We stayed at the Ellington Wachesaw East which is a part of the Festiva Resort in Murrells Inlet, and attended the 90+++ minute sales pitch for timeshare ownership.  We did purchase a "s****.>

Me and my wife are also victims of this festiva misrepresentation from the actual contract.

Hi,
Me and my wife are also victims of this festiva misrepresentation from the actual contract, they never have rooms available where we want to go, within a year we have traveled several times and were not able set/schedule with festiva, they told us that the maintenance fee was one time thing only, also offered us as new costumer (sign-in bonus) a cruise and when we called to scheduled they said it was either the cruise or 3,000 points, The salesman said if we signed the contract, we would get a free 7 day cruise anywhere, anytime, any cruise ship, They lied and misrepresented the timeshare. We purchased based on fraud.
We soon found out it was all fraud. We didn't get a free cruise. The cancellation policy was 5 days, not 7. We were told we could use the timeshare immediately...also a lie, In my opinion, the sales pitch was a huge misrepresentation from the actual contract from the get go
Finally found room available after a whole full year trying to used this timeshare and guess what, another surprised, WE CAN NOT USE JUST THE 4 DAYS WE WANTED TO STAY, WE HAVE TO USE THE WHOLE 7 DAYS AND LOST THE 3 REMAINING DAYS AND POINTS.We are really looking into filing a suit.
Thank you.

Response from Festiva

AUTHOR: Festiva Rep - (USA)

POSTED: Tuesday, February 02, 2010

I'm sorry that there seems to be some misunderstanding about what you purchased from Festiva. At the time of purchase, you should have received a Bonus Points Certificate outlining the terms and conditions of using those points, including any fees required for them. Typically, bonus points are additional points above and beyond your allotted contract points that can be used to make or complete reservations for a nominal fee.  If you did not receive a certificate with the details of the bonus points, please let us know. Also, there is detailed information about maintenance fees in your contract and on our website on the FAQ page of the Adventure Club Members' section.

We certainly do not intend to misrepresent our product in any way, and we want all of our owners and members to get the best possible experience with Festiva every time. I'm confident that we can help you better understand your membership and resolve any questions or concerns you may have so that we can get you on vacation. Please contact us at comments@festiva.travel with your name and the date that you purchased, and I will be sure that your information gets to the correct person or department.

Thanks,
Sara
