In Febrary, I contacted Wells Fargo about getting a modification for my mortgage, and have had nothing but crap from them since then, to the extent that today I found out from other people - not from Wells Fargo - that a date has been set for a sheriff's sale for September 9th.

I wrote to Pete Wissinger, President of Wells Fargo Home Mortgage, telling him of all of the effort I had put into trying to get a straight answer out of Wells Fargo and of the responses I got from them of missing, wrong or information that was sent too late for me to do anything about. He referred my email to Dawn Nelson, who responded with more lies and missing information. I thne responded and even gave him a chart comparing what Dawn said to what really happened and all of the parts Dawn left out - including the fact that she lied to the Minnesota Attorney General's office.

He again referred this to Dawn Nelson who completely ignored all of the issues and said nothing that the processes would be changed, but I was supposed to trust her and them, if I wanted to reapply for the modification.

My take on this is that Mr. Wissinger the processes of making up answers as they go along and outright lying are acceptable business practices, because he never responded to say they weren't. They not only lied to me, but they lied to the Minnesota Attorney General's office, they lied to my relator and they even lied to their own laywer. He gave me back to somebody who I showed had already lied on more than one occasion to respond to what I said and he supports what she says.

If they had been honest with me back in February, I could have and would have sold the house right away. Instead, because they lied to me - and Dawn's first response in writing to me proves they did - my credit is now tanked and I am going to wind up paying fees to them.

Here's what I sent to him and what is ok with happening at Wells Fargo.

My original request for a loan modification in February was acknowledged and was told paperwork would be sent again.

4/21/03 Pre-qualification information taken. Letter sent to customer. Any calls I made before this time. The fax I sent to Iowa in March indicating I had not received the workout papers that were supposed to have been sent in February.

Name of person who took the information is not indicated.
Two letters are sent - one from South Carolina and one from California and both say different things. Both letters give phone numbers to call that would be answered in California - per Dawn Nelson.

4/28/03 Reviewed File. Left message on 612-522-9144 for customer to call. Name of person who called is not indicated. Fax number indicated on San Bernadino letterhead does not go to San Bernadino. First fax sent to David at Muscoy, CA number When I returned call, I was told David was not handling it, Larry was. Left voicemail for Larry to call me.

4/30/03 This information is not indicated in the letter.AM left voicemail for Larry. No call returned.
PM left voicemail for Larry. No call returned.
Called general number to find out they aren't aware that I sent paperwork and was asked to resend.
Was told Larry tried to call this afternoon, but when I picked up the phone, there was no one on the other end, so I hung up. We did not speak. Was given new fax number to resend paperwork - 909-473-3595 (Muscoy, CA). Fax phone rings, but does not pick up. Called general number again and was told to try faxing to 909-880-6907 (Marshall, CA)

5/2/03 Second follow-up call placed to 612-522-9144. Need proof of income. Cannot read. Name of person who made the entry into the computer is notindicated. Received call from Larry to call him. He does not indicate why. I called Larry two times to ask for the status of my paperwork, left voicemail two times, no response (one call was on cell phone, so I have proof of call) Three hang up calls.

5/5/03 Customer to fax proof of income.
The name of person who made the entry into the computer is not indicated. Received a voicemail telling me it was urgent I call 877-216-8448. The call does not indicate an extension or a person to talk to. This number is different than the one I called Larry. Returned call and was not able to get specific information about what information was not clear.

Was told to fax proof of income. All proof of income was faxed to David on 4/27/03 and Larry on 4/30/03
Faxed only income information to Larry - 909-473-3595 Muscoy, CA - numbering each page and asked him to call me on whatever page the information was not clear. Larry does not respond.

5/6/03 Information not received.
Complete information was faxed on 4/27/03 and 4/30/03. Income information faxed to Larry on 5/5/03.

5/8/03 This is not indicated in letter.
Left voicemail for Larry asking for the status of the paperwork and for information on sending in the $1,000 on or before May 15th.

5/9/03 Information received and sent to investor. Investor denies modification. Larry does not return call.
5/9/03 This is not indicated in the letter. According to Liz on 5/30/03, the reason I was denied was because I did not respond to a letter supposedly sent to me by Cheryl Bonson. Cheryl's letter was in their system as being generated on 5/9/03.

