I PURCHASED A BRAND NEW TANK SCOUT JIANSHE 400U ATV OFF "SEVENLOTUSIC" (EBAY SELLER NAME FOR TANK-SPORTS) ON NOVEMBER 5TH 2009.  THIS ATV APPEARED TO BE A GREAT DEAL AT $2600 SHIPPED TO ME.  I finally recieved the atv on Novemebr 16th.  I remeoved it from the shipping crate only to find a bunch of broken and defective parts on the atv.  I notified Jim at Tank Sports and he assured me that things would be straightened out and they would take care of me.  I sent pictures of the defective items which included a cracked cylinder head heat sink, broken control switches, broken light lenses all around the atv and a broken fuel switch.  So a few weeks go by and still no parts.  Now I have noticed that a boot and seal have broken and are leaking on the rear differential of the atv so I report these problems.  Jim still assures me that these things were being taken care of and he was on top of it.  After about a month of no resolution I am getting aggrivated and threaten to use legal action.  A few days later I recieve an email with a picture of the shipping label from Tank-Sports.  7 days later I recieve the box finally to open it up to broken lenses, stripped screws all of which were replacement parts removed from a used atv.  I am extremely annoyed now.  I was also promised the seals, boot and a replacement cylinder head all of which were not sent.  I am going to copy and paste my emails from tank sports so you can see the promises that were broken one after each other from the point I did business with this company.

Here is a review of your company and the customer service I have recieved in the link below.  Please read the attached emails too between Jim, James, Dona and myself. I can't seem to get anything accomplished with any of these people so I thought I would pass this mess over to the parts department and general inquiries.  I had enough and hired a lawyer (my brother) to contact California Motor Vehicle tomorrow and file a complaint.  I haven't asked for much but for your company to replace defective parts on the atv I purchase and all I seem to get is lies in return.  I don't even have a title for this atv yet.  I was told it would be shipped 2 weeks after the purchase date.  Where is it??

I contacted a lawyer today about all the issues I have been having with your company and product.  I haven't recieved a response in days once again.  Promises broken again..  I will be contacting California Motor Vehicle and my Lawyer will be mailing a letter to them on my behalf.  I've had enough of the games.  Here is some information he gave me on your company today.  I have everything I need to file a complaint tomorrow morning against your business. 

 

As to the legal title issue, you should receive a certificate of origin, maybe another document that enables one to get a legal title.
What I would do is encourage them to work with you to your satisfaction, otherwise you will contact California motor vehicle agencies and file a complaint. I am sure this will help get some response. They do NOT want to lose their California vehicle distributor license.

Following is some specific info you can use.

Documents needed to register an OHV that has never been registered in California

If you purchase a new or used OHV from a California licensed dealer, the dealer will collect the fees due from you and provide the department with these fees and documents to transfer or register the OHV for you.
If you purchased an OHV that has never been registered in California from anyone other than a California dealer, you will need:


  • An Application for Title or Registration (REG 343).
  • A vehicle verification by an authorized DMV employee or law enforcement officer, vehicle verifier, or authorized auto club employee.
  • Evidence of ownership, which may be:

    • The Manufacturers Certification of Origin endorsed to the nonlicensed dealer and any bills of sale needed to establish a complete chain of ownership to you.
    • An original or certified copy of the factory invoice to the nonlicensed dealer and any bills of sale needed to establish a complete chain of ownership to you.
    • Out-of-state titling documents and any bills of sale needed to establish a complete chain of ownership to you.

  • OHV fees and use tax, if due.

The Department of Motor Vehicles collects OHV licensing fees and maintains registration records pursuant to Vehicle Code 38010.

I am sure they have legal requirements to send you the proper papers, irrespective if the sale was out of state. If they have not done this according to the vehicle code, they you have something against them to report unless you get your issues resolved.

You have too much at stake and I feel your anxiety and frustration. I am sure you will get their attention when you get your facts and jargon down and start talking about getting California DMV involved. NOBODY who is sane wants anything more than the least involvement by them.

