Marc Robeson misrepresented rates and contract terms.  In fact, he assured me I could terminate at any time with no fees.  Not so.  When the rates were more than twice what he presented, I tried to get resolution both through Mr. Robeson and Pivotal Payments.  I spent months paying exhorbitant fees and not getting anything changed.  

I then asked to terminate and was told I was contractually obligated and would incur excessive fees to terminate.  I contacted Mr. Robeson, had to threaten to hire an attorney and he got me out of the contract.

I now find that he obligated me to a contract with First Data for a swiper for 48 months.  I can not get a response from him at this point.  The contracts he presents to customers are not what he presents to the service providers.  Totally dishonest, unethical, fraudulent practices.

To Whom it may concern,

Pamela Yagjian Krewson signed a merchant-processing contract that was indeed month-to-month and was honored as such. As soon as I was able to review her first month statement, we found that she was not entering card information properly and had incurred higher than normal fee's. We then went out to Ms. Yagjian Krewson's office to ensure proper training and even reimbursed her for the overages since she did not know how to properly install her device.  

Ms. Yagjian Krewson eventually elected to cancel her service and we honored her request without penalty. However since the equipment she agreed to buy was proprietary to the mobile device she used, she was not able to cancel her lease with First Data Global Leasing. Her equipment can be transferred to many other merchant processors across the United States without penalty. I am more than happy to provide all documentation that clearly states she acknowledged all terms of the lease on 5 separate occasions and the fact that it is non-cancelable.

 It is obviously never our intention to misrepresent any information to our customers. Our contracts are clearly stated and require multiple signatures and initials to ensure complete transparency.  Furthermore we always leave a carbon copy of the contract with the merchant at the time of signing to further ensure transparency. In the event that a customer has questions or objections, we always work with the customer to ensure complete satisfaction and an amicable resolution.

 Being accused in a public forum without recourse leaves me with no other option but to defend myself. I am sorry that Ms. Yagjian Krewson feels she was mis-represented, but we have gone above and beyond to rectify the matter.
