Texas has an exception for Child Support and Back Taxes

I agree, it does take two people to make a baby. Cecil helped me make 3 of them and I have been the sole supporter of the children since our divorce 14 years ago. Cecil does not visit his children (he has a court order that says he can visit them) nor does he voluntarily support them financially. He, like you, seems to think that it is ok to make children but you don't have an obligation to support them. Cecil didn't volunteer to provide financial support for his children after the divorce so I had to get a court order for child support. Just as I provide for them, so should he.

Texas Wage Garnishment :

Wages cannot be attached or garnished, except for child support.

Income that is not a wage can be garnished or ordered turned over to a receiver.

Bank accounts, rents and royalties can be garnished.

Exemptions include social security benefits.

WARNING For individuals living in Texas who are paid from an out of state location, there is case law (Baumgardner vs. Sou Pacific 177 S.W. 2d 317) to support taking a judgment from Texas, domesticating the judgment in the foreign state, then filing the wage garnishment there. Many creditors have used this strategy successfully.

Wage garnishment is illegal in TX

If he lives and works in TX, his wages cannot be garnished. Also if the company is in TX, the CO court order is invalid anyway. No jurisdiction.

Responsibility goes both ways and it takes 2 people to make a baby. Our child support laws are ridiculous.

Women want equal rights and equal pay, etc., but never want equal responsibility.

With rights come responsibility.

Cecil should work for cash and/or get an offshore bank account. I would agree to support my kids, but I don't agree with the principle of someone dictating an amount I have to send to do it.
