Bank of America markets their company to unsuspecting foreigners as "The Bank of America". They knowingly deceive the public making us believe that they are the nations bank.

Monday January 6                              

Like most mornings, I dropped my son off at school and proceeded down Hillsborough Ave to my morning stop for supplies.  Gum, iced teas and coffee for the office.  The proprietor was on the phone screaming at someone about a money order.

“he was there on Saturday with the money order”
“can you please waive the late fee?”

I had been in real estate long enough to know exactly what was going on.  Turns out that the proprietor had done a money order for a customer who was paying his rent late and incurred a $50 late charge because the rent was not there before the grace period Saturday.

This argument continued while I stood in line for the next ten minutes.  I was amused, very amused.  The Property management company stood their ground.  They were there on Saturday collecting everyone else’s money orders.  My next thought was Bank of America.  Why Bank of America not Chase or Baybank?  Don’t mortgage companies give you a fifteen day grace period, well if it’s not fifteen days it’s certainly longer than three.  How can scumlords be more aggressive spitting out late fees than Bank of America.  The situation was absurd but I had seen it many times before.  The store owner made me stand there and listen to his entire conversation.  It’s a small neighborhood shop.  I go there to try and keep my business local even though he doesn’t have what I need half the time.  Inventories low, products differ a little than 7-11 but he’s two blocks from my office so I support when I can.

Of course, every time that Bank of America comes in to my head, I get angry.  The greatest fraud ever pulled off in American. 

I was surprised to discover the English(1) is the third most common native language in the world behind Chinese and Spanish.  I just always assumed it was English. In our country of immigrants English was a second language for me, my father, his father.  When an immigrant comes to the United States and sets eyes on his first Bank of America sign what does he think?  Remember the sign also includes a misleading logo in the colors and shape of a waving American flag.  Now lets suppose right next to the Bank of America is a Wells Fargo who also has a logo of an old horse drawn carriage.  I assume the carriage represents a company history dating back to 1863.  So, this immigrant who later becomes a surgeon wants to deposit his remaining $19, which bank should he choose?  Which bank does he choose and why?

For years without exception every Spanish speaking client I have had, uses Bank of America.  I always ask them why Bank of America? And there answer is always the same “Banco de America”.  Which has always had me wondering: if normal American people believe that Bank of America is the bank of the United States then isn’t that an unfair advantage?   Hey when the big wigs were sitting around thinking up names did anyone suggest the name and logos might be deceptive?  Is there a memo, notes, people who remember how the name was conceived?  If there was any collusion in the name or marketing process we have a much bigger closing the doors problem. 

My first bank account was with Baybank which was later bought or taken over by Bank of America which absolutely thrilled me because I assumed the Government was in charge. 

In real estate we study a lot about deception and deceptive business practices.  We are held accountable for just about everything we say and do.  My signs must be easily identifiable, with my name and firm so a pedestrian can call of look up my license and credentials.  What if I could create a sign and image for my business that made ordinary people believe that I was the Real Estate Broker of the United States Government.  This would clearly be illegal and any business that I receive form this deceptive marketing should certainly be subject to forfeiture. 

I have been thinking about this for years: bank of America needs to change it’s name.  If there was any collusion ever about the marketing fraud Bank of America needs to close it’s doors and liquidate to pay restitution to everyone who had ever done business with Bank of America.

I apologize for the use of the word “CASE” if it implies anything having to do with law.  I am not a lawyer, I don’t know anything about law.  About twenty years ago I tried to sue someone that was using deceptive advertising.  I read up on a lot of local and federal “deceptive business” law.  Very similar in the licensed real estate brokerage business (REALTORS). 

I learned a lot twenty years ago about deceptive business.  Remember the auto dealer industry got spanked hard for all of their Sunday paper false advertising.  New Corvette $19,000. With about twenty thousand dollars in undisclosed requirements.  Oh and they only have one available at that price and it just rolled off the lot.

The use of “CASE” going forward references this body of work and my point of view.  It is not a legal case because I don’t know what a legal case is.  I am smart enough to know that my point of view will come under a lot of scrutiny.  So just like I would when I fight my Home Owners Association, I will gather information that supports my point of view.  It wont be hard, just time consuming.

I have been thinking about immigrants and tourists because they might not speak English.  It occurred to me a few days ago that this charade has nothing to do with the language someone speaks.  In fact why would anyone born in the United States believe anything but Bank Of America is Americas bank.  So I asked my seventeen year old son:

ME       What is the first thing you think about when I say “Bank of America”

SON     An American flag, I think of the logo an American flag

ME       Is Bank of America our countries Bank?  Our Governments bank?

