So, let me get this straight...

You wrote a bad check, but it wasn't at your grocery store, so you're bothered that your grocery store knows about it and treats you as a risk for writing back checks?

Actions have consequences. You state that you "don't write bad checks and made one math error." Well, despite your rationalization, regardless of the reason, you DID write a bad check. Just because you don't make a habit of it doesn't make you any more trustworthy.

You also state that "some one should be able to sue them for the humiliation and stress." So... you broke the law, and you want Telecheck to pay you because the consequences of breaking the law make you sad?

Why write a check at all if the place takes debit cards? It is your fault for writing a bad check.

Telecheck is a database organization that many merchants belong to. The service reduces the likelihood of costly returned checks where the merchant loses his merchandise, the money paid for the merchandise, the fee the bank charged for the returned deposit item, and collection costs. The alternative for many merchants to using a check service is to not accept checks at all... so for 26 years, you've had the convenience of paying by check as opposed to not at all.

The problem with Telecheck and some others is that the service has no way of being able to poll your checking account at the time of sale to see whether the account is open or the funds are available. It only looks at your check history and decides mathematically the likelihood that the check will not return unpaid.

So if you write a bad check to a Telecheck merchant you will not be able to write a check to ANY telecheck merchant for a long time regardless of your account balance.

And here's a little known secret that a lot of merchants don't even know. A percentage of checks (perhaps 15%) that have NO negative history of returns are declined at the point of sale anyway because Telecheck assigns a "velocity rate" to their merchants that declines a percentage of checks for no reason at all because Telecheck charges for declines and this is a no risk profit center for them.

There is an appeals process you can work through with Telecheck to remedy your history with them, but it ain't easy folks.

If you EVER write a bad check to heb, they'll NEVER, EVER accept a check from you again cause they use telecheck also. That said, you DID write a bad check. That company probably has the same "one strike" and you're out policy. Now you'll know and won't try and use a check there anymore. If I were you, I wouldn't shop there anymore either. Why is it that you are blaming telecheck when it's the store's policy? Telecheck's just the messenger. They'll take your debit card cause the funds are withdrawn right away or declined on the spot.
