I became behind on my Military Star Card when my Fiancé got discharged from the military and I lost my job due to being laid off in March 2015. I was notified after filing my taxes in January 2016 that they would be taking all 5000 of my federal tax refund dollars. After contacting the Treasury office, they told me that the only people who can stop this is the creditor themselves. I reached out to the creditor twice trying to make arrangements as well as file for a hardship. They insisted that they couldn't help or withdraw the information from the debt until its paid. Basically telling me they can and will take all the money they can. They also told me that filing for a hardship would take about 30-45 days. When i requested to speak to a supervisor i was placed on hold by two different agents many times. I was given a non-working number and told to call the supervisor and leave my name and number, and they will get back to me as soon as possible within 24 hours. The number I was given for the supervisor is 614-791-4651. I explained my hardship of not being able to pay my rent or utilities, as well as having two children. They didn't care and said sorry this is your debt and we will do what is needed to collect but if you like you can set up a payment plan for the remainder of the balance after we take the refund. How am I to pay that money if I cannot even pay my normal bills due to them taking my refund.

I have never received an intent to offset from this company, if that was the case I wouldn't of filed my taxes this year until it was resolved. I haven't lived at that address in over a year but my mail is forwarded and I still didn't receive anything. I have even updated my address with the company and was on a payment plan and made payments up until march 2015 when I was laid off. To which I contacted them about a hardship, and they told me there is nothing they could do to help. How is it that you say you sent it to collections in January but payments were still being made on the account as the payment arrangement requested until March. I am a single mother whom relies on this tax refund to get my family by with a roof over our head and electricity and water as well as food. I cannot provide that if its taken from me as explained. AAFES didn't assist or help me they referred me to the collection agency telling me that they were the only ones whom could help. When speaking to the collection agency they did nothing but give false information about whom to contact about this issue, non working numbers. After being referred to the Treasury office twice they said that the collection agency is the only one who can stop the offset as they are just information based.

After speaking to the collection agency yet again and being placed on hold many times I was told I could file for a hardship that would take 30-45 days but that that wouldn't stop them from taking my refund. And they wouldn't return it if i was approved for the hardship they would just help me pay back the remaining balance. With them taking this they are forcing me into bankruptcy, as they have take them money needed to keep my family a float. AAFES also didn't address my issues on my refund, nor were they willing to do anything or come to any agreement. Might I also add that they claim to have sent the intent to offset in January of 2015, but funny thing is I filed my taxes in April right before the deadline, as I had not received the intent to offset as claimed and was able to get my full tax refund. This company will not work with any veterans or their families, all they care about is their money . It doesn't matter if people become homeless because of their actions. I have attached the most recent correspondence from this company. If they were in fact going to take my tax refund this year why would this letter dated January 31st, 2016 state "If you have an income tax refund, perhaps you can use the proceeds to pay this account." Which is giving me the option to use the proceeds to pay, instead of knowing they were going to get my refund already and leaving that part out.

They claim to have sent notice of the offset in January of 2015 due to them saying I didn't have a payment plan in place, I never received anything or any notice to offset. And I was also on a payment plan of $200 a month at the time up until march 2015 when my payments fell behind and they would no longer work with me due to my job laying me off at the end of March. After contacting this company repeatedly, and them either hanging up on me or giving me false information as to whom i can contact to help me resolve this issue. I am coming here for help. I was basically told after weeks and weeks of trying to contact this company that they will not give any part of the refund of 5377 that they took from my taxes even if I am in a hardship. They claim that the hardship would only help pay the remaining balance after they collected all of my refund that I desperately need to keep my family a float. After lying to me and telling me that they would help and do what they could after speaking to the higher ups they avoided my calls and when I did finally get a hold of them they claimed sorry there is nothing that they can do and I would be on my own and sorry for any inconvenience. This is not acceptable or even fair! I needed that money to pay rent, my lights and water so they don't get shut off as well as food for my children and these people just don't care at all!

Sorry but this is not a RipOff..

Just because a company doesn't do what YOU want, does not make it a RipOff.  As such, you are not going to want to hear this, but they are not ripping you off.  So here are some facts for you.

First off remember the very first thing.  The only reason that they are taking your $5000+ tax refund is because you have a balance of over $5000 with them.  When you got the card you made a legal agreement that in exchange for letting you borrow their money, you would make specifc payments.  There was nothing in that agreement that stated they had to "work with you".  There was nothing in the agreement that said you didn't have to pay them if times got tough.  But what was in this agreement that if you failed to make your payment they had the right to do things such as take your Tax Refund.  

Let's look back at a few other things.

You come off trying to say that up until March 2015 you were making payments, well that turned out to be only partially true.  You later state that in January you were already on a "Payment Plan", which means you were already having issues(this is important later).  It also means that this company that according to you only cares about money was trying to help by allowing arrangements.  As a side note on this you wonder why they didn't take your refund in 2015.  Well the reason for that is simple.  You stopped paying in March 2015, and did your taxes in April.  That is only a month later, and at that time they were most likely still in the "let's see if we can work it out stage".  So it wasn't long enough.  However, in 2016 that is now almost a year later.

Now, on to a bit more financial info...

You say that you are now forced to declare "Bankruptcy".  Where I have a fact for you.  If this one bill and the refund was the only thing between you and bankruptcy, it is just a matter of time.   You were going to be in this position anyways, they just happen to be the "scapegoat".  Of course I know you are saying that isn't true and things such as "Well only if they would do..." or "If they would just let me..." that you would be okay and everything would be fine.  Well you will find many a people who have said those same words only to delay the inevidable.   So if you are truly in this position and not just trying to use "buzz words" to get sympathy perhaps this is the time to declare bankruptcy so you can start to move on.
