First of all let me say I do not have a loan with this company nor have i ever had one. I have never signed any type of legal binding contract with them nor have I ever even stepped a foot into any of there places of business. this company and there methods of collection techniques truely amazes me.

I have been getting harassment calls from them and agents they have hired on both of my cell phones at my place of business as well as my residence. I have also had visits to my place of business by agents they have contracted. I have even had physical harm threated to me by them, Calls to my residence on a sunday!. After several request to stop this to there office, District managers as well as regional managers and there corporate head quarters in Savannah, Georgia this still hasn't stopped.

Well guess what to no evil they continued calls to my residence. So I advised my lawyer of there contined actions and requested he put them on written notice. He did this by sending them certified letters to the following 1. There corporate headquarters in Savannah, Ga 2. The owner of this company Tracy Young. 3. The attorney of record in another civil case that he represented Titlemax in Columbia, Sc. This was a demand that all contact cease and desist sent to them on June 8, 2007 guess what another call by them to my residence again.

Now I have a request in to a local news channel to expose them and let the viewers of this news channel see the tatics this company uses to go to any extent to collect there money even if they violate state and federal fair debt collection laws. Also it appears to me that the only resolution to resolve this is to have my lawyer file a federal civil suit to stop this company and there harassment. I'm truely amazed at this with being a former collection manager myself for 10 years and being trained on collection laws and what you can't do or say because if you do you are in vilation of the law. This company and there employees and agents have broken all the laws I have ever been trained not to break.

I mean is there some type of law that this company has been given by state and federal laws that excempt them from them? Hopefully if the news channel does a story on them it will publicly embarrass them to stop. Along with I guess maybe financially hitting them will bring it to a stop.

Lawsuit Update

TitleMax has had there attorney file there answer to the complaint and lawsuit I have filed against them. There attorney answered the complaint on 12-11-2007. To no surprise what so ever but basically they deny almost every allegation in the complaint. And also to no surprise on paragraph 49 of there answer reads as follows. 49. WHEREFORE, having fully replied to plaintiff's complaint, TitleMax prays that plaintiff's claims be dismissed with prejudice, and that TitleMax be awarded such other and futher relief as the court deem just and proper. This is also pretty good in there answer line 44. reads as follows.

FOR A NINTH DEFENSE

(South Carolina Unfair Trade Practices Act Inapplicable)
44. TitleMax would show that the alleged acts of TitleMax, which are expressly denied, do not affect public interest but are essentially private in nature and,therefore, the South Carolina Unfair Trade Practices Act is inapplicable. Furthermore, TitleMax operates within a regulated industry; therefore, it is exempt from liability under the South Carolina Unfair Trade Practices Act. Are you kidding me ?


There is more but I want continue to go into there denial of any wrong doing. But will tell you that not to any surprise to me because the things they do trying to be above the law never ceases to amaze me. But like I have stated in previous post they were sent a cease and desist all communications letter from my attorney making them aware that he represents my brother and myself.

Well here is another thing they can denie ( LOL) on 01/24/2008 they once again mailed out another letter of demand from there Laurens Rd office in Greenville,SC that was signed by the manager there. When i was made aware of this I thought no way this happened surely it is a mistake and was sent out in 01/2007 but nope the date on the letter and the post mark on the envelope confirmed the date. Once again TitleMax I commend you on continuing to conduct your obvious negligence of going to what ever methods you chose to engage in rather than comply with the federal and state laws. The day is coming very soon that a jury will get to see the evidence compiled against your company I have collected and we will see what there decision is on your tactics. Hope to see you soon in the court room. :) keep up the great work.

TITLEMAX litigation update

Just up dating the status of my civil lawsuit I have filed in the Court Of Common Pleas Greenville County,Sc. Suit was filed on 9-14-07 against Titlemax and 2 of it's agents they use to do recovery for them. There was a little problem getting Titlemax served at first but that has been corrected and they were served the complaint on 11-9-07. Both agents have been served and 1 of them did not respond and my attorney will be filing for judgment against that one. The other did respond. TItlemax has a legal rep in this state and they were served by mail the complaint and have 35 days to file there answer to the complaint. Like I have stated before I have never done any kind of business with this company and gave them several warnings to stop calling my cell phones,my home phone,and my business along with there agents coming to my business.


So this is the only thing I think there going to understand. I had said in previous post that I would keep you updated. Titlemax is to answer the complaint by 12-14-07 unless of course they request a extension of time which is generally 30 days. My attorney I am sure will grant them that since he tells me it is professional courtesy. So upon the next actions that are of importance I will keep you posted.

