In a nutshell these people are idiots.


In 1984 (no that is not a typo) I had a smalls student loan for 1500.00.  I paid the first part of the loan (1000.00) and then paid the balance off a year later when I left my home state for good the debt was paid.. didn't hear anything of it, nor should I.


I understand the Dept of education owns these loans.. so every three or four years they surface.. I told them its been paid.. they tell me its marked in their files and then thats the end.. Now that they decided to use third party junk debt collectors who are on commisions it has become a joke.


I get a letter then a "call", then one of my clients gets a call (he assumes I work there, I do not, I am self employed).. in a LETTER I explain this has been PAID and I am told to PROVE IT.. I don't know about you but I don't keep stuff like this for 25 years!! Not to mention the bank I was with turned over at least five times and I am not even sure who owns this stuff now .. so I am supposed to find a bank that has not existed for over 20 year, who owns it , where the records are to find a payment on a loan they can't seem to understand was covered.. not to menion the so called interest and this company tacked on a 1200.00 fee of their own (you must be joking). When this guy told me to mail a copy of the cancelled check.. I just laughed out loud and asked him what planet he lived on.. that loan is probably older then he is.


What really got me is they called family members I have not seen in over 20 years in a state in which I have not lived in over 20 years when they have my CURRENT ADDRESS AND CELL..


In one day they called my mother, sister, a distant cousin with a similar name, my client, my cell and a neighbor.. yep thats right my neighbor.. I guess they think thats going to make me call them back. Not likely.. I don't do bullies and people with NO common sense.. not to mention these third party collectors have high turnover rates and are not very sharp to start with.. they wouldn't know a state statute if you introduced them to it.


I do NOTHING over the phone, they have paper that tells them all they need to know.. but how hard up are you if you are chasing after a 23 year old debt!!! This moron even made a threat regarding my tax refund which made me laugh.. you own a business the word REFUND does not exist.. you pay out the nose every quarter.


I do think it is ridiculous that the govt has no statute of limitations on nonsense like this... every other debt does.. so they will hound me for a month or so.. send it back to dept of ed.. I will resend the letter,, they will tell me its fine.. then they will farm it out again in a year.. guess it will go with me to my grave.. this is just plain stupid

There is no statute of limitaion for Department of Education Title IV loans.

Even if you can't secure proof from the Dept. of Education that your loan was paid off, you should be able to force the agency to abandon the debt.  There are exceptions to this for some educational loans but not for all types.
