Here's the summary of my grievance and dispute against Gemisphere:

Bought a therapeutic necklace from Gemisphere in Sept 2012. I used it for couple of times and didn't get the therapeutic benefits that the site advertises. Spoke to the merchant's representative that I would like to return it and get a full refund.

I was denied the refund because I have 'used' the product. My question is how else are you supposed to know if the product will help or not unless you use it?

Another point is that the webpage I used to buy the product did not mention their return policy.

If the merchant resolves this amicably by 100% refund, I would be happy to post the positive resolution on this site.

Clarifying customer's statement / return policy

We regret any miscommunication or dissatisfaction and take great pride in our customer service.  This purchase was made through our website which clearly states our full return policy just above the submit button in your shopping cart. The policy states that we "will provide a full refund for any unused gemstones returned within 30 days (US) or 45 days (International) of purchase and accompanied by a Return/Exchange form, the original receipt, and a return merchandise authorization (RMA) number. To download and print a copy of the Return/Exchange form, click here. To obtain an RMA number, please call a Gemstone Advisor at 800-727-8877. We regret that we cannot offer refunds for gemstones that have been worn or used. Shipping and handling charges are not refundable.  This refund policy is also stated under our Frequently Asked Questions page.

Because the necklace was both worn, and the request for a refund was made after the 30 day window for refunds, we explained that it was not our policy to issue refunds.  We can, and do, make exceptions in regards to our return policy if a customer is this unhappy or dissatisfied, but because this particular customer indicated she would try our suggestions in working with the necklace, we thought everything was fine. There are times when a new customer is not using the necklaces properly, or feeling the effects on a physical level immediately, but after time the positive effects of the necklace become obvious. These are tools for long term use, not quick short term solutions and customers may not always feel something happening right away.

The customer has been fully refunded as a courtesy.

We are proud to say that we are widely known for our exemplary customer service. We do also have a fair and clearly stated return policy.
