On my Mini S 35K car, the turbo went out. There were problems when the car had 2000 miles on it and it continued. When the turbo went out, I was told I changed my oil too late and warranty will not cover the repairs. Being in the car business over 20 years, I have never heard of this, especially when the oil change is due on a yearly basis.

   That doesn't sound like a response from someone who has been in the car business for 20 yrs.   Your warranty and owners manual specify both the time and mileage intervals for an oil change.   The dealer has no idea how many miles you are driving, so it's unlikely that they would be able to call you when the change was due.    You know it's your responsibility to make sure that maintenance is done at the proper intervals, right?   This phone call business sounds pretty weak.

  One thing that might help your lawyer out is that Mini used to recommend 1yr/15K miles as the oil change interval.  Starting last year, they lowered that to 1yr/9K miles.   No doubt they found that their previous interval was resulting in a lot of warranty engine repairs.   Even with synthetic oils, 1yr/15K miles sounds pretty ridiculous.  Doubly so for an engine equipped with a turbocharger.

Yes I agree that the warranty must be honored through proper maintenance, especially oil changes. I called to make an oil change appointment and was told it is too early, they will call me when it's time. The call came, it was done. Still, I was denied service. The matter is in the hands of an attorney now.

What does your warranty paperwork say?  If you say the oil change interval is ONE YEAR do you have absolute proof you have not exceeded that interval?  Have you tried another dealer?  If everything is exactly as you say, I would not just sit still and believe them.  If you have the proof as described above then I would take this up with the zone office and if they OK it, then I suggest you ask them to provide you with another dealer to do the job.  The turbo requires lubrication from the oil in the engine.  Turbo failure is often caused by lack of oil changes, running low on oil etc.  Please, don't sit on this.
