LOAN WAS SOLD
Like everyone else here, my loan was sold. It was sold to Chase Bank but there is one major detail, Wilshire "services" my loan. Chase has absolutely no contact with me whatsoever. Makes me wonder if they even know what is going on.
FINANCIAL TROUBLE, THE HOUSE IS PUT UP FOR SALE
I made my payments on time for a good while until I had some financial trouble, so I put my home up for sale. Wilshire was aware of this because when I first called them to let them know I was having trouble making payments, they suggested that I sell the house because I had plenty of time, I had only missed one payment at that point. I let them know that the house had been on the market for a while now and that I had a few very interested buyers. I continued to show the house until I had a solid contract with a well-qualified buyer who was willing to pay all my closing costs! The buyer made me a full price offer and we set a closing date.
I called Wilshire and let them know. The title company also called them and requested a payoff. They sent it. I owed more than my selling price and
the appraisal was ordered by the buyer and it came back $3,000 short (about the same amount of my prepayment penalty which was going to expire in a month or so).
REQUESTED A SHORT SALE, WILSHIRE DOES NOT RESPOND
I ordered a discounted payoff and amended the closing date to give Wilshire plenty of time to respond. I sent Wilshire all the requested documents and they said(in writing) it would take two weeks to respond. Well, a whole month went by and no response. Every time I called Wilshire, I would automatically be directed to a rep by the name Dona Rolf, only she never answers her phone! I left her message after message wanting to know the status of my discounted sale approval. The title company also kept calling her but she NEVER responded.
All of a sudden an appraiser sent by Wilshire calls me because he needs to get inside the house to do an interior BPO. This was done and I was left still waiting on Dona to call me back.
READY TO CLOSE, ORDERED A PAYOFF
By this time, my penalty had expired and I was going to pay any remaining shortage for the buyer. Big deal, it wasn't much. I amended the closing date to get a new payoff quote from Wilshire and I left Dona yet another message stating I was ready to close and there was no need for a discount anymore and we needed approval. The title company also called her. Did she call us back? NOT A CHANCE! My buyers' loan expired on April 9th. Wilshire knew this from all the messages we left on Dona's voice-mail and the short-sale package I sent them. I tried talking to other reps and they all said Dona Rolf was taking care of my loan so they couldn't help me. The buyer and I signed the contract in January 2007. We waited on Wilshire up until April 9th,2007( the last day we could close). They did not respond, not once. I lost the buyer.
LOCKS WERE CHANGED!!!!!
Three days later...
I was getting ready to show the house to another prospective buyer and I arrive at the property to find a huge pick-up with a trailer on top of my lawn and a group of people cutting the grass and changing my locks!!! I called the police and these people told the cops my house had already been foreclosed on the first Tuesday in April and that Wilshire had sent them out to "secure" the property. I told the cop that I didn't receive notice of foreclosure; he needed something in writing stating that the house had not yet been foreclosed or I would be arrested for criminal trespassing!!! An hour later guess who calls me? Yep! Dona Rolf. I immediately asked why she did not return any of my phone calls and she said she never received a single message from me or even from the title company. So I asked "Then why are you calling me?" She paused and responded by asking her own question,"Is there something you need to discuss with me? OH PLEASE!!! Of coarse she got all my messages! She just freaked out when the guys cutting the grass called her to let her know I called the police on them!!
I sent a request in writing to their attorney Mackie Wolf & Zientz PC to get the lock box code and they failed to respond too. Not Surprised.
My house will foreclose on June 5th 2007. I finally received notice from Wilshires attorney. A bit late, don't you think?
I am definitely filing a law suit against Wilshire and Chase and I will advise my attorney to read all of these reports.
My take on all this is that Wilshire does not lose money when a house is foreclosed because they make their money by "servicing the loans", they do NOT fund them. If they foreclose and then sell that same property, they still make a profit. I'm guessing the actual loan holders have no idea how Wilshire conducts it's business and cover up so many deceptive practices. It's a shame they don't care how it is affecting so many people. Just visit their website and you'll see, they have a section of all the homes they have foreclosed and are now selling. They should add pictures of all the families they have affected too.
I have already sent my complaint to the Federal Trade Commission and I advise all of you who have not done so to do so. Yeah, we may have gotten behind on our payments but we all were treated unfairly as we all tried in good faith to resolve our situations so don't give up and FIGHT for your RIGHTS!!
One last note. Do some research on Wilshire and you'll be surprised at what you'll find.
