Cavalry Portfolio has been blowing my cell phone up for the past 6-8 months.  Beginning in December they started to call my work.  I've told the "lady" repeatedly that I do not have the funds to pay them.  I am barely getting by as it is.  The woman that called me even admitted that I'm over extended as it is.  I'm 26 years old.  I work full time and I was working on my second degree, but decided to take a semester off.  Unfortunately, Cavalry has yet to take a break on trying to get my money.  That would have to mean they have a soul.

So I ran my credit report to see what all this is about.  Turns out it is a Bank of America account that was closed and charged off.  The Bank of America account was delinquent  in July 2006 and charged off in September of 2009.  Cavalry reopened the account July 2007. 

I know the Tennessee Statute of Limitations is 6 years, but does this mean I have to keep enduring this harassment? It's so embarrassing when she calls me at work, but she won't stop!   LVNV FUNDING, LLC is also hounding me as well.  I could really use some advice, guidance, and help (all of the above).  Please someone...  Help.

You are taking the right step by coming to Ripoff Report to post and hopefully to learn by reading many of the posts.

It is unfortunate that you may have admitted that the account is yours.  The first step is to refer to the debt as alleged debt and never admit that you are liable.  The reason is simple that the statute of limitations starts over if you acknowledge the debt to the collector.

If you did not admit the account is yours I would immediatelly do so.  If you may have acknowledged that the account may be yours you should send a debt validation letter to Cavalry and from now on you should deny that the account is yours.  You also may want to include in your letter a request to not contact you by telephone on your cell and at work.  If Cavalry violates this request keep a log or record of the harrassing calls which can be used to sue Cavalry for damages as well as to file a complaint that may result in fines to Cavalry.

Do not give them any further informatoin about your current financial situation.  You are not obligated to do so.  Since you may have admitted the account is yours it is now a possibility that Cavalry might file a lawsuit to gain a judgement and levy against your assets such as your checking account.  If this happens do not ignore it but instead get a good consumer lawyer who will be able to prevent a judgement as it is most likely that Cavalry won't be able to prove you opened the account and that the debt is legit and yours.  The bad news is that a lawyer will cost you but if you try to represent yourself you will find out that one who represents himself in court has only a fool for an attorney.  I am not an attorney, but would not try to fight in court without one as bottom feeders like Cavalry will try to twist your words and possibly have you on tape with your concent.  

If you are successful in stoping a judgement due to lack of proof of debt you surely will find your account sold by Cavalry and on to another low life debt collector.  Since your cell phone # is in the "system" it will be shared with all low life debt collectors so I would strongly advise changing your number.  Collectors will try to keep collecting even after the SOL expires.  Your phone will never stop ringing for years.

Make sure that your social media such as FB, Twitter, etc doesn't allow the public to see your contact information and actually I woul drefrain from putting your address, phone number, etc   The reason is that debt collectors have as part of their skip tracing sent "friend" requests to targets hoping you will accept and then they will have your key information.  They will even friend some of your friends first to influence you to that they know your friends and you and they are truly just a low life debt collector.
