I purchased a MP4 Player that was advertised as new. Yet the player I received was defective and included an unsafe adapter which was noncompliant with US codes.

I returned the player, the replacement was in a sealed box with a different adapter. However two other functions didn't work. Further examination showed the replacement was the one I had in the first place.

I paid for a new player, received a used, defective, refurbished one which was replaced with the same used, refurbished player with additional defects.

Plus the price was high for an electronic gadget that had been on the market for 2 years already. uBid needs to screen their suppliers and fire the rotten ones if they want to stick around.

remedy?

the best thing u can do at this point is take pictures of the product or keep it and file a complaint with the attorney generals office. They have to respond to that inquiry. The other thing would be to see if your credit card company has a guarantee if Item is defective they will either credit u back or start an investigation on your behalf, in my situation Amex refunded my disputed charges, plus 5 unauthorized charges that UBID decided to charge me. I would go for a class action but I think they are hovering towards Bankruptcy here very soon. U can read their proxy and see their stock which is at 2 cents.

UBid- inundated with counterfeits

AUTHOR: Bimini - (U.S.A.)

POSTED: Tuesday, February 17, 2009

UPDATE:
The second adapter I received had different specifications, so I looked for advice on its compatibility. I was made aware the second one has a fake UL sticker. The player's brand is not marked anywhere, the manufacturer listed by the distributor does not exist. UBid was informed about this but nevertheless instructed the distributor to repair or replace. Refund or a substitution was rejected. I was advised that if I refuse to accept the replacement I would lose all my rights.

The origin of a product on uBid's site may be identified as an anonymous supplier's warehouse'. In that case the buyer agrees to a transaction with an undisclosed merchant while uBid excludes itself from liability.

UBid uses a stringent 10-point merchant qualification process to approve sellers. UBid's statement: We also stand behind everything sold on our site with our 100% Fraud Free Guarantee for me translates to: in the interest of profits we continue to associate with fraudulent sellers and allow criminals to sell counterfeits even after being made aware of that fact.

Fraudulent products are a safety hazard and can cause death, injuries, and extensive property loss. Counterfeits repeatedly finance terrorist activity. Making fraudulent products available is a crime. I urge consumers to be vigilant of cyber predators. Please report counterfeit merchandise to State and Federal agencies.
