Clay Schlinke - Prosperity Homes & Investments Builder doesn't return earnest money even when he is not building the property San Antonio Texas

We (Lin Ma & Jing Liu) were introduced by a friend to buy two 4 plex property at 6304-6310 and 6312-6318 Attucks Lane, San Antonio, Texas in Feb 2013.

We paid $5000 (total $10000) deposit for each of the property to First American Title Company through the sales agent Kevin Clerk. According to the contract, the houses should be completed in April 2013. But the construction has never started due to the builder’s (Clay Schlinke, Prosperity Homes & Investments)) financial issues.

Later we found out First American Title Company distributed the $10000 deposit to the builder without our knowledge.

On 5/20/2013, we (Lin Ma & Jing Liu) signed Notice of Buyer’s Termination of Contract and sent to the builder (Clay Schlinke, Prosperity Homes & Investments). We have tried many times to contact the builder to refund our $10000 deposit. The builder always ignored our request and hasn’t returned our deposit. This is why we have to fill the small claim against the builder.
