I did not want to write this report, but the conduct of this business owner, Mr. Shannon Parker, has left me no choice.

What started out as a simple misunderstanding and disagreement on eBay escalated into a campaign of harassment and bullying. I had purchased what was supposed to be a new iPhone from Spark iRepair (of Denver). The so-called "new" phone I had purchased from Mr Parker did eventually arrive but arrived clearly with signs of use -- a half-empty battery, and clear evidence of prior setup  (it had already been through the initial setup screen, ie not factory new).

Most likely the device was pre-owned (i.e. used), or an Apple warranty replacement phone, but certainly not new. I checked the remaining warranty on the device and sure enough it had two weeks left. The owner had gone to great lengths to confuse the buyer, wrapping it in cellophane to make it "appear" new, using ambiguous and confusing language in the description as well. In retrospect I should have contacted the seller to verify the accuracy of the description, but I just assumed he was honest, as most are - my mistake!

I ultimately opened a dispute with eBay against Mr. Parker which I won and my money was fully refunded. The angry words and emails that started well before the dispute contiinued unabated and increased in intensity and frequency. Mr. Parker's emails were thick with shocking profanity and homophobic slurs - imagine that, you are a customer and the business owner is calling you a f*g*t, an idiot, and telling you to "suck d**k" (his words).

IT ONLY GETS BETTER. After having lost the dispute, and after having sent his last hate-filled email, he filed an anonymous report here on Ripoff Report posing as a disgrunteled customer of mine in Los Angeles (where I am based), even though a) my company has never done business with his, and b) he lives in Denver. This charade went on for days until he finally admitted his ruse and his real identity - and ultimately his real intention, to harass and defame me.

He took his harassment campaign over to Yelp and later Manta using similar tactics. These remarks have since been removed as they were baseless.

WARNING: Potential customers out there reading this, should you ever enter into a disagreement with Mr Parker, expect to be bullied, cyber-stalked, harrassed and be called an "idiot", or a "f*g*t", or whatever his expletive du jour is. If you place a high value on customer service and self-respect I advise you to go elsewhere.

This person has demonstrated clear sociopathic, anti-social behaviour, in his DISHONESTY, his acts of CYBER-BULLYING, CYBER-STALKING, BULLYING, HATE-SPEECH and routine use of HOMOPHOBIC slurs.

You can believe me or you can believe eBay. eBay aribtrated the dispute and issued me a full refund! If the seller (the subject of this report) was blameless then why would I have prevailed in the disupte? (see attached)

This disagreement boils down to this: The seller (Mr. Shannon Parker) posted his eBay auction using vague and misleading language, calling his used/refurbished products new when he should not have. Used or refurbished products don't remotely qualify as new, no matter how you dress it up (ie repacking in in cellophane to make it appear new). Warranty replacement items from Apple, which is what the iPhone I received probably was, are almost always refurbs - I know because I have been buying Apple products for more 20 years.

Reputable sellers don't use marketing gimmicks or slick language to sell their products, they rely on honesty, integrity and truth in advertising. I should know because I have a 100% favorability rating on eBay. If and when a dispute does arise, reputable sellers don't blame the customer and call them hateful names, such as "fa**t", or suggest they should suck "c*" (see attached), adding insult to injury (can you imagine a sales rep from Apple suggesting such an act?). In my book, you don't do that to customers, unless of course you are a Soup n**i and have suicidal business practices. Sure I got upset and threatened to leave negative feedback, who would not have under those circumstances?

I passed on 10 other phones to buy his junk because it was labeled "new". And yes, he should have compensated me for my lost time and distress. Other eBay sellers in the past have done so without my asking when they realized they were in the wrong or had made an honest mistake - even I have done so, and customers appreciate it and respond to it. And that is the difference, this disagreement is the result of Parker's deliberate intention to mislead, and subsequent intransigence in accepting responsibility and providing redress to me, his customer.

My advice to seller, Mr. Parker, think about another customer service strategy, stop blaming and disrespecting your customers, insulting them and calling them hateful names, and if you must, do it quietly behind the scense, hire someone who knows what they are doing because quite franky, you don't. Maybe you should start accepting personal responsibility for your actions, and don't resort to terrorist tactics like filing a false report here on this sleazy site purporting fictionalized business transactions that never happened between us off of eBay, and later stalking me online variously on Yelp, Manta and other sites.

Notice the demeaning and denigrating language he continues to use when addressing me, says it all if you ask me.

Here is the real story with Jeff, and why I highly recommend thinking twice before doing any business with this kind of person. I have sold on eBay for 13 years and have never been below a 99.5% feedback rating, which is extremely high.  Currently I'm at 99.7% with THOUSANDS of transactions under my belt.  My eBay username is spark5280 .. I welcome anyone reading this to check and see.  My point is, if I really were a lying scumbag seller like Jeff implies, then certainly I would not have so many satisfied customers.. thats a fact.  The TRUTH of the matter is I disclosed exactly what I was selling in my listing... even the fact that the box was shrink wrapped by me.  I listed it as "new other (see details)" ..and spelled out exactly what you would be getting.  The problem began when Jeffie the hothead purchased the item and he did not bother to read the description.  I know he feels I mislead him by writing "sealed" in the title, but the fact of the matter is it WAS sealed.  Many people buy iPhones from me as gifts and like them to be sealed when given, and I actually do a good job at it,  but I never try to pass it off a "factory sealed" and trick anyone... I state it clearly in my description that I sealed it.  The iPhone was not used, It came directly from Apple store Genius bar and still had the plastic film on both sides, not a scratch on it.  Now at this point I CAN see Jeff's' point if he feels the iPhones' condition was "manufacturer refurbished" and not "new other".  The Apple store employee told me it was new, but like I said, I could see his point if he wanted to return it on that issue..(even though I stated where the iPhone came from in the listing)..  The PROBLEM actually wasn't the iPhone really..heck I'm sure we've ALL returned something before, right?  eBay by default will side with a customer who feels the item they received was not as described, Im not sure why he feels he "won" some big victory there, I simply sold that same phone to a reasonable person.. no issues at all.  Jeff COULD have contacted me, expressed his disappointment, and told me that he would like to return the item and get all of his money back.  Thats is what reasonable, logical people do.  The problem is Jeff Yana attempted to extort me.  Before even giving me a CHANCE to rectify the issue, he insulted me and demanded a full refund including shipping PLUS an extra 25% ($113).. or else he would sabotage my businesses' reputation.  This is why I say avoid this guy.. anyone who thinks this is how to act when things don't go their way should be avoided like the plague. I don't react well to people doing this type of thing to me, and yes, I called him names and attacked him back online.  He has repeatedly attacked my Yelp account and had his reviews removed.. just to repeatedly repost again.  I encourage you to look at the included screenshot of Jeffs initial email via eBay.. his eBay username is leanmeandancingmachine, and see for yourself.  I also encourage you to visit the exact eBay listing he purchased (just put the item number in search- 121168580908)..and read for yourself what I stated.  Save yourself the headache and avoid this nut-job.
