I had went to the seven elven store to purchase cigarettes and showed the sales clerk the pack I had and ask for Silver menthol Marolboro. I purchased the two packs and exited not paying much attention until only minutes later I realized he had given regular mentols. I went back and ask for the correct brand and was refused. The white female employee made comment we wont take them back once you leave the store, state law. i indicated it was and error on the cashiers part, I am not looking for refund only correct brand. She said no, we have had to many problems with you people bring back cigarettes. I ask who you "people" were, she commented Pontiac people. I ask her how she would determine I was from Pontiac without stereotyping me, due to color. She said I am not going to tell you again we are not taking them back. I informed her there was no reason to be rude because I was asking about your bigoted remark. She said youre lucky it's only my remark youre dealing with because I get pissed easily. I told her not to get pissed just call the Police. She refused so I went around the store asking to use a cell phone (I had left home without mine). It was amazing how many did'nt want to get involved, like an episode out of ABC's "What would you do?" While I waited for the Police she begin to berate me telling me to get out the store and wait for them outside. I indicated I have done nothing to have you refuse me service, and have not disrupted your business what so ever and am waiting for the officer to arrive. She said I dont give a F_ck I can puit you out. I ask why all the profanity, I'm not cursing at you. I ask if she might know how imortant it was to treat people with respect and not based on color. she then stated I am not saying s**t else to you and you dont say anything else to me. The officer arrived and I explained what had occurred and he was cordial and pleasent and took all the neccessary imformation to lodge my complaint, and told me to contact the fanchise owner in the morning. I informed him that this was a transaction for goods and service in which incorrect merchandise was recieved and credit card payment used and I will first call Chase, and then the owner as to his BAD employee's demeanor. I had to stop at a Sunoco on the way home to get my favorite "correct" brand because of the mistake and spent 45 minutes in the store all because of failed customer service, and a little empathy.

Yes I did write the report as I was with my roomate I am WHITE 55 yo physically disabled man who was there when all this happen. I dont have a computer and share one with my Roomate
You guy's are really out there and have too much time on your hand's. shame MLK birthday came and we celebrated it here in Detroit and have such ignorence that exist today.
No white hood needed when you have the net (lol)

Get over yourself.  The store has every right to do what policy dictates.  As for your "paralegal" status I suggest you sue the school who gave you that certificate because my 12 year old spells better than you do on a bad day.

1. Consumer protection act state of michigan requires thatb policy be posted to afford customers opportunity as to wheter they choose to patronize the business

2.Consumer protect law requires point of sales transaction are refundable or return to the store where goods and service of product rendered is not what was intended as purchase

3. Civil rights protects all persons from publc service violations of a discriminatory nature white, black, asian, all persons, references to color or disablity, religion as reasons or demonstrated acts to refuse such service is violation of the act

4. Threats inthe form of indimidation and usage of color to communicate such threat is violation Federally and State under Ethnic Intimidation law

A purchase for item of $13 is not by ant means pety, and should the opportunity present it's self where all the Nay sayers get bad treatment or verbal lashing from a clerk do complain just grin , bare it and smile with a thank you very much. Get a clue
So many have forgot good manners and stand up for bad behavior and then complain society is in the crapper well go figure.
the store owner made it clear after reviewing the tapes and speaking with other employee, the actions were reprehensable and not properly handle by the clerk. Dont think I am not sympathatic to retail I worked in the area for 14 years including Loss Prevention.

Bottom line is refer the matter to management or owner and not take it out on the customer.

Owner own words that she should of indicated I will take your name and pass it onto the management/owner to discuss the policy.

Co-sign all you will , complain about my part, being a smoker not paying attention whatever. the bottom line is satisfactorly resolved

Check out his second update, with the title "Idiots remain"; he is trying to pretend it was posted by a white onlooker who agrees with him! For example, he says, "yes I am white male who witnessed this act while returning from the Palace".

It would be obvious enough that it was the same guy due to his illiteracy level, but he kicks up the idiot meter to ELEVEN by posting it from the same account as his original complaint! This guy is so dumb, he does not even know that if you want to pretend to be another person, you should probably create a second account. 

OMG my sides are aching from laughing to hard. We get some real winners on this board, but this guy is *definitely* in the running for loser of the year. 

OK, gotta wipe the tears from eyes now.... :)

As a Non-Smoker what the heck is the difference between the two packs that are significant enough to cause you to go nuts?   Are these cigarettes so different that it was impossible for you to just use these two packs and the next time just make sure you get the right one BEFORE you leave the store.

