By their own admission (see pg 31 of the May 10 2013 Opinion and Order above) at least 167 Fieldturf fields have failed because the synthetic grass fiber has degraded prematurely.   Between 2005 and 2010 Fieldturf installed many times that number of synthetic turf fields in the United States.  Dozens of fields throughout the country may be failing prematurely without the customers knowledge.  

In many cases, customers with defective Fieldturf fields have had their fields replaced under warranty at no cost.  See these examples for instance:

In a recent similar situation in Ohio, a Fieldturf customer had to resort to the legal system as well since the company was non-responsive to a warranty claim:

Other customers are paying 300k and up to replace fields that are defective and still under warranty.  The synthetic turf at H.A. Avon High School in Avon OH installed their field in August 2007.  They have agreed to pay $295,000 to replace their defective Fieldturf field that was still under warranty:

It is important to point out that in an open, competitive bid environment and where it has NO warranty obligations whatsoever, Fieldturf  bids approximately $325,000 to remove and dispose an existing synthetic surface and to supply and install a new surface.  See these 2 examples for instance:
 
 
 
 
Fieldturf positions itself as a leader in the industry that supplies premium synthetic turf products and installations.  It proudly proclaims, among many other things, it has the:
  • "Industry's Best Warranty"
  • "Longest-Lasting Turf System"  
  • "Highest Return on Investment"

As you can plainly see, the application of the Fieldturf Tarkett warranty is inconsistent and unfair.  Some customers are getting their defective fields replaced and upgraded at NO COST under warranty.  Other customers are paying hundreds of thousands of dollars to have their defective fields replaced under warranty.  They are paying, in some cases, more than customers who do not have a valid warranty claim.  Finally and as cited above in cases in Nashville and Texas, the company is refusing to honor warranty claims from its customers.  These customers bought the same product from the same company at roughly same time but are getting dramatically different treatment under the company's warranty.
