My family and I drove thru Gatlinburg and with no hotel reservations we stopped at city's tourism bureau where a tourism employee indicated she could get us a cabin for the night and then if we would agree to attend a "90" minute presentation the next morning at Westgate, Westgate would refund the $ we paid for the hotel.
Westgate officials did not give us a complete copy of closing papers and we did not discover this until we got back to Tampa. We tried to get closing papers faxed, no one could help us. I called several phone numbers I had to find on my own and was told that there was no fax number and there was no "corporate counsel" to whom I could send anything or call.
Westgate officials evaded our requests and are now saying it is past our rescission period. We did get our complete closing papers in the mail but only after the rescission deadline has passed. We are collecting names and complaints from others and will pursue filing a class action lawsuit against this company.
They are a huge company and the City of Gatlinburg should not allow them to tarnish their beautiful City's name in this manner.

I understand where you are all coming from, being that you did have bad sales reps who are malicious trying to sell their product. But do remember that the majority of owners with westgate are HAPPY! I'm a sales rep with the westgate lakes resort and I have personally walked the property and asked owners how they like owning, and I have never recieved a negative response aside from that they cant afford a second week.
In cases where they "hide" the closing documents you probably had a dishonest sales rep. I personally HAND the closing document to my new owners, along with my personal cell phone number. I have woken up to phone calls at 2am to answer questions for my owners. I've learned that it all begins with the presentation, if you have a lying sales rep you might have problems. Im always honest with my owners because i dont want cell phone calls at 2 am from angry owners. Its not a bad business, theres just bad people working for the business.
Remember theres 400,000 owners with westgate the percentage of disgruntled owners is very low, in fact westgate has the lowest cancellation percentage in the timeshare industry. Im truly sorry for your problems that you have had, and for all purposes keep pushing for what your tryin to acheive in your lawsuits, but just remember not everyone in timeshare is in the business of lying. Please tell us how you were aboe to get a refund from Westgate Resorts. I have not been so fortunate and have hired an attorney to deal with our complaint against the lying crooks at Westgate Resorts. We have been delinquent in our payments since Dec '05 and they still have not even started foreclosure. Not sure what gives, but they won't get another penny from us. I have sent Westgate Resorts a letter voiding our contract 'ab initio' due to the misrepresentations, careless and reckless statements, negligence by sales staff by providing misinformation, etc. They do not respond with any intelligence to any of our complaints. They just say, we are still obligated to fulfill our purchase (despite the lies, fraud and deceipt).
We will have to see what a lawyer can do.

Told by a rep for Fla Atty General's office they could not help us, then received letter confirming they could not, made contact with attorney, shortly thereafter was contacted by Allen or Alan (will leave last name out) with Fla Atty General's office who requested more information assuring me he was pretty sure case would be resolved in our favor, few weeks went by, received yet another phone call from Fla Atty General's office stating they could not help us, and received yet another letter confirming they could not help us but they were forwarding to DBPR, then shortly thereafter received yet another phone call from my wonderful friend Allan at Fla Atty Gen Office requesting more information, you guessed it, another letter stating they could not help us, this cycle went on and on (I kept specific notes on dates, times and individuals talked with). This circus continued with us repeating our demands and affirmatively stating we would not yield. We had talked with several different attorneys and experts to review our documents, including the "owners CD" which allegedly contained our "owners documents" (but did not). I too sent a FOIA letter to the DBPR who had some jerk call me. He very curtly informed me that he had literally thousands of documents to go through - too bad - I asked that he inform me as to the exact amount of $ due for copying, etc. That was the last I heard from the DBPR. Finally on November 7, 2005 we received our refund and cancellation of our timeshare. Though our complaint was finally resolved in our favor, my husband and I are still very angry. We were treated like morons by the Atty General's reps and the DBPR's reps. During this time, I have researched and talked with many different individuals who have had the same experience. My research showed that the owner of Westgate David Siegel is a big contributor to the Republican Party. I am a die hard Republican - though we cannot afford to contribute thousands of dollars like Siegel - we did make minor donations to the Republica Party - since our experience with Westgate, Fla Atty General's office and DBPR, we will no longer renew our "republican party" membership. We still strongly support our GOP, but will no longer make monetary donations. I would suggest to Charlie Crist that if he wants to be governor of Florida, he reorganize his departments before he leaves office. We won't be voting for him. I encourage everyone who has ever had a problem with Westgate to never ever give up - these companies thrive on dishonesty. God Bless you all and don't quit fighting.