He stared me in the eyes for clues as he thought hard.  Then announced:

SON     No! but it looks like it is

ME       How do you know it is not our government’s bank?

He shrugged his shoulders and could not answer.

I didn’t know my son was so smart, maybe he has heard me yelling about Bank of America.  How would he know that Bank of America is NOT American Bank?  How did I know? 

So, getting back to the case and data.  I know I have talked to at least ten Spanish speaking clients in the last few months who have mortgages with Bank of America.  Without hesitation all of them use Bank of America because they believe it is the countries bank.  Why would I ask?  For years Bank of America was the worst bank nationwide for approving short sales.  Then they had the Robosigning scandal of 2010.  They were foreclosing on their mortgage customers using ruthless attorneys and an illegal process.  Including having office workers sign affidavits they knew nothing about.  No one served a minute in prison that I am aware of.

Every time a Spanish speaking client came in to the office I just knew we had an uphill battle.  I guessed their mortgage was with Bank of America and sure enough it was.

How many people do we need to verify this deception?  Is ten enough?  How many deceived customers do I need before I can extrapolate that the problem exists on a world scale.  When a Spanish speaking person walks in to the lobby of a Bank of America and greeter “este el banco de America”  How does the greeter respond “si, es el banco de America” is not a lie but not true either. Does the language difference create a different meaning.  Would my son ever walk in to the Bank of America and ask the question “is this the Bank of America”  Would both the teenager and the Spanish speaking person assume it was the countries bank.  Why would they not?  When one of the largest companies in the world uses the American flag it creates a relationship, an expectation with the country and its government. 

Is the word America synonymous with the United States of America.  Obviously it is, in everyday English, we call it the American Flag.  Eddie Murphy is “Coming to America”.

It’s important to establish that American means the US Government or the country of the United States.  That people around the world associate America directly as the United States of America.  Which extrapolated means that Bank of America is thought of as the Bank of the United States of America.  This name would obviously be ridiculous and laughable if they are not the nation’s bank.  Is not Banco de America equally deceptive, ridiculous and laughable?

If the choice of the name “Bank of America” was just a poor choice then the remedy is obvious, they will have to change their name.  However, if there was ever any collusion or discussion from within Bank of America indicating that they knew about the deceptive marketing, they have a very big problem

The classic story about the Chevy Nova, or No go in Spanish.   Looking back you think “morons”  there wasn’t one Spanish speaking person at GM who could speak up.  Obviously an honest and costly mistake.  Was Bank of America’s mistake honest and costly, not a chance!  It was and continues to be expertly calculated and effective, but blatantly deceptive.

Rule #1 We cannot use marketing that might (does) deceive a portion of the general public.

Rule#2 If we advertise price or quantity the item had better be available

Rule#3 marketing cannot lie, fabricate, exaggerate or otherwise up market a product

If we sell a product to a new customer through the use of deceptive marketing

It is important to establish that the words perception of the language “Bank of XYZ” Where XYZ equals the country.  The perception will clearly be that the name itself For instance if you are born and raised in Canada does “Bank of Canada”  (insert section on word meaning..) have a different meaning than let’s say Wells Fargo Bank.  Obviously the banks intentions are clear, to let the public know that they are the country’s bank.

It is clear what statement can be made from just a little data.  Every other country that uses the language “Bank of” or “Banco de” or “Banque du” or “中國銀行” is referring to the countries bank. 

A simple google search for the largest countries in the world brings us to Wikipedia again. I searched “Bank of the United States” and “Bank of America” with the following results:

This demonstrates that when people come to America as tourists or residents they come from a background where they are accustomed to a central government bank.  Mexico, China, Philippines, India, Cuba, Vietnam, Korea, Haiti

The Bank of Korea (BOK) is the central bank of South Korea

And so on….. they are all government banks!  Just like any reasonable person would be inclined to assume that Bank of America is Americas bank.

Is the use of the word “America” a problem in itself probably not.  If I change my real estate company name to “Realty of America” would this be a problem?  What if I use only red white and blue in my marketing?  What if I disfigure the American flag and make it my logo.

I just figured everyone used the American flag in marketing.  However as I drove through town tonight, I did not see one American flag used in marketing.  I saw a few flags waving on posts but no storefront, sign, window etc.  I am going to have to look closer in the city tomorrow.

Banning Use of the American Flag in Commercial Advertisements

So briefly here’s what I got form the article.  This guy Halter owned a bottling company and printed an American flag on his bottles.  The state of Nebraska claimed it was a “desecration” in violation of state and federal law.  The Supreme Court sided with Nebraska.  This case paved the way for a ban on the use of the American flag in commerce.  If this article is correct, most states and possible federal law still prohibits use of the flag in commerce.  Wouldn’t that be interesting!

