I had a poor experience with Vin Mcauley, the sales manager at BMW of Peabody when returning a leased vehicle.  Upon completion of the lease transaction, I filed a complaint about this dealer on another car rating website.  Vin Mcauley's written response to the complaint was to post that I was attempting to extort money from him and that if his dealership "paid me $ 500 I would not post the complaint on the internet".

This is a blatant lie. 

It was a great response from Mr. Mcauley since he was using the internet to discredit me as opposed to dealing with the complaint on it's merits.  I'm glad that I found this website as there is no way to respond to Mr. Mcauley's lie about me.

I'm glad to see that there are websites to deal with these types of encounters.  I appreciate hearing about others who have experienced similar encounters.

It's been a few years since my experience with BMW of Peabody, and I put the experience well behind me, until I saw this post from them.  Originally, I had posted the details of my bad experience on dealerrater.com, the website for consumers who have had a bad experience with a car dealer.  The sales manager at the time, Vin Macauley, responded to my report with a version of the events that included me telling him that i "would not post the events on the internet if they paid me $ 500".   I thought this was a good way for Vin to respond since it was not true, but impossible for me to disprove and since dealerrater.com had no rebuttal option, I posted my complaint here.

Since that time, Vin has left BMW of Peabody, so I don't know who actually posted their rebuttal on this website, but they are sticking to their story of me trying to extort $ 500 from them for not going online.  Simply not true.  As a consumer who was truly dissatisfied with the resolution of a dispute, I went online and posted my experience.  

Now on this website, they have posted the same response to my experience and said that I tried to extort $ 500 to not post a complaint online.   What should I do from here?  File a slander lawsuit?  Perhaps.  I find the teliing of my story on a public forum is powerful.  I'm not concerned that anyone who knows me will believe BMW of Peabody, I'm not worried about my reputation, so the only people they are really trying to influence would be their potential new customers.  I have no problem speaking with anyone who wants to contact me about this (((phone number redacted))).  

By the way, I am not married.  It seems odd that in their version of the story they are not sure "if it was David Paparella or his wife" who asked for the $500.  That seems like an awefully big claim to make against a person to not know who it came from.  Perhaps that is how they protect themselves from a slander lawsuit.  I don't know, I'm just a guy who holds onto things for a long time.  Hey I out lasted Vin MaCauley.  I knew I would.

Mr. Dave Paparella,

Over two years ago I responded to your online review on DealerRater (http://www.dealerrater.com/dealer/BMW-Peabody-review-16/page10/) regarding the same situation from just under 3 years ago.   We sell over 2,000 vehicles a year (for over 15 years) and this is the only time in the history of the dealership that we have been accused of what you are saying.   To be honest, I don't recall whether it was you or your wife that made the offer to remove the review for a $500 payment but that offer was presented to me in regards to your DealerRater review.   There was a management level discussion regarding whether or not we'd pay the $500 but as I stated earlier, it was a matter of principle.   I did not post the response as a way to discredit you, I posted so readers could hear both sides of the story as you left out what I felt was a crucial detail.  

I was alerted to this report just recently and I'm dismayed to see years later you continue to post this inaccurate (or at best partial information) review and I just don't understand the motivation.   If you'd like to come in and discuss or talk via a phone call that offer still stands but I will continue to defend my integrity and the integrity of my dealership with your online reviews - with no need to resort to lying.
With DealerRater, I decided to not get into specifics ... as this continues to show up online, I will explain the dealership's perspective.

Mr. Dave Paparella and his wife came into the dealership to return their lease.   When told about lease end charges, Mrs. Paparella became increasingly agitated.   She did deal with our lease manager and did ask to speak to another manager.   The lease manager correctly stated that he was the manager and that their options were to return their lease, keep their lease, arbitrate with a 3rd party or return their lease at another dealership.   This "refund" for the purchase of their LoJack didn't come up until later.   Mrs. Paparella created a scene at the dealership, swore at the lease return manager and repeated several times that he was "impotent".   At the point where a major scene was being made, we asked the Paparella's to leave the dealership.   I fielded a complaint email and phone call and that is where the threat of "going online" came up.   A few days later a complaint was registered on DealerRater and I contacted the Paparella's to see if I could resolve the situation.   I was told that if I were to make a payment of $500, that the review would be removed.   

There are several reasons why I continue to respond to these reviews.   1) the information is not accurate  2) BMW of Peabody is an extremely ethical dealership and certainly operates "above board"   3) the Paparella's feel the need to make it personal and use my name and the names of my co-workers.   So as many reviews as they write, I will continue to respond.   At least this gives any potential reader the opportunity to draw their own conclusions.   I'd be happy to discuss this with the Paparella's or any interested reader and I can be contacted below.
