Attorney General Abbott took legal action against ASAP, accusing the automotive parts dealer of falsely advertising high-quality, low-mileage replacement motors and transmissions. The company promoted its products through its Web site, www.asapmotors.com.

Although the defendants claimed their products were thoroughly tested and inspected, hundreds of ASAP customers, including mechanics, complained that rusted, mismatched or cracked motors and transmissions failed to perform as advertised. Bank records obtained by the Attorney General's investigators revealed that ASAP purchased motors and transmissions from local Houston junk and salvage yards. ASAP claimed to import high-quality products from Japan, but customers complained that the products they received did not match ASAP's claims.

In addition, consumers complained they were charged extra shipping fees that exceeded ASAP's estimated shipping quotes. Some customers complained that ASAP charged or threatened to charge a 20 percent "restocking" fee when they attempted to return defective or mismatched products. Under the agreement, ASAP is prohibited from charging those restocking fees in the future, except under certain conditions.

Consumers also complained that their attempts to contact ASAP about faulty or mismatched products were largely unsuccessful. Callers were put on hold; phone calls were not returned; and product returns and refunds were difficult to obtain. As a result, many consumers cancelled their payments or sought credit card "chargeback" refunds. In response, ASAP filed several hundred lawsuits against customers in Harris County small claims courts. Under the agreement, ASAP can only sue its customers in the counties where they reside or from which they order products.

The settlement prevents ASAP from using warranties that nullify a consumer's right to dispute problems with credit card companies. In addition, the defendants may not charge a consumer's bank or credit card account without the consumer's express authorization.

Average consumer losses ranged from $1,000 to $1,500