I reported all these issues on the 17th.  It is now Dec 8th.  The package could have went back and forth 4+ times by now.  I had the clutch adjusted and it will be fine but every one of my lenses is taking in water except for the headlamps.  The rear brake light and both front blinkers now are taking in moisture

He might have overlooked the email that you sent him. But please note that we always try our best to fulfill our commitment and to the best of our ability to satisfy customers.

I see that you have already filed a dispute on paypal and left a negative feedback on ebay. I am sorry that you are at this tough situation. It is very unfortunate that the thanks giving weekend along with the blaze that took out the telephone box have caused so much issues. Remember I told you we had UPS pickup the parts box, but because there was no internet we could not upload or get tracking #s? well because we couldn't upload or get tracking numbers that entire 2 day worth of packages that we sent out are lost. your package isn't the only one. we have dealers that purchased 20 vehicles wanting their package but the situation does not discriminate.

the package was returned back to our facility as of today after a round trip to san bernadino sorting facility.

so lets come back to the subject on hand. as according to Don's reply, he wanted you to adjust the clutch, you asked for directions but he has not replied. This I will speak to don about tomorrow morning first thing.

Second your package will once again be shipped, and this time we will have a tracking number tomorrow.

Third we have already issued a partial refund on paypal. As you might have already read and reread, the ebay auction terms are very clear, no cool downs and as is with defective parts only warranty. Therefor, I am unable to honor any labor warranty or claims, straight parts only.

since we will be sending out the package tomorrow roughly around 4pm. please let me know if there is anything else you want don to claim as warranty before we mail the package out, do not worry if you don't get it don tomorrow. we have more time later on as well.

The 400U is a great bike, comparing to other 400CC class vehicles from China its very well made. As your friend in the dealership might have even noticed, the 400U is almost a direct clone of the Yamaha (grizzly i believe it is). Jianshe of China is actually a joint venture of Yamaha. We indeed have sold many and many units. Very rarely does it come down with as much issues as you are experiencing. I am deeply sorry about that. But please let me know if the clutch needed to be replaced. get me photos of it asap so I can pass it along to Dona our tech.

James, Jim, Don or whoever I am dealing with now.  I just wanted make you aware that I have been doing a review on your company and product since we have owned your Jianshe 400U.  The timeline and comments can be viewed at the link below.  I am very frusterated and fet up with the communication and quality of the ATV.  I have shared my knowledge with a larger portion of the powersports communtity on the internet positive and negative.  After almost a month I have recieved a measly $100 partial refund.  The first round of defective parts issue were reported 3 weeks ago.. Still no parts.... Now I am forced to do time intensive repairs to the atv without being compensated for it.  I am hoping this is a joke and maybe you can do the right thing and start refunding some cash or come pick this junk up and send me one that is worth while.  I've had enough of tank-sports and Jianshe products. I will also be leaving negative ebay feedback as of Saturday which will be a month since purchase if things are not straightened out to my satisfaction.  The way I see it is I paid $2600 for an ATV worth less than $1500 to me.  The repairs are costly and labor intensive and on top of that I can't even use the atv becuase your company has issues standing behind their product.  It's great to be promised parts but to wait for them for 3 weeks is a joke.

Dona,  I will repair the quad but can you send the clutch adjustment procedure to me so I can adjust the clutch properly.  I will also be needing the 2 boots on the front of the swing arm that connect the drive shaft tube to the transmission/engine.  The front one is completely ripped as seen in the pictures and the rear one appears to be dry rotted already.  I'll replace the pinion sea/boots and adjust the clutch in my shop but we are talking quite a bit of labor to do all this work and have to adjust the clutches already.  This really starting to bug me.  You company is really lucky I am a licensed mechanic.  I feel taken advantage of just a bit.  What would you of done if I was just your average customer who had no mechanical knowledge?  To adjust the clutches and replace the differential pinion seal is probably $500-800 worth of work at any motorsports dealership.  Can I be compensated for any of my time and labor or is that just expected of me for purchasing this atv?  I don't mean to sound rude but come on, 76 miles and I'm already turning the wrench on it, still waiting for my parts and haven't recieved any partial refund at all...  I'm so aggrivated right now I am considering putting the atv for sale once I replace all the defective parts, repair the rear end leak and clutch slipping.  Then at least I could buy something more dependable and enjoy it instead of working on it constantly

