Cherry Creek Restoration Darrick Waggoner Steals from those who make his money Blue Springs, Missouri

Yes Bill, there is something wrong and the something wrong is simply that Darrick wanted to start a company in KC and I didn't want to work for him anymore. That is why he did not pay me. I did not want to work for Darrick any longer, that's no excuse for not paying me.

You may have known him for 10 years not to steal from his salesmen, but that doesn't change the FACT that he has now stolen fromtwo sales reps for the crime of not wanting to work for him any longer.

He has stolen the commissions from jobs that he would not have hadif it werent for Tony and myself. We found the customers, we brought them to the company,he stole our commissions. Thats a fact.

Tony and I signed the contracts with the customers under one company, all insurance negotiations were done by Darrick and Mike, Darrick required the checks be made to Cherry Creek, his new company, that becamea felony when he depostied the check. If there's any fraud, they committed it.

My name is Bill Gallagher, I have been working with Darrick Waggoner on and off for the past 10yrs as a sales person, and everytime he has owed me commissions for jobs he has always paid. In my experience there has to be something wrong for him not pay commissions owed. as far as I am concerned Darrick and Mike keep there word on everything. Every company is going have little issues, but let the work and experiece of someone that has been with the company for 10yrs not 6 months speak for it's self.

The customerfrom whom Darrickclaims to have a sworn affidavit is most likely Eva Craig. Owner of the property, Craig's Corner,where work was done. The contract was signed under one roofing and gutter company and Darrick required that checks be written to another roofing company. It that the laundering your talking about Darrick?

I contacted Eva, when darrick shorted me $1800.00and asked her to contact me whe she was ready to pay, make the check payable to Cherry Creek,as Darrick demanded, and allow me to pick up the check and take to Cherry Creek Restoration, to collect my commissions. This is a tacticI learned from Darrick when he wastaking contracts fromthe other roofing comany where we all began working.

This customer has been extended long term credit from Darrick in return for this letter. She owes over $8000.00 and in order to make me appear to be lying, they have given her long term credit. In the response from Mike on Tony's post, hesaid Cherry Creek pays commission on projects as they are collected. And to their credit they have paid me on completed funded jobs. I have never said they are keeping money on completed/fully funded jobs. I have said they are draggin out jobs in order to keep my commission because I no longer wish to sell work for them. A reasonable expectation from any sales rep in any commission only field would be to have commissions paid in full at the company's expense when that company extends credit to a customer.

So we're back to square one. In my original post I stated that darrick was keeping my commissions unfairly. Would any sales rep agree to an indefinite wait for commissions when extended credit is given to a customer, by the company,when the customeris unwilling to folllow the terms clearly spelled out in the contract signed by her? No, the company should pay the commissions because the company extended the credit.

And if Eva signed an affidavit as Darrick said in a text he sent to me, then she has committed perjury. Because she knows I never asked her to make the check to me. That's Darrick's tactic.She asked me if thats what I wanted and I said "no thats illegal. Make the check to Cherry Creek and I will recieve my commissions" on a completed paid in full job as they indicate is their practice. I have no reason to believe that they will keep a check from me if I'm standing in their office holding a paid in full invoice. Affidavits are sworn to by dishonest people all the time. She signed a contract with dates of payment and missed them, renegotiated for time against her crops, when the crops were sold, she renegotiated again with darrick behind my back and received extended credit. I cannot and should notbe expectedto wait on commissions when the company has given acustomer extended credit.

This again is a ploy by the most dishonest group of peopleI have ever met to steal my money and keep it for themselves.

As in the previous post I extend an olive branch to darrick in the form of keep your word, pay what you promised and we can move on from this.

We have all the accounting for these jobs, we don't lie and we have sworn affidavits from the customer Jay tried to launder money from. these two can grasp at straws all they want but when your right, your right. that's all I have to say.....

Since I posted the first report. Some interesting text messages have come from Darrick Waggonerand his woman Kelli Jo Williams.

Darrick has claimed that he always intended to pay Tony and myself for the commissions due but when asked directly he is forced to lie about the situation as in Mike Beardsley's post in response to Tony's post.

It gets a little convoluted as to who actually owns Cherry Creek Restoration, the BBB website says its Mike Beardsley, their business cards say its Darrick as the Owner and Mike's cards say heis a senior partner. Their fraud starts there but doesn't end there.

In response to mike's response on Tony's post, we were not advanced well over $2000.00, it was $2000.00 exactly, 1k for me 1k for tony, and agreed upon by Darrick that that amount would be deducted from a contract, Rookies Restaurant, that was signed at the beginning of the summer and as of the december post, remained incomplete and uncollectable. However they took that 2000 as well aas 1800 each when they paid commissions on other jobs. My question, if you always intended to pay us, why take back the loan before the job loaned against is completed and paid?

So mike lied to ripoffreport on his first response.

Second, these posts were not in retaliation for taking that 2000.00 out of commissions paid but for the 1800.00deducted from each of us from money collected from another client. Money that Darrick said was a misunderstanding of KelliJo's instrructions to pay and that he would have her correct and send to me. I waited three weeks for that check before posting on this site.

Another lie to ripoffreport in the same post.

During the last two days, Darrick has texted me repeatedly to beg me to take this post down and says he will pay me the 1800 if I do. I told him I would apologize for this post publicly when I recieve the check he promised to send.

I even offered to return to denver and sit with him like men and as he writes and hands me a check for the 1800 which he wrongly withheld, I would publicly state that it had all been a misunderstanding. He refused this very reasonable offerand threatened a lawsuit for slander if I didn't retract these statements. I have the text stream to prove it. I'm sure his attorney has explained that ifa statement istrue, thenits not slander.

Mike Beardsley also claimed that I asked clients to make a check to me, this is another lie as my request to the clients was to make the check payable to Cherry Creek Restoration and give me notice so that i could return to Denver, pick up and turn in to Cherry Creek in exchange for my commissions. Darrick knows this is true .

Mike, Darrick and Kelli Jo are quick to lie to make themselves look good but their lies are the reason we parted so badly.
