In March 2011, Fieldturf (the self-proclaimed World Leader in Artificial Turf) filed a major lawsuit against its largest supplier - Royal TenCate based in Holland.  See link here: http://www.scribd.com/doc/50114371/Fieldturf-TenCate-lawsuit and the TenCate answer and counterclaims can be downloaded here: https://anonfiles.com/file/2b156219169fed216c281dd9f7082044

A recent Opinion and Order in the case is here: http://docs.justia.com/cases/federal/district-courts/georgia/gandce/4:2011cv00050/173174/395/

By their own admission (see pg 31 of the May 10 2013 Opinion and Order above) at least 167 Fieldturf fields have failed because the synthetic grass fiber has degraded prematurely.   Between 2005 and 2010 Fieldturf installed many times that number of synthetic turf fields in the United States.  Dozens of fields throughout the country may be failing prematurely without the customers knowledge.

In many cases, customers with defective Fieldturf fields have had their fields replaced under warranty at no cost.  See these examples for instance:

FieldTurf installed in May 2008 at Lowndes County High School Martin Stadium in Valdosta, GA.  See this link for more information: http://valdostadailytimes.com/sports/x624712511/Lowndes-Martin-Stadium-receiving-new-field-turf

Other customers are being offered a warranty replacement and "upgrade" of their defective Fieldturf fields for approximately $175,000.

In other cases, Fieldturf is refusing to honor its warranty.  See these stories for instance:

Fieldturf fields installed in 2008 at Winslow, Sedona and Monument Valley High Schools in Arizona.  See this link for more information: http://www.azjournal.com/2012/10/05/winslow-school-board-seeks-attorneys-advice-on-field/

In a recent similar situation in Ohio, a Fieldturf customer had to resort to the legal system as well since the company was non-responsive to a warranty claim:

http://news.cincinnati.com/article/20130428/NEWS01/304270085/Colerain-High-turf-war-settled

Other customers are paying 300k and up to replace fields that are defective and still under warranty.  The synthetic turf at H.A. Chapman Stadium at the University of Tulsa has just been replaced.  The turf was installed in May 2008 and was under warranty until May 2016.  The manufacturer made a big deal about this installation in early 2008.  See this link for instance:  http://www.globenewswire.com/news-release/2008/06/03/379335/143961/en/FieldTurf-Continues-to-be-the-Choice-for-Tulsa.html.  Here's a story about the replacement field: http://www.tulsaworld.com/site/printerfriendlyblog.aspx?articleid=19897

The same for the University of Texas at Austin.  Their 2009 Fieldturf field was just removed and replaced for 290k.  See here:  http://www.statesman.com/news/sports/college-football/texas-installs-new-artificial-turf-at-royal-memori/nXbtW/

Avon High School in Avon OH installed their field in August 2007.  They have agreed to pay $295,000 to replace their defective Fieldturf field that was still under warranty:

James Madison University is paying $370,431 to replace their defective Fieldturf field that was still under warranty: http://www.dnronline.com/article/dukes_get_a_new_rug

Palisades High School has agreed to pay $325,000 to replace their defective Fieldturf field that was still under warranty: http://www.phillyburbs.com/my_town/palisades/palisades-to-replace-stadium-turf-field-in/article_c88d0d9b-6774-5cf8-a1e6-f79dae663693.html

Beaverton School District in Oregon paid over $800,000 to replace the synthetic turf fields at Westview and Southridge High Schools that were defective and failing prematurely: http://www.oregonlive.com/beaverton/index.ssf/2012/04/beaverton_school_district_to_s.html

It is important to point out that in an open, competitive bid environment and where it has NO warranty obligations whatsoever, Fieldturf  bids approximately $325,000 to remove and dispose an existing synthetic surface and to supply and install a new surface.  See these 2 examples for instance:

Fieldturf positions itself as a leader in the industry that supplies premium synthetic turf products and installations.  It proudly proclaims, among many other things, it has the:
  • "Industry's Best Warranty"
  • "Longest-Lasting Turf System"
  • "Highest Return on Investment"
See here for more information on Fieldturf's marketing claims: http://www.sd129.org/database/district/downloads/district/FieldTurf_Brochure-b.pdf

As you can plainly see, the application of the Fieldturf Tarkett warranty is inconsistent and unfair.  Some customers are getting their defective fields replaced and upgraded at NO COST under warranty.  Other customers are paying hundreds of thousands of dollars to have their defective fields replaced under warranty.  They are paying, in some cases, more than customers who do not have a valid warranty claim.  Finally and as cited above in cases in Nashville and Texas, the company is refusing to honor warranty claims from its customers.  These customers bought the same product from the same company at roughly same time but are getting dramatically different treatment under the company's warranty.