  I would like to apologize on the many issues you have encountered with your new 400cc atv. The issues that you have mentioned are not common problems and I would like to help you to the best of my capability. It seems that the seal is the cause of the problem and would like to send you a replacement seal at no charge. From what you have explained, the main pinion seal is defective, can you confirm this is the defective part causing the oil leak. The performance issue can be caused by the clutch. I have more issues already with this atv.  I am pretty sure the rear pinion seal was defective.  It looks like the seal was leaking from the rear end differential down the tube/shaft into the front boot.  I went to strap the quad down on the trailer today and when I compressed the suspension to secure the quad I heard a pop and found about a 1/4 of a quart of gear lube below the boot on the trailer.  The boot must of been loaded up with gear oil from the pinion seal leak and blew open, leaking fluid everywhere.  I am not 100% positive that the pinion seal is what's wrong but it's a good posibility.  I also noticed that when I ride the atv that the transmission revs in different gear and at different speeds instead of gripping the gears and accelerating smoothly.  Seems like I am letting off the throttle quite a bit to allow the engine speed to keep up with the transmission.  I've attached pictures of the cracked boot leaking gear lube and have absolutely no idea what could be wrong with the transmission.  I'm just so aggrivated right now.  I woke up at 7am this morning to meet some people to ride, loaded the quad, noticed the leak, put the atv back in the garage and went back to bed.  Starting to get tired of the issues.  I've only had the atv 3 weeks and have had nothing but problems.  I've only done light riding with my 5 year old nephew too and it's already breaking.  His little 110cc Tao Tao atv has held up better than this one for $2600.  I am staring to think I should of bought a used name brand atv for the money and would of been better off or spent and extra $1500 to buy brand new from a local dealer.  Let me know what the next step is please.  I'm really getting sick of wasting all my time fooling with this atv.  I've spent just as much time addressing problems than I have riding it probably.  I should be able to get on it and go without all this hassle.

Mark, James is not in today. I read your email. I broke down the issues you wrote to reply to them on a one by one basis.

as for the parts, we will be sending out the parts sometime today.

as for the engine, it is certain that the engine was not dropped. the mfg would not install and engine that was dropped. the fins on the engine do chip from time to time. sometimes they are dinged when it is being lowered into the frame or from the engines hoised up on chains for installation. fins gets chips from riding also when pebbles hits the fins. out of the units that we have sold in the past on or off the internet, we have not had a defective engine due to an engine drop, neither have we seen a chipped fin on the 400u. prior email you have stated that the engine seems to perform well without issues, that leads me to conclude that the engine was not dropped. but even thou i am very certain that the engine is good, i will include a cylinder head for you as you have requested.

as for the prices, thats something that we can't really do anything for you. You purchased the vehicle with the buy it now option, we can not offer you discounts.

as for the resale value, i can't really help you on that one either, ATV goes though a lot more wear and tear than other products because of their intended usage. i am not an expert in resale value but based on looking at cycle trader magazine, the 2nd hand price for ATV has always been lower compared to the street bikes.

As for the $50 discount, it only applies to the cosmetic damage to the heat fins.

I will talk to James again see what he thinks as well.

Hi Mark wanted to give you an update. My tech is looking for a right light right now, we have the lever switch and left light. we will be getting the parts to you asap.

as for the chip on the fin, the tech said that its visual, the chip will not impact your engine. he recommended getting the sharp edges filed down to avoid any scrapes. i spoke with James and he wants to offer you a $50 credit back for all the issue and for filing down the sharp edges. The refund will be made to your paypal account on monday.

Just so you can explain to the tech if he asks why the lenses are leaking.  I found that where the phillips head screw goes through the lense into the light housing, the screw had been overtightened on the rear ones and put small cracks in the rear lenses at that location.  Causing the moisture/water to enter the light assembly

CALIFORNIA DMV INVESTIGATORS NEVER EVEN CONTACTED ME AND I HAVE NOT HAD ANY RESOLUTION TO THIS MATTER.  LESSON LEARNED...DON'T BUY ANYTHING OVER $100 OFF EBAY AND STAY AWAY FROM MAIL ORDER CHINESE ATV'S!! IT'S TOO GOOD TO BE TRUE OBVIOUSLY AND NO ONE CAN BE TRUSTED THESE DAYS!!