As for Law/Store Policy.  So the employee mis-stated the Store Policy as State Law...big freekin' deal.  Well I guess if she exchanged them for you instead of getting fined by the State she would have only gotten fired.  But at least you would have the correct cigarettes..and after all in the end that is all that matters to you right?

I can't wait to see what you come up with next.  First claims that somehow you were discriminated against because you were sold the wrong(but very similar) cigarettes.  Then bringing up laws that have no relevance and then you all of the sudden becoming a Marine.  I can't wait to see what you come up with next.

By the way if I had some guy ranting about not being able to get the Cigarettes he wants I probably wouldn't let them use my Cell Phone either..regardless of what "color" they were.

So not only did tax dollars go towards having the police sent to the store to assist in the tragedy of the wrong cigarettes, but it was our tax dollars paying for the cigarettes themselves. I get the feeling that once this guy is out of the military, he will be getting a nice job at the DMV as well, if you know what I mean :)

BTW, taking a look at the OP's photo of the cigs, I can see that they are BOTH Marlboro menthols! The only difference is one is "silver" and the other isn't. So this guy whines to the cops because he cannot deal with the oh-so-subtle flavor differences of one fine Marlboro menthol vs. another. I am starting to get the feeling that he was the kind of kid that would cry for his mommy/teacher/etc whenever a kid made a face at him.

The OP doesn't live in california. Civil rights laws and interpretations of civil rights law in california are not applicable in michigan. What are michigan's laws like? I know here in missouri I can throw people out of the store for being redheaded, wearing metallica t-shirts, having flip-flops on, or because they work at mcdonald's. None of these are protected.  As for the OP, She wasn't denied service because of her race. The cashier sold her the cigarettes, she left the store not realizing they were the wrong brand, the cashier had instructions from her manager not to do any returns/exchanges on cigarettes once they left the store and the cashier followed the store policy. Any comments made (and if you people was the only comment) are irrelevant to the fact the cashier was just holding the customer to the store's policy. The cashier had every right to remove the customer from the store. The customer was clearly being unruly after being declined an exchange, the customer was threatening to call the police over a civil matter, and the customer was harassing other customers to use their cell phone. Personally when the police arrived I would have pressed charges for trespassing since the OP would not leave the store.

I love how you try to sound intellectual by just slapping incorrect words into your sentences. Seriously, give it up; you are just embarrassing yourself. 

Also, Google for "stupid 911 calls," and you will see instances of people calling the police for stuff like this (wrong order at McDonald's, etc.), and of course everyone is LAUGHING at them, just as we are all laughing at you. 

Here is a suggestion: next time something so trivial happens to you, try sucking it up like a man, instead of acting like a child.

OK, look the fact that you "people" is used in reference to previous conditional bad acts, and taken into account that the clerk indicated you people are the "people" from Pontiac, is a clear unequivocal stereotyping of the population make up of the city which is predominantly afro american, and hispanic. So here the questioned poised:
 How do you determine if someone is in fact a part of the make-up of suspected persons who have been an issue for the store , returning cigarettes? In what way can one make an educated guess as to homestead of a person , whom has never been met?
Lastly I am from Waterford a suburb outside of Pontiac, and the ludicris indication is only magnified by the calculated obsurtity that a person who is "Afro American" visiting a suburb of Auburn Hills does not live there , but must clearly be from the hood or Yak only supports my discernment.
There was a case in Ferndale a city that had until the 90's refused to comply with certain intergration law's, yea belive it the schools were still segregated, still in that date and time. The chief of police then stated in a City Counsel meeting when his officers were being sued (and the FBI were investigating practices of racism or discriminatory acts) the question was posed as to why officers were performing the speed traps on Pinecrest Street and how it would affect the residence who were being pulled over. His response was " We are pretty sure they are not residents of Ferndale" How,  do you know this? because the majority of stops occurring dont live here!  The Civil Rights violations and other investigations revealed the majority of stops were in fact "black" and the indication of them being non-resident's, was another way of saying they were of other ethnic make-up, without publicly saying they were racially targeting people of color.
Call it what you may to make your self feel comfortable about racism and the way it still exist, but there it is just below the surface , for all "YOU people!" to see.
Who are "you people" in this statement? am I specifically identifying a make-up of particular race?
I'm sure you'll form an opinion about it that best suits your comfortability!

