We chose this company to build our home because they advertise on their website as being able to complete a construction in 90-120 days. The salesman also made verbal comments, " if we can get you in this house by ??/??/?? will you sign." We signed our contract at the end of March 2004. Home was not signed over to us until October 2004 so we could complete our portion of the house. So much for 120 days. They were very slow in getting started and hardly ever told us what was going on. Very poor communication with us. Delivered the materials over a month before construction actually begin. Materials(lumber, windows, doors, etc) sat through several rains. Some of the materials were left uncovered. I am now worried that some of the materials that were used in construction were not fit to be used. I ended up having to hire an attorney just to get them to finish the house. They also told my attorney they would wash the "baked on" tree sap off the windows that they let sit under a tree for a couple months. They never did this.
Because they did not finish their part of the house in a decent amout of time I had added extra expense of hiring people to help me get it finished in a timely manner. I had planned on having a little time to finish painting and flooring myself. I feel they are responsible for paying these extra expenses I incurred. They basically waived the contract in my face and said I get nothing. It is a pretty stiff contract. Enough with all this legal crap. They know they did us wrong and even verbally admitted it. I know they felt some sort of guilt because they brought us a $1000 gift card to LOWES for our trouble. I did not want a gift card. I had already bought all I needed for the house and I have no use for a gift card. I wanted cash so I could reimburse myself for the extra cost incurred. I have now come close to bankruptcy trying to payoff the added expenses I took on because of them. Just in the last few weeks I have been able to refinance and get out from under them completely and roll the extra expenses into the mortgage. I would not recommend this company to anyone. EVER! All they care about is getting you to sign their contract, take your money, then do things at their own pace. They also made several mistakes in the building of our home which I will post later.

Even when the consumer goes out of their way to prove there is a problem, they refuse to resolve the issues.

We signed an agreement with these customers on 3/31/04 to build them a home. We began construction on April 16. We did not promise or commit to build the home within 120 days - we strive to do so when all things fall into place, and many times we do build in well under 120 days, but not always. Our contract with these customers says very clearly that we were not commiting to build the home within any specified time and they initialed right beside that provision.
Also, part of the delay was caused by the time the customer took to get power and water to the site because he was doing his own trenching. After those delays, we got going on construction and had the project substantially done by September. The customer continued to give us punch lists after that, which we addressed, and that is what took the job into December - the home was substantially complete in September.
We gave the customer a $1,000 Lowe's gift card as a customer service accommodation. We didn't force him to take it - we offered it and he accepted it. The attorney did not "force" us to do anything. We completed our contract and turned the home over to the customer, as expected.
We completed this project nearly 4 years ago and have received no more complaints from this customer. If we receive one, we will address it in accordance with the contract, the law, and principles of fair dealing.