JIM from TANK SPORTS sends me more damaged used parts!!

After months of waiting today a USED cylinder head arrives from Tank Sports. I don't know if I should be happy or mad. It's used and who knows if it is any good. I was so shocked I even recieved the part. Once again I get one that is damaged. I have no clue why they waste their shipping money. All I can do is laugh now. I have no anger left inside me. Now just waiting for the clutch, lenses, controls, boots, seals ect... Looks like Motor Vehicle gave them the nudge they needed to get rolling or maybe Jim had no excuses left for me.

I would like to correct my last post.  I stated that the Tank-Sports website advertises the ATV to be 495 lb.  I made a mistake it is actually 595.2 lbs and the Cerificate of Origin states it weighs 300lbs.  Big Difference!!

I called ebay yesterday and filed a complaint with them.  After chasing Tank-Sports for answers for weeks and weeks.  This is how they respond to the ebay claim.  I left it to the EBAY representative to straighten this out and hopefully they can make the right desicion for me.

"Every blinker lense assembly you sent me to repair the defective ones I have already is broken. Would you like me to send you pictures of all 8 of them now??? Maybe your "water damaged box" did some damage to my "new lense assemblies." I'm really sick of the excuses. I do not want a cylinder head that has been sitting in a water damaged box either as it probably is starting to corode the bare metal. This atv is completely defective we are not just talking about lenses anymore. The rear differential oil seal blew out of it and you failed to send me those parts also. The engine has a chunk of metal taken out of it and along with all the other cosmetic issues that came along with it. Leaking lenses, broken switches ect.... I want my money back so come pick up your defective atv. I tried to call Tank-Sports today again and your numbers do not even go to a voicemail anymore. I've contacted California Motor Vehicle Investigation Department and they will be investigating your busines"

"Hi Mark, Remember how the package came back and we had to resend? The package was reboxed because of water damage. The repackage did not put the cylinder in as we forgot. We will be sending it out, today. As for the turn signal lights, they were taken off of our only showroom sample to fulfill the urgency of your order. there are more turn signal lights on the way in a container, but however we imagined it would please you to know that we took them off of our showroom unit to get yours up and running. I inspected the lights before they were wrapped in plastic and they were in decent conditions, no broken tabs. In regards to us sending you defective parts, the parts that was sent to you, are not defective. I assume you are talking about the lenses still? Sorry we have to stick with what the auction states. Defective parts coverage only. If you can let me know what you need when you can. "

Doesn't sound like fun...

'The factory does not drop engines'

LOL!

Are they in the factory every minute, and know this for sure?

I taught English at an electronics factory in China.  I had to walk through the packaging warehouse on my way in one time, because they were repairing the main door.  Right in front of me, someone dropped 20 or so DVD players off a conveyor belt.  It was about a 6 foot drop.  A few of them lost the face plating.  I had a birds eye view of the packaging department, from my classroom.  I watched for about 15 minutes to see what they would do.  They picked them up and stacked them.  Broken display covers were thrown out.  Someone came a few minutes later with a handful of small plastic transparents.  Right there, they snapped on new covers, then put them all in boxes without even testing to see if they had broken any of them.

A good example

This is not intended to be any kind of criticism of you.  I would be as upset as you are.


It is, however, a good lesson for other people.  Don't buy something like this sight unseen. It SHOULD be safe to buy something new this way but obviously it's not.  Buy it locally and buy the exact one you see at a dealer, not one they order and ship in. If it's not local, either travel to look at the exact machine and be prepared to take it with you, maybe even take someone with you who has in depth knowledge.  OR don't buy it.


Even with all this you could get a lemon but at least your chances are greatly improved.

I JUST WANTED TO UPDATE PICTURES.  I HAVE CONTACTED THE SOUTH EL MONTE CALIFORNIA INVESTIGATION BRAND OF THE DEPARTMENT OF MOTOR VEHICLE AND THEY WILL BE LOOKING INTO THIS CASE.