5/12/03 This is not indicated in the letter. Larry's voicemail says he is out of the office until 5/19/03.
Called the general number to find out Larry does not handle the account. Ce Ce says Serita Brown now has the account and I should not send the check.
Left a message for Serita to call me.

5/13/03 This is not indicated in the letter. Serita calls to tell me Liz is handling the account, but refuses to give me Liz's phone number. She says I have to wait for Liz to call me

5/14/03 Called and spoke with mortgagor to verify financials, she states they are correct.

The name of the person who made this entry is not indicated. What is the purpose of this call if the modification had already been denied?

5/19/03 Loan referred to foreclosure. Letter dated 5/20/03 from Fort Mill, SC is not sent until July 1, 2003 - postmark on envelope shows 7/1/03 - and arrives 7/5/03. Letter says it has been referred to the attorney with instructions to begin foreclosure proceedings.
The letter tells me to call Borrower Counseling at 800-868-0043 - a different number than all of the other numbers they have given for Borrower Counseling, but would still be answered by Collections in California.

5/29/03 Closing file. Only option per investor is for borrower to pay total amount or to sell property.

The name of the person who made this entry is not indicated. Liz tells me the investor didn't give a reason - "they usually do, but one wasn't given this time." Liz told me if I could come up with $3,020 and agree to increase my payments for several months, she would go back to the investor to see if they would agree to that. That's why the note about me having $1,500 to pay by May 30th is in the file, otherwise why would she be interested in how much money I have if the investor is not offering any other options as Dawn's letter indicates?

5/30/03 Closing file. Called borrower and advised she must contact foreclosure department for total amount in order to stop foreclosure. The name of the person who made the entry is not indicated.

It had already been turned over to foreclosure - according to the letter from South Carolina on May 20, 2003, and according to Liz on 5/26/03. I called Stephenson and Sanford on that date and Becky said she didn't know the payoff amount because Wells Fargo determines that amount, not them.

6/18/03 Mark Stephenson says he has been trying to get the payoff amount from Wells Fargo for 10 days, but their computers have been down.

6/9/03 This is not indicated in the letter. I received a letter from San Bernadino, CA telling me the investor denied the modification because "it was not in their best interest." There is no specific reason on it. The letter gives 800-344-6723 X6055 to call with questions. This is the number where Ce Ce, Larry and Serita are.

6/18/03 This is not indicated in the letter.My realtor calls 800-344-6723 X6055 to find out the payoff amount and is told a sheriff's sale is set for 6/20/03, but she can't be told a payoff amount.

Mark Stephenson says he has been trying to get the payoff amount from Wells Fargo for 10 days, but their computers have been down.

6/24/03 This is not indicated in the letter.
In a conference call with Peggy Weldon (Minnesota Attorney General's office) and me Dawn Nelson states the reason the modification was denied was because I did not send in the $1,000 as the letter from South Carolina indicated. According to Dawn, it didn't matter that the letter from California didn't mention the letter from South Carolina or that it didn't say the same thing - even though it was generated the day after the South Carolina letter. It was denied on the 9th, and the payment wasn't due until the 16th.

7/5/03 This is not indicated in the letter.
Received a letter dated 5/20/03, but postmarked 7/1/03 from South Carolina telling me the account had been turned over to Stephenson and Sanford for foreclosure proceedings. It says that due to the default under the terms of the mortgage, the entire balance is due and payable. If this happened on 5/20/03, then what was Liz asking for more money for on 5/30/03?

This letter also states I can call Borrower Counseling at 800-868-0043 if I want to explore an opportunity to reinstate or if I need assistance in selling the property. What they call "Borrower Counseling" is collections - Ce Ce, Larry and Serita in California - as per Dawn Nelson on 6/24/03. The 5/29/03 entry says the only options available are to pay the entire amount or sell the property.

If there were other options, then why was the application denied and why weren't those other options offered before this time?

7/26/03 I get notices in the mail from realtors telling me a sheriff's sale has been set for 9/9/03. I don't get a notice from Wells Fargo, neither does my realtor, although Wells Fargo has contact information for both of us
