My wife and I found country places inc  In early November while searching the Internet one evening in far west Texas. The home was listed on there web site as "move in ready." We look at the many photos of the home both inside and out and agreed to call Mr. Don Busby to find out more info on it. We spoke to him the following morning and explained to him that we were interested in the home that was listed in Waynesboro Tn. When we spoke I did make it clear to him that my family would be coming from far west Texas almost an 1100 mile drive. I asked that he be honest with me with respect to the condition of the home. He assured me that it was move in ready condition and that we only needed to bring our furnishings. Mr busby then informed me that I needed to forward the $5600.00 as a down payment for it. I explained to him that I would only forward half until I got there and looked at it, he agreed. Upon completion of our 19 hour drive towing a full uhaul and four horses accross three states we arrives to find out that the power needed to be turned on. My wife and I went to the power company and had power turned on when we returned to the house we found out family dog poisoned by antifreeze that his company used to winterize the toilets. Our family dog had to be put down due to anti freeze poisoning. We then called mr busby and explained what happened. His response was "sorry to hear that." We then came to find out that he house had no heat due to a furnace that did not function. After using heaters and a wood stove to heat the home all winter spring came along with warmer temps. Guess what the ac unit had a hole in the condenser coil and did not function. Not to mention the well pump did not work at all and needed to be re piped and re drilled. Please keep in mind that we were assured that the home was in move in condition. He then had the nerve to ask for the rest of my deposit. My family and I lived in this home for roughly 6 months and paid 860.00 per month for a mortgage that he apparently held on this home. In his "contract" he states that the house is to be insured and that he 1st payee be listed as country places inc the second payee be the bank. After talking to several insurance co I found out that none would insure the home due to a 100amp power line running through the attic without being in conduit and it was deemed a fire hazard. We have since moved on to a better situation but most recently wanted to share with others this experience. Most recently we have found that the same house has been relisted on there web site and again is listed as " move in ready" with the same photos and same listing. The home has no well pump, no AC, no heat and in un insurable. Please don't make the same mistake

Below is a list of the events that transpired between the seller and the buyers of the house and owner financing agreement mentioned in the previous report.    The events listed below are documented by the following methods: email conversations, faxed documents, signed contracts, a promissory note, public records from lawsuit and eviction in Wayne County TN.  If you notice on the initial report the person did not mention their name/s.  I do not wish to get back at or smear the buyers so I will not be mentioning their names.  This report is being written to clear my name and prove that the events written in the previous report are not true.

10/31/2013:  The buyers contacted seller with an interest in the property that is being offered with Seller Financing.  Buyers are living in Texas so seller sends them pictures and description through email. 

11/18/2013:  Buyer contacts seller and states that they want to come view the property but are afraid the property will sell before they get here.  Seller agreed to accept a $600 deposit to hold the property so the buyer could travel from TX to TN later that week.  The buyer stated in their report that they forwarded half of the $5600 down payment.  This is not true.  It is documented that they only paid a $600 deposit and this was refundable if they were unhappy with house.

11/22/2013:  Buyer wanted to view the house during the Thanksgiving Holiday but seller was out of town.  Seller agreed that the buyer could go by and view the house.  Buyer stated that they were bringing their camper with them and would stay in the camper until the seller returned after Thanksgiving to complete the deal.  

11/22-11/25/2013:  During this time frame the buyer moved into the house without permission while seller was out of town visiting family for Thanksgiving.  When seller contacted the customer, they(buyer) stated that they wanted the house and would send the remaining $5000 and sign contracts to purchase the property.

11/25/2013:  Contract is mailed to the buyer.

11-25 to 12-18-2013:   One month after moving into the house the buyer has not sent back the contract or the down payment.  The buyer won't return phone calls, texts or voicemails.

12/18/2013:  Seller hires an attorney and has a notice of eviction delivered to the buyer(certified mail).  The buyer has not paid the down payment and has not returned a signed contract.

12/18/2013:  The buyer gets the certified letter and finally calls stating that they had to pay for house repairs and do not have the money to pay the full down payment.  Seller cancels the eviction and agrees to lower the down payment  to help offset the costs of the repairs that the buyer claims to have made.  Seller requested receipts/proof for the repairs.  The buyer claimed to mail the receipts but it never showed up and the buyer never supplied proof of repairs.

12/19/2013  A new contract is sent out documenting that seller reduced the down payment from $5000 to $4000.  Buyer has now lived in the house for a month and has not made any payments or their down payment.  Buyer has only paid a $600 deposit.  Again the buyer wont return calls or emails for another 10 days.

