Thrifty Propane False advertising and refusal to comply with their advertising Medina Ohio

Please take notice that Thrifty Propane (“Plaintiff”) has filed an action in the Hamilton County Court of Common Pleas (Ohio) – Thrifty Propane v. John Doe, Case No. A1500404– due to allegedly false and disparaging statements published concerning her on Ripoff Report using various aliases or screen names.  This complaint is one for defamation per se, defamation, tortious interference with existing economic and/or business relationships, and tortious interference with prospective economic and/or business relationships against Defendant.  Plaintiff seeks the following relief: a preliminary and permanent injunction; declaratory judgment; general, exemplary, and punitive damages; and attorneys’ fees.  Defendant must answer the complaint within the time allotted by the Court.

Thrifty Propane has a “Price Beat” Guarantee. Our Guarantee reads:

“Please fill out the following and we will get back to you with a price that beats your current supplier by a minimum of 10 cents per gallon.”

Each customer is asked to fill out an on-line form in which they state their contact information, their county, and the number of gallons they desire, their current supplier and their current supplier's price per gallon. It is unclear from this report whether the customer advised Thrifty of his current supplier's price per gallon. In like manner, the customer has not indicated anywhere that Baker's Gas is or was his current supplier. Our customer reps require this information in order to act on the guarantee. Despite the fact that this customer  purchased his propane elsewhere, we paid him $84.00 to honor our guarantee.
