 A Classic Lawyer-Trap, In Orange County

Arash Shirdel, who is an attorney in Santa Ana seems confused about his role. Experienced attorneys, are supposed to win, win quickly, and close a legitimate case, or are they?  Most civil business disputes self-destruct by way of settlement, or simply close after a few years, that is where smart attorney’s walk away.

“A Lawyer-Trap” is a case that is designed by attorneys to pressure defendants or plaintiffs into retiring a civil business dispute with usually a fairy tale of allegations attached. The opposing lawyer usually files enough paperwork that will quickly deplete the best bank balances, but before you settle, beware of the long-term affects.

The company “WECOSIGN” was doing exceptionally well in the start-up stages. WECOSIGN had gone public within a year, and suddenly the plaintiff (Carlos Padilla III a former trusted employee) decided that he should be running the company. Padilla III filed suit after he was terminated for cause, according to  Frank Jakubaitis, founder and CEO. Padilla III did not need a big pocket to sue but his lawyer saw a pay day down the line and took on the battle at no charge, “A classic Lawyer Trap”

This civil case started ten years ago and has suffered through 84 court appearances, a suicide by the Superior Court business receiver (Patrick Bulmer,) and the death of a United States Trustee from cancer in the middle of the subsequent bankruptcy case.  Carlos Padilla III through his attorney Arash Shirdel filed over 356,000 pages of allegations, nine motions in excess of 17,572 Pages, 10 motions requesting a summary judgement consisting of 65000 pages, he had the (un-fortunate or fortunate) benefit of the two witness’s dying, had 6 different Judges assigned, submitted 10 modified complaints (someone in the mix submitted forged documents to the federal court) and still the plaintiff Padilla III, and Shirdel claim and complain to the courts that Frank Jakubaitis’s is the sole reason why this case is and has been on-going for ten years. Is putting up a legal defense, a new concept, ask “Jakubaitis?

Finally when attorney, Arash Shirdel rented a portion of his law office to a duplicate company called LET-US-COSIGN (a mirror image of WECOSIGN) during the very early stages of this law suit, it seemed likely they he had more than a casual interest, “says Jakubaitis”

The verbal and written Internet disparagement was so financially devastating, “I was forced to steer WECOSIGN into bankruptcy seeking protection, or so I thought. Bottom line, I learned it cost a lot of money and time if your-self represented and drawn into a classic “Lawyer-Trap says Jakubaitis”

The only thing this law-suit and Carlos Padilla III did as a single plaintiff was destroy the share-holders equity of a public company, (all 72 of them) and put 10 employee’s out of work. To date Carlos Padilla III has recovered nothing.  

Jakubaitis has now filed a massive personal damage suit after 10 years against Padilla III  Will he win, (who knows) but one thing that he has learned when asked, “Superior Court’s and Bankruptcy forums don’t like people who are self-represented. Even if your court decorum is proper and your recital of the law is correct. “Thank God for jury’s” but even then, it’s a toss-up, when self-represented “says Jakubaitis”  This case is a classic “Lawyer-Trap” Beware these attorneys really do exist.