I can’t wait to hear Bank of America claim the logo is not an American flag.  Below is a simple google search where the second unsolicited grouping og logos is “flag”.  Even google refers to the logo as a “flag”.  Amazing, so obviously we need to research Flag desecration laws.

I just can’t put it down.  I just found a congressional report online “There is a federal criminal prohibition on the use of the flag for advertising purposes in the District of Columbia.” This is from a report written for congress by an Attorney.

Today I am kind of fixated on the use of the flag in commerce and advertising.  My morning started with a ride through downtown to take my son to school.  I was definitely preoccupied and he was studying for an exam so we didn’t talk much.  I didn’t see a single sign or poster or anything using the flag in commerce or advertising.  Then on to Walmart for a few office supplies.  I didn’t look down every isle but a bunch of them.  I really expected to see the flag used a lot on products, but I didn’t see it once.

The closest thing I found was a store called Flooring America.  this is what the sign on the storefront looked like.  Obviously patriotic with red, white and blue.  The star could be symbolic of the flags star.  However the flag is not used at all.  Nor does the logo mislead anyone to believe that this is the country’s flooring store.

So why does everyone in the country protect and cherish the flag so not to disgrace it for financial gain or advertising and commerce?  More importantly why does Bank of America think they can do it.  Surely some bright person over there brought up the US Flag code.

Very interesting don’t you think.  A complete and total disregard for the flag and dare I say our people.  Bank of America is just going to do whatever they want to gain whatever advantage they can, shameful.  Then I repeat a very important line “

“by which the average person seeing the same without deliberation may believe the same to represent the flag”

Which is a huge portion of this argument.  Bank or America might claim that they are not using a flag, that their logo is just a few squiggly lines.  If your squiggly lines mean flag to an “average person”  than it is a flag and should not be used.  Does the “average person” from Mexico believe that Bank of America is the country’s bank?  I know they do because many of my clients are from Mexico and I have to explain to them that they can get a mortgage from any bank, not just Banco de America.

I talked to a friend today about why he banks at Bank of America. 

ME                         What do you think of Bank of America?

FRIEND                 I hate them!

ME                         then why do you use them?

FRIEND                 I just always have.  I am from Guam and we used either Bank of Guam or Bank of America.  I’d rather keep my money here.

ME                         Here?  You mean in the states, the mainland?

FRIEND                 Yes

ME                         It’s not Obamas bank you know?

FRIEND                 I know but it’s like a super company, and they don’t get that big without help.  Didn’t we bail them out or something, billions right?

ME                         Do you know what the logo looks like?

FRIEND                 Yes I think so.

ME                         What can you tell me about it?

FRIEND                 It’s like a flag that’s waving isn’t it?

ME                         I don’t know

 

Admittedly the conversation didn’t prove much.  A guy from Guam is using Bank of America because he thinks they are keeping his money on the mainland.  That just sounds like good business, unless the use of unfair and deceptive marketing was used to get my friend to believe in BOA.  The logo looks like a flag waving DUH, it is a flag waving.

I know I have seen a ton of paper come from BOA, literature, sales brochures etc. are available at the store.  Let’s try a google search for as the code says “advertising purposes”

 

In this search I just did a screen shot to identify how many flags or partial flags were used in one screen.  BOA identifies with success, knowledge and even ramen noodles.  There were 27 flags flown on the first screen.

So Title 4 Chapter1 Section8 Respect for flag states “The flag should never be used for advertising purposes in any manner whatsoever.” Yet it is clear that BOA is aggressively advertising to all age sectors using the American Flag as an advertising tool.  How many billions of dollars have been made through the use or this type of advertising?  How much money will BOA owe “we the people” for their deception?

The BOA flag can be found on just about every disposable promotional item ever found including:  Pens, paper, shirts, baseballs, flashlights, camera, business card holder, bags, balls etc.

I just decided what I am going to do with this document.  I ask myself everyday why I am doing this.   In my dreams I am on top of a mountain howling in victory.  I don’t even know who or what I won, but we were the underdogs.  I know people needed me, I acted and I helped them.  Normal people need hope everyday and I deliver.  I look down and people cheer.  I am a no one but part of everyone proving again that somehow justice does find her way home. 

What if one man with a wife and five kids, living paycheck to paycheck, could bring to light the arrogance, deception and complete disregard for this country that defines Bank of America.  Don’t forget that these are the same folks that were willing to lie and forge signatures to foreclose on my clients.

