I intended to purchase an e-mail list of people with a specific name. I spoke to Mark Miller from Glencore and he informed me that he could provide me a list of over 7,000 e-mails, ALL of people with the name I was interested in. This cost me $400. Once I received the list I realized that no one, I repeat NO ONE on that list had the name I requested. This was the only reason I purchased the list.
Here was that correspondence:
me: “I just want to confirm that all 7,419 records are of people with either the first or last name XXX. Also, we will get the full e-mail list to use.”
Mark: “Correct and correct. All have with first or last name of XXX and you’ll have access to the name data with your list.”
The day I received the list and for 3 weeks after, I called and e-mailed. At first I thought that they may have accidentally given me the wrong list. I started to realize I was scammed. Then I received an e-mail from Peter Smith:
I am being told by my apartment that the list was delivered to you quite some time ago and that the contract was fulfilled. Please read the terms concerning the Satisfaction Guarantee.
If you would like I can have someone from Operations do a repull for you, but as stated in the terms that will be at 75% of the cost based on the licensing of the new data. You can send payment information directly to Accounting.

I sent Peter the e-mail that Mark said ALL people on the list would have the name I was intending to purchase and that the reality is...NONE of the names were there.
...no reponse
We are out $400 and have a bogus e-mail list.

Having worked in Advertising and Marketing for a while now, I've dealt with this "company" and many like them on a regular basis. Reading your complaint, I felt for you - really.
First off, I can almost guarantee that Mark Miller and Peter Whatever are not their real names. Your request for contact information for people of a specific name seems reasonable, and I hope that (regardless of any "promises" made over the phone) some sort of written/email agreement was produced. Because of how simple your request was, the agreement, hopefully, was almost as simple. If that agreement contained that name, you should seek an attorney. If this kind of deception is common with them, they'll have plenty of other regretful buyers that would be more than willing to devote some extra time for a class action suit.
That said, $400 for over 4000 valid email addresses is not a bad market price.
Personally I've grown thick skin towards their brand of high pressure, low value, sales tactics and have learned by experience to read all contracts and get what I pay for.
