Erick Schmidtke Gave me 2 consectutive monthly rent checks that went N.S.F + unpaid hydro bill. Internet

July 1, Erick Schmidtke, 30 years old, originally of Oshawa, Ontario, rented a unit from me for $675 a month. On July 2, 2012 he gave me first and last months rent.

Was 9 days late on his rent for August.                                                                                                                                                                                                                                                                                                        
Gave me a check for his rent for September/12. Check went N.S.F. Sent him an e-mail requesting that on the first of October he give me a check for September's rent plus October's rent and a $40 Bank charge for his bad check. He responded saying that he will leave me a check for the rent and that he would be moving out at the end of October. He gave me a check for October and completely ignored my request to make good on the N.S.F. check for September.

I e-mailed him back and told him that 60 days notice is required by law and explained to him the seriousness of writing bad checks. It fell on deaf ears.

His check for October also came back N.S.F. with no explanation or offer to make it good when I contacted him about it.

He moved out owing a Hydro bill of $113 which he signed an agreement to pay for when it became due.

To add insult to injury, When I went on his Facebook page I found out that him and his girlfriend bought a new vehicle, 2 weeks before he moved out, owing me all this money!

Erick Schmidtke lives somewhere in Erin, Ontario with his new found girlfriend, Tiffany Crocker. He is a route salesman (self-employed) for Betty Bread/Lanthier Bakery, Alexandria, Ontario and works out of a depot in Brampton, Ontario at 1327 Clark Blvd. He leases a 5 ton Truck from Ryder.

I went to the Halton Police to file a charge of False Pretense against him and they told me it was a civil matter. Not so, there is a law in the Criminal Code of Canada (Part IX Offences Against Rights of Property) that specifically states that anyone who writes a bad check has the onus on them, in court, to prove that they wrote the check in good faith. The police here refuse to act on bad check writers because of protocol, budgets and there are too many of them to deal with. In other words the police can circumvent the law as stated and can refuse to act on it!! Meanwhile, these crooks are getting away with stealing from people with impunity.
