Then they filed a $3000 lawsuit for Loss of Profit, specifying "loss of horse sale, over use of horse bedding and defamation.
We went to court on October 6th. Chris White showed up but not Shannon Etengoff. He asked for a postponement because she had just been released from the hospital (actually it was Oct 1st) and she had all the information needed to proceed with the case. The judge set a new date of December 1, 2011.
On December 1st they did not show up in court. Their claim was dismissed and my counterclaim was awarded. Today, December 3rd, I received the official notification that a judgement has been filed in my favor.
I can't believe that they filed a suit when I followed the letter of the boarding contract.

FIRST OFF, A 24 HOUR NOTICE IS ILLEGAL!
He took me to court, suing me for $3000: Loss of a horse sale, overuse of bedding and defamation.
The first court date he said he couldn't proceed because Shannon wasn't there. It was rescheduled and neither one showed up. I was awarded a judgement. He wrote a letter to the judge and it was reopened.
Back to court and after a 45 day wait .... HE LOST AGAIN! I was awarded a judgement for the board for the days I was off the property. HE WON NOTHING! He told the judge that my horse bit his horse and he couldn't take her to the auction where he felt she would have brought $2000, but his board contract specifically says horses are inherently dangerous and they bite, kick, rear, trample, etc., and SMC cannot be held responsible. The judge told him that he is held by the same contract so, HE LOST.
He told the judge that the colt that I was buying and who didn't become mine until the day I gave notice, used $300 in bedding over what they provide to boarders. Again, HE LOST. The judge agreed that the colt only belonged to me for 10 days.
And finally, he said that my horse damaged one of his barns. He wanted $300. I had a boarder with me in court who verified that she moved off the property AFTER I left and that that building was not damaged. AGAIN HE LOST!
FYI!!! The colt was kept in a stall 24/7 and was drinking excessive amounts of water. HE NEVER CALLED A VET OUT FOR HIM! A month before I ever got a bill of sale, I had the colt vetted and his hematacrit which should have been a min of 34 was at 25! He was severely anemic. He was vetted again 20 days after we left the barn and it was at 21. Thanks to love and good feed, 3 months after we left the barn, his crit was at 38 and he was able to be gelded.
I provided my own feed and supplements for all 3 of my horses but it appears due to the anemia of the colt and the weight loss of the 2 senior horses, that he was not feeding it.
