CCCU has failed to provide proof of late payment reported on our account, and refused to remove when proof couldn't be provided. CCCU reported a 30 day late payment on my credit report. I have contacted them directly, and through the credit reporting agencies asking them to provide proof of the debt. We have provided proof in the form of bank statements clearly showing the payment was made on time. However, CCCU has failed to provide any proof to the contrary, and have failed to remove the item from our credit report as required to do when proof of the late payment could not be provided. The credit reporting agencies have been of no help either. We have been told that because of CCCU's long standing relationship of being a "reputable source", no proof is needed to place the item on our credit report. Again, CCCU cannot provide proof to us, and has been unable to provide proof to the credit reporting agencies as well.

Skylar Jack in the collection department has repeatedly told us that the information reported cannot be removed per federal law.  To-date, she has provided no proof of the late payment, and has been unable to provide proof that such federal law exists that once a financial insitution reports erroneous information, it cannot be removed.

As previously stated, we have provided our proof that the payment was not late.  We have also taken the proper steps to resolve this through the credit union and/or the credit reporting agencies.  We are now being forced to take legal action to resolve this issue.  My warning to anybody preparing to do business with Clark County Credit Union would be to avoid them at all costs.  This issue has proven to me that they are not ethical in their dealings with their members.  This will definitely be the last loan we ever have with CCCU!

Clark County Credit Union (CCCU) always provides a monthly statement (proof) of the dates and amounts of every transaction on a member’s account.  A payment made is recorded on the date it is received.

If a loan payment is made on or before the due date, it is considered an on-time payment and is reflected in the borrower’s credit report. A payment received after the due date is a late payment and proof of the event is recorded on the statement and is reflected as a late payment in the credit report.

CCCU always attempts to work with credit union members whenever payment difficulties arise for a borrower, even over long periods of time.

Accurate and truthful reporting of credit report information is essential and important to CCCU and the borrower. CCCU relies on reports from credit bureaus and maintains practices that ensure fairness in lending and help mitigate financial loss to credit union members. CCCU is thorough and careful to provide accurate monthly reports so that all users can rely on them for veracity.

CCCU cannot be held responsible for the late arrival of payments made from another institution via US mail or by any other means, as the activities of other persons or businesses are completely out of our control.

CCCU abides by all state and federal laws governing financial institutions and is audited annually by the Financial Institutions Division of the State of Nevada.

I do find it odd if this is a recent report on your credit that the company wouldnt have proof of when your account would have been paid. If this was an older account however, that would make more sense as companies only have to keep records for a certain number of years. Did they recieve the payment? If so, when? Also, how did you make the payment? Did you write a check or did you use your bank's Bill Pay service?

The reason i ask your payment method is if you use your bank's bill pay system to pay bills, then it is entirely possible for the payment to clear your account and still not be recieved or cashed at the payee. If this is a payment you made using Bill Pay, contact your bank to determine when the funds were recieved.

As far as the credit agency is concerned, they should have investigated the matter if you filed a dispute. If you are unhappy with a company’s investigation of, or response to, your dispute, you can submit a complaint to the CFPB online or by calling or by calling (855) 411-CFPB (2372).
