ARBITRATOR DECISION

Complainant, Edgewater Pools, LLC (Edgewater), has challenged the identity of the Author (Anonymous) who posted a Report on the Ripoff Report website at www.ripoffreport.com on January 19, 2011, as Ripoff Report No. 684442 (the Report). The Author, who is not identified in the Report, claims to be a former customer of Edgewater and that a pool built for the Author by Edgewater was poorly constructed. Edgewater contends that the Report was not submitted by a customer but by a competitor.   Both the Complainant and the Author have agreed to submit this matter to the Ripoff Report VIP Arbitration Program.


Edgewater has submitted the Affidavits of two former employees/agents of its competitor. [continued below]....

Report Attachments:

.....  One Affidavit submitted by a former Sales Manager of the competitor from 2009 through 2011 states that the competitors president instructed sales people to post false reports on the www.ripoffreport.com to disparage competitors. Another Affidavit of a person who identifies himself as a former agent of the competitor from 2009 to 2011 states that he observed the competitors president file a complaint on www.ripoffreport.com against Edgewater on or about January 19, 2011. This individual states that on four other occasions he observed the competitors president file similar complaints against other pool builders. 

The Author has not provided a response to the Complaint or provided evidence to establish that he or she is indeed a former customer of Edgewater.

I have been asked to decide whether the preponderance of the evidence submitted establishes whether the Author is, in fact, a former customer of Edgewater.

Based upon the Affidavits submitted and the failure of the Author to identify himself or herself, I conclude that the Author of the Report is not a customer of Edgewater.
