I too am a victim of this fraudulent company. My family was forced to "upgrade" from analog to digital, in February, 2005, going to a higher cost plan and starting a new contract (2 years).
This month, July, my husband's phone needed a new battery, so he went to the local store (which by the way has an unlisted phone number!!) where we originally got into this mess. They told him that for just $2.00 more than the cost of a new battery, he could have a new phone. So he took the bait. Now we've received a letter from Verizon stating that on July 2 WE requested to upgrade our equipment and therefore our new contract starts from this date! I have no intention of extending our contract!!
When I called Customer Service, they said there's nothing I can do about it, unless I wanted to pay the $175.00 termination fees. We have 3 phones on this plan. I'm up against a brick wall with this stupid company. Does anybody have any suggestions?

If you were upgraded to digital from analog, you had to have gotten new phones. You could not be placed on another new contract if you were changed in February.
1. Digital requires new phones. If you were not offered new phones at the time, then you should have been advised that you qualified for it at the cheaper 2yr price or possibly free with the New Every Two up to 100.00 credit.
2. If you did get new phones when you changed to digital and there was an issue with the battery, Verizon offers 1yr warranty on their equipment.
3. Was this a Verizon store or a re-seller? Re-sellers have "some" different rules. Go to a Verizon Communication store.
4. Did you call Customer Service? Did you speak with a Supervisor?

I worked for Verizon. I had a line, I have paid this line off three times. It is reported (this single line) under 9 different accounts numbers as an active account (closed in 2001) and I'm working with my Prepaid Legal lawfirm. They actually answered the lawyer and responded with about 1200 pages of call records. And one contract with one account number which I paid twice and then my mortgage co' had to pay when I closed on my house.
Call the Federal Trade Commission. Verizon operates with written contracts. You have to have signed a renewal - verbal ok doesn't fly when the customer challenges it.
Make sure you have the original contract that you did agree to and stick to those terms. Gee - good luck. Verizon Wireless....it's alot like dancing with the devil if you get service with them.

Unfortunately, there might not be too much you can do because whenever you buy a new handset at a store, you may be re-signing a contract as well (which the authorized dealer should have told you upfront). Read your contract again, and it states this as well. Sorry. I wish I could help further...