I sit laughing at your comment but I am going to reply to it in the nicest way I can. First of all I did contact the sheriff's office in regards to the physical threat that was made to me and it is on record with the Greenville County Sheriff's office. I don't know if your comments on how law enforcement in New York handles these type of complaints is true or not. But the way they are handled here is totally different from what was told to me by the deputy that took my call when I called to file a complaint or criminal action if I could get them to take such action.


I was told by the deputy that this is considered more of a civil issue. Now in regards to my brother using my name or address on the loan application or signing my name or even listing me as a reference he did not do that. I have seen his loan contract and I AM NOT ON IT NO WHERE. So lets review it MR SNIFF! Sheriff's office has record of my attempt to get a warrant on the person that threated me. My name is no where on the loan contract at all nor my address of my residence nor my business address. Once again I will state I AM NOT IN A CONTRACT WITH TITLEMAX IN ANY WAY. So is there any other questions you have that you want to ask me to try and defend this ruthless companies tactics? Have a good day sir!

Sniff! Still doesn't smell right.

I've delt with this type of issue before with folks.

Since you claim your attorney sent them certified letters to leave you alone I don't understand why your report and your rebuttals do NOT mention any criminal complaints for aggrevated harassment filed by you with law enforcement agencies.

Around here, after sending such a letter, one simply goes to the county DA office and files a criminal complaint every time they contact you.

Further, when a person is threatened by "repo" folks, a criminal complaint would be appropriate.

So, where are the criminal complaints you have filed against these folks?

I can't help but believe there is more to this story than you're telling.

I'm beginning to suspect that your brother might have used your address when he applied for the loan.

Litigation Update

As I have stated in previous post that my attorney was preparing a civil lawsuit against Titlemax it has now been filed as of 9-14-2007 in the state of South Carolina county of Greenville 13th judicial circuit court of common pleas. I try to keep you updated as this case moves forward.

The real deal is that like i have stated I am not a borrower nor co borrower and I have nothing that belongs to Titlemax what so ever.If you had read post about this complaint you would have read that my brother borrowed from this company not me and that DOES NOT OBLIGATE ME TO HIS DEBT IN ANY WAY.ANYTHING ELSE YOU WAT TO KNOW CORY?

I notice you're skirting around any real issues about what they are really after. They make loans on vehicles. How do you tie into them? What are they harrassing you about? You've stated they've called you and visited you. They must want something that you have, that they think belongs to them. Somehow you are connected with them. Whether YOU own/owned a vehicle or someone you know owns/owned a vehicle or you have knowledge of said vehicle, they wouldn't be wasting their time bothering you.

Congrats to titlemax and it's staff for such great training of it's employess not to mention upper management and even ownership of continued FDCPA violations federal and state.Well here is a update to what has transpired since my last report on June 8,2007 Titlemax was sent a letter from my lawyer to cease and desist all communications to myself and my brother and to contact his office if they needed anything at all!

Well apparently this fell on deaf ears or should I say BLIND EYES reguardless this letter was sent certified to TRACY YOUNG owner and CEO of TITLEMAX, Inc. also to Titlemax headquarters in Savannah, Ga along with attorney of record in another civil case that this lawyer represented them on. Since the letter has been sent I have had not one but but TWO more calls to my residence from them continuing to try to collect on a loan that I personally have no legal obligation what so ever for. These calls have been logged and recorded along with photo's of them from caller ID.

Keep it up Titlemax i can assure you that your chance to defend your actions is coming. I have made ever attempt to get it thru your THICK SKULLS I DO NOT OWE YOUR COMPANY IN ANY WAY SHAPE OR FORM. As stated previosly I have never stepped foot in any of your offices for anything except one time and that was have consultation with my lawyer after I left his office. I dropped by the office on laurens Rd in Greenville, Sc and advised the manager who I was.And told him that should he need to contact me for anything at all and I DON'T SEE WHY HE WOULD NEED TO! But hecould contact my lawyer and I left them 2 buisness cards with his contact infor on it! I have NEVER signed any loan documents from your company as borrower or co- borrower at all.Never have I signed any kind of legal document at all.

I have done everthing in the world I can think of to STOP this continued HARASSMENT from Titlemax. It will come to a stop rest assured your repo agents threating me with physical harm. Your repo agents continued harassment with visits to my office.Your upper management and there slander will be stopped. The next post coming from me will be a case # from court and I told by my lawyer that he is preparing the paper work necessary for this to happen and I'm hoping It will be filed this week.

The several types of harm Titlemax and it's employees and agaents are causing me, my family and my employees needs to come to a STOP NOW. Im sending a fax of this updated report to Titlemax head quarters in Savannah , Ga right after it is completed along with emails that will be shown as CC: STOP THE HARASSMENT IMEDITALLY!