12/29/2013  The buyer(wife) calls seller at midnight and leaves a frantic voicemail stating that her husband has left her and taken all the money.  She says that he blocked her emails and thats why she hadn't responded back to seller.  She also sends an email explaining the same and says she only has $1000 that she can send toward the down payment.  Seller agrees to let the buyer pay the remaining down payment over the next 3 months and buyer agrees to sign a promissory note.  Buyer also promises to send $1000 plus her first payment the next day on 12/30/13.  but 3 weeks late seller gets only the $1000 partial down payment.

12/30/2013 Through 01/12/14 Seller emails and calls the customer each day attempting to get the signed contracts but no answer and no response from the buyer.

1/7/2014  At the request of the buyer(wife)  A revised contract is sent with only the wife's name.  Contract is sent certified and requires a signature.  When seller gets the signature card back...It was signed by the husband  who seller was told had left and would not be on the contract.

1/13/2014  Buyer emails stating that they have mailed the $1000(portion of down payment) and all signed documents.

1/18/2014 $1000 down payment arrives but no signed documents as promised.  Buyer has now been in the house for two months and has not made their first payment and they have only paid $1000 of their down payment which was reduced from $5000 to $4000.

1/18/2014 to 2/16/14  Multiple attempts are made to contact the buyer to get the signed contracts which buyer previously stated had been mailed.  Seller instructs the customer to only mail the contract and check with a tracking number.  Buyer agrees to send with a tracking number.  Buyer again wont answer calls or emails.  The contracts never show up in the mail. Buyer finally emails seller and says that they couldn't afford the extra $4 for a tracking number so everything was sent regular mail(never arrived).

3/24/14  4 months after moving into the house the buyer finally sends the signed contracts.  Buyer also submits a check for $1500 which bounces due to insufficient funds.  Buyer now owes $3000 from the down payment and is past due on the monthly payments.

3/25/14 A certified letter is sent to buyer notifying them that they are $4884.90 past due and that their contract is scheduled to terminate on April 15th if payment is not made.

3/31/14 The buyer submits a complaint to the Better Business Bureau and the State of Tennessee Department of Commerce and Insurance Consumer Protection.   All documents, emails and conversations are submitted by the  seller to both agencies.  Both agencies close the cases and agree that there was no wrong doing by the seller.

4/16/14 A certified letter is sent to the buyer stating that their contract has been terminated due to non payment.  Buyer is also notified that they have 30 days to vacate the property.

5/16/14  The 30 days have expired and the customer is still living in the house.  Seller hires an attorney to pursue eviction of buyer.

6/11/14  Eviction hearing at Wayne County Court.  Buyer requests extra time so they can hire an attorney.  Judge delays the trial to June 25th.  Buyer is still living in the house.

6/25/14 2nd hearing at Wayne County Court.  Buyer Claims that seller does not have rights to the property and that buyer needs more time to secure an attorney.  Judge delays the trial a second time to 7/9/14.   The buyer is still living in the house.

7/9/14 3rd hearing at Wayne County Court.  All evidence is submitted to the court and the court rules in favor of the Seller and orders the buyer to vacate the property.

7/20/14   Seller regains legal access to the property.  Upon inspection of property it is documented that all appliances had been taken from the house by the buyer.  The floors are covered in animal feces and trash.  The house is infested with fleas and is a complete disaster. 

Recap:  The buyer moved into the house without permission and it only got worse from there.  The buyer lived in this house From November 2013 till July 2014(9 months) and only made two payments.  They also only paid $1600 down payment of an agreed $4000 which was reduced from $5000.  The buyer made multiple promises stating that the "Check was in the mail" BUT the check never showed up.  The buyer would not respond to sellers attempts to communicate and resolve the situation.  The seller made every reasonable attempt to work with the customer including lowering the down payment to cover the costs of alleged repairs, delaying the monthly payment and the down payment(which was never paid).    

As a side note:

The seller would like to thank Ripoff Report for their many phone calls/emails with offers to "help me". Thank you for offering to let us join your Corporate Advocacy Program which says "Let Ripoff Report change those negative search engine listings to a positive."  It sounds like a great program but we just cant afford it at this time.  I'm sure Ripoff Report is doing a great job of exposing dishonest and corrupt people but please be aware that hard working honest people can also be unfairly targeted by anyone.