Lastly if pointing out peoples spellinng is your focus then you should get a clue, and know that there are many in society without graduate , or even formal education , let alone having mental defeciencies that preclude them from spelling as you would have them to your level of expectation worth pointing out! : Give them the minus, while you take the Plus, say's something more about you then them!. You have a bad attitude. The clerk's "you people" remark may have been in reference to smokers, not skin color. You were guilty of trespassing when you refused to leave and you wasted emergency resources when you called the police over a petty complaint.

You should have verified that you had the correct merchandise prior to purchase.

Before you call other people idiots maybe you should look at your own sloppy work:

If you are so smart, why did you write "imortant" twice in this post? That's not a word.

"inappropiately, mentols, attitudial, did'nt, pleasent, misimformation, vilating, emploee and passivisim" aren't words either.

The word is pacifism NOT passivisim, you dunce! Cousin Rosa would be so proud.

Maybe you people (smokers) should learn to spell.

You are surprised that people did not want to loan you a cell phone to call the police about a CIGARETTE PURCHASE? Given your actions (and your absolutely wretched spelling), you don't sound like the kind of person *I* would want to get involved with at all. 

And also, is it THAT much of a hardship to smoke a different brand of cigs for ONE friggin' pack? Shoot, you are going to cancer no matter what brand you smoke.

It is apparant that you are not experienced with the racism or predjudice associate with "shopping black" numerous TV programs , investigative reports have shown the prevelance of the bad act. secondly there was the issue of not merely cigarette purchase, but the threatening remarks of what she, the emploee would do to this pesron who had not acted in any fashion as a threat or personal danger to her or property. ( yes I am white male who witnessed this act while returning from the Palace) Next the issue of "Civil Rights" where the public servce laws are violated based upon color as dimonstrated by the remarks of the employee are a serious allegation. The problem is society today is that people take the law into there own hands most time unneccessarly where issue of wrong or where one feels they are owed property or money. The fact is law enforcement is more capable of disciminating what is civil and criminal and not a lay person such as the idiot responding here with bias remarks of a personal nature, revealing something more underline in thier persona (underline mask). There have been quite a few murders and assualts in the Metro Detroit area at places of business resulting from such encounters, where the associate of the business was put in danger from something said or done, and the customer acted out inappropiately. Good for the customer dont apologize for doing the right thing!, and thank God I have knowledge in such area by lineage and my up bringing, and teachings of my elders and great Civil Rights lessons of my 4th cousin Rosa L Parks who taught passivisim was more imortant then a retalitory response, and direct confortation. Get some education into law as I have (school for paralegal, course's and certified) before you show how little education you have of what is civil and criminal and the investigative purposes of the wonderful Police department that protact and service all persons equally.

You just wasted the police's time and wasted taxpayer money. What occured here was a civil matter, not a criminal one and frankly i"m surprised that the police would even take a report. As for the cigarette policy, I have worked for 3 different  gas station chains in missouri and every one of them has the same policy you are quoted. No exchange on tobacco or alcohol once it leaves the store. Its to protect the employees since both of these items are age sensitive. They are also a high theft item. Reasons aside, the store is perfectly within their rights to refuse an exchange or a refund on the merchandise. As for you refusing to leave the store after calling the police, the store is private property. If the employee asks you to leave and you refuse, you can be cited with trespassing. Personally, had I been this employee and a customer called the police on me and refused to leave the store I definately would have pressed charges for trespassing. Stores have the right to refuse service to anyone. They don't need to give you a reason. You are also reading a lot in yuo someone saying "you people" that's hardly a racist insult or term. While the employee should have done the exchange, it was simply courtesy especially if you just bought them and no more than walked to your car. Now, if you aren't being truthful about the length of time you were gone from the store then I take that back. Also, if it is the store's policy then the employee could get fired from their job if they did the exchange for you. the police did give you the proper response and the same one I would have given you, the employee is doing their job take it up with the manager/owner.

The party responsible for the attitudial behavior has now been identified as " Melissa". I recieved a call from store ownerMr. Taffar today after notifying him the day before that his stating that State law prohibits returns is misimformation after I had spoken with Attorney Generals offioce, Bryan DevLin, Revenue and Collections tobacco.

Store owner apologized and then stated he spoke with Police who contacted Lansing and found , yes, there is no such State law, but now interates it is "our store policy". Yea, ole switch-a-rue, make it fit to justify the bad act.

He (the store owner) however did agree to exchange the product and apologized. Lesson, dont believ everything a merchant tells you as being truth, research and investigate the claim, they may be vilating The Consumer Protection Act in your State