We have the similar experience, but luckily recind within the recission period, got refund back with deduction of breakfast and binder.
These salesmen are heartless, only good at one thing --lying, they never tell new owners there is a recission period, and the contract is usually hidden in a secret place and hopefully new owners will never find out.
I even made a call to ask if I can back off, and all I was told is lies, luckily, I fount out on the internet and was able to recind.
I lost about $100, but still felt very lucky, I know many people were ripped off for thousands of dollars, I never imagine there is such a dirty business in the united states.

We filed a complaint and are collecting names of people who are having the same problems with Westgate. All too often people really don't want to take the effort to fight the crime. We have to stand up and tell these companies they are no longer going to get away with stealing from people. I don't know how they can sleep at night. What really really upsets me is when we were given the presentation, the sales person was very quick to point out Steve Seigel's picture with President Bush. I certainly hope the President that I voted and campaigned so hard for is not supporting this company. We will never ever give up until we are completely satisfied. We will allow the atty generals and city of gatlinburg to do their research and if we are not satisfied we will pursue legal action.

You might also want to send a letter to the FTC for good measure. My letter to the Florida Attorney General's office was forwarded to the Department of Business and Professional Regulation (DBPR), as the DBPR's Division of Florida Land Sales, Condominiums and Mobile Homes regulates the creation, sale, and operation of timeshare plans in the State of Florida.
If it is your expectation that you might reach a resolution through a government agency or the BBB, I would suggest you not have a lawyer contact Westgate until it is evident that the agencies cannot reach a satisfactory resolution on your behalf. Agencies will claim their policy prohibits the processing of complaints if your complaint is in the hands of an attorney or the courts.
I had a lawyer review my documents to confirm I had a legitimate complaint. His contact with Westgate included one telephone call with a Gail Anderson on April 19, 2004, and a Letter of Demand dated May 4, 2004.
Here's my experience. I was able to get the DBPR notes through the Freedom of Information Act. The following is from my notes and those of the DBPR investigator and will illustrate the kind of tactics to expect from Westgate:
5/7 Letter of Demand received by Westgate. The letter requested a response within 30 days. My attorney and I agreed his involvement would end with his opinion and a demand letter to Westgate.
6/9 DBPR investigator faxed a letter to Westgate asking that they address my contract issues. 30 days have passed since Westgate received my attorney's letter. No response to attorney in all this time.
6/15 DBPR investigator made a telephone call to Nicole Dowling. She states Westgate is currently negotiating with the complainant's attorney (Oh, really?). There were no ongoing negotiations. If my attorney had had ongoing conversations with Westgate, I was not charged for them. And why, pray tell, would an attorney not charge you for calls made/received on your behalf? As such she stated that they are unable to respond to both the complainant's attorney and the DBPR and felt that this case file may need to be closed. The investigator informed her that beyond reviewing paperwork and writing the demand letter, the attorney was no longer involved in negotiations. At this point almost 40 days have come and gone since Westgate received my attorney's letter. Nicole's statement was bogus and simply an attempt to get DBPR to have the case file closed.
6/21 DBPR investigator made a call to Mr. Briganti who stated that there have been several conversations with the complainant's attorney (sigh) and that Westgate sent a formal response to the attorney last week. As of this date no formal response was received. The actual response was dated 6/17, postmarked 6/22 and received by attorney 6/24.
Be prepared for Westgate to ignore, deny, stall, misrepresent - whatever it takes for you to give up and go away. Don't give up. Keep us updated. I wish you every success.

We've been owners for about 16 years but didn't have a serious complaint until our recent upgrade. Now that we have experienced for ourselvs how Westgate "resolves" problems with its owners, we fully agree Westgate must be brought to accountability for its unethical tactics.