I thought about money, maybe I could make money, but how?  Don’t people get paid to do research?  Everyone is good at google research!  If I ask BOA for money to keep quiet that sounds like extortion.  Maybe they could pay me for the rights to the research?  Ten million sounds good.  They could expense it from petty cash like I do for a pack of gum.  Maybe they could get the money from their printing budget.  You know all the advertising and marketing materials with our flag on it.  Oh, and a name that allows the world to think it’s Americas Bank, oops Bank of America. Hey that’s not a bad idea maybe I can pitch ad ideas.  I can come up with something better than ramen noodles.

             

 

 

Back to Google again for a search “America’s Bank”.  Imagine my surprise when the first advertisement is BOA.  So they soil our flag, don’t follow the rules we do, market themselves as “America’s Bank” and of course they don’t do anything to dispel the worlds ignorant perception that they are indeed “America’s Bank.  I don’t know what liable or slander is other than tv shows.  I am sure I can’t say anything that is not true and everything I reference is readily available on the internet.  What about my opinion?

What if BOA already knew everything in this document?  What if they have always known that a huge percent of their business is attained by deception?

What if someone wrote an article that read:

“Bank of America’s integrity and respect for our flag pleased customers”

So of the 20 million customers they claim to have how many of them are “investors”? lets just say a million.  Everyone else is working.  So any article about profit is addressing five percent of us without mention of the other 95%

So to answer the original question of what to do with this data. I think I am going to email it anonymously to every email I can find.  Every politician, news agency, website etc.  I just have to decide if it’s to cowardly.  I’m not working on this for my gain, but to accomplish certain goals.  I do not personally add or detract anything from the document itself.  The document does not get more or less important by knowing the author or his lack of credentials.

I am very excited to finish the questionnaire this weekend. I still wonder if it’s important to know the background of the questionnaire subjects.  For instance is there a reason to know that the answers came from a college student opposed to someone in their 40’s.  I don’t think it matters.

Years ago I studied this Massachusetts law in some detail, which is how I knew for a fact that BOA is breaking the law..
MGL c.93A Regulation of Business Practices for Consumers' Protection

Section 2. (a) Unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or commerce are hereby declared unlawful.

Her is a case:
Duclersaint v. Federal National Mortgage Association, 427 Mass. 809, 696 NE2d 536 (1998) "A practice may be deceptive if it reasonably could be found to have caused the plaintiff to act differently than he otherwise would have acted. However, a good faith dispute as to whether money is owed, or performance of some kind is due, in not the stuff of which a c.93A claim is made."

So the argument can be made that BOA has no idea that they are being deceptive.  BS but okay lets go there.  As of this day they have been notified and need to comply with hundreds of laws nationwide prohibiting marketing that misleads the general public.  It has to stop immediately!  As of today they owe every American damages because we have all been deceived.  If of course anyone from BOA has information that they always knew (which they did, just a guess) how deceptive they were, then they have a much bigger problem.

What are the top source countries with the largest share of immigrants compared with those 50 years ago?
As of 2010, Mexican-born immigrants accounted for approximately 29 percent of the nearly 40 million foreign born residing in the United States, making them the largest immigrant group in the country by far.

China (including Hong Kong but not Taiwan) accounted for 5 percent of all foreign born, followed by India and the Philippines, each comprising approximately 4 percent of the immigrant population. These four countries — together with Vietnam, El Salvador, Cuba, and Korea (at about 3 percent each), as well as the Dominican Republic and Guatemala (each about 2 percent) — made up almost 60 percent of all foreign born residing in the United States in 2010.

The predominance of immigrants from Central American and Asian countries in the early 21st century starkly contrasts with the trend seen in 1960 when immigrants were more likely to be from European countries. Italian-born immigrants made up 13 percent of all foreign born in 1960, followed by those born in Germany and Canada (accounting for about 10 percent each). Unlike in 2010, no single country accounted for more than 15 percent of the total immigrant population in 1960.

QUESTIONS

In any interviews, questionnaires we will refrain from recording anyone’s sex,race,religion,color etc. because it does not matter.  If what we are trying to prove is true it will not matter who we interview.  The publics overwhelming belief will be that Bank of America is a direct arm of the United States of America.  Our interview pool does not matter.  If we talk to 1000 spanish speaking people from Mexico or 1000 high school students from New Tampa.  The results will be startling.  Maybe Bank of America is a pseudo government branch like Fannie Mae and Freddie Mac.  Did the United States cripple Toyota so GM could survive?   Maybe the government has always known about this marketing deception.
