We made a long trip to see the "good deals" that they had and to see if we could get a decently priced van. What I got was a pushy saleswoman who kept trying to get me to go above what I wanted to spend, and then with the taxes and extras that I didn't even know were on the form she succeeded. They kept us there all day procrastinating between the stuff for the different vans we wanted to see and then stalling with getting the paperwork together so it would keep us there longer wearing us down so we would buy a van. Well it worked, I agreed to get the van just so I could leave.

Then after we drove off the lot we went to the gas station since the tank was on empty and we noticed that the break lights weren't working. So I called the saleswomen to see if they could do something about it since we weren't that far, basically across the street and she said yeah to bring it back. Well that's what we did and they weren't done screwing us over just yet.

They wanted to charge us to fix it because we bought it "as is" and had "left the lot" after arguing with them about it and demanding they give me my check back since I paid for the stupid thing in full and I knew they hadn't cashed it yet, the woman refused and went to talk to one of the head bosses and they decided not to charge us for the repair. I still said that wasn't good enough and that now I worried about my children's safety, if that could happen pulling out of the lot who knows what else is really wrong with it. They still refused to give me my check back and take the van back into their possession after arguing with them for a very long time.

I had my infant with me because I'm nursing and so eventually I gave up and decided to take the 2 hour trip home and make sure to let everyone know about how horrible these people are, they exploited the fact that I had a baby with me, kept us there literally all day and just aren't good people and should be avoided at all costs.

"ALL USED CARS IN THE STATE OF INDIANA are sold AS-IS (it does not have to be disclosed to you b/c it's used and assumed that b/c it's used it's AS-IS) even if they aren't advertised as-is."

  The disclosure is required on the posted buyers guide by FTC regs for any dealer that sells more than 5 cars per year.    The buyers guide must be "posted prominently and conspicuously on or in a vehicle when a car is available for sale."  If your employer is not doing this, he/she could be in for an expensive surprise.

  There is no assumption that cars are sold "as is" in Indiana or anywhere else.   The dealer has the option of selling the car "as is" or providing a warranty (and posting a different buyers guide), though most choose not to.

I realize the situation you were in. With that in mind know this, and I am not blaming you just giving advice for the next purchase.

1. A car dealership CANNOT keep your license while you are on a test drive. You must have that license in the event that you get pulled over while on that test drive. They should make a copy and hand it back to you.

2. they shouldn't ever need your insurance information in the State of Indiana unless you actually purchase the car. Even then, the insurance information should be copied and handed back to you immediately. On A test drive the car is legally the dealership's and should be covered by their insurance the entire time.

3. ALL USED CARS IN THE STATE OF INDIANA are sold AS-IS (it does not have to be disclosed to you b/c it's used and assumed that b/c it's used it's AS-IS) even if they aren't advertised as-is. So, before you buy it ask if when you take the test drive if you can take it to a mechanic down the road for a $20 twenty one point inspection. If they say no, then DO NOT buy the car as they may have something to hide. (they do not have to inspect anything on the car when they put it in the lot except the Frame, that it starts, and that it drives)

4. Get EVERYTHING in writing and tell them firmly that you do not have time to wait all day, threaten to leave if it takes too long. Then if they have a problem with your terms of the purchase (which should be reasonable) then leave. If they don't give you your license and insurance info upon your request or withing a reasonable amount of time I would call the police and report harassment/theft.

(My credentials- I am a car salesperson in the state of Indiana. Specifically Indianapolis) As a Salesperson these are the laws we have to adhere to, very strictly at all major dealerships. Smaller dealerships have the same rules to follow but skate a fine line.

Next time...

The next time you visit any auto dealer, it would help you to do the following:

1.  leave the kids home or with a sitter.  It's hard enough to keep track of everything during an auto purchase without being distracted by the little ones.

2.  Arrange financing on your own with a bank, credit union, etc.  This way you will KNOW how much you can spend and you'll usually get a better interest rate.  This is part of your budget process; you determine what you can afford (total purchase price, NOT MONTHLY PAYMENTS) and you have a lender-you're preapproved for an auto loan with a lender of YOUR chosing.

3.  If you "hand over" your license to them for a test drive, get it BACK from them immediately after you return from the test drive.  Accept NO excuses-GET IT BACK IMMEDIATELY.  If they refuse, call the police.  Do not tolerate any stalling tactics.  Every time I've purchased a new car/truck, the entire process took about ONE HOUR and the salesperson was with me the entire time as we negotiated.  If any salesman were to leave me sitting around for more than 5 minutes, I would be out the door.

4. READ all documents before you sign anything at an auto dealer!!!  If there are any blank spaces or there is something you don't understand, do not sign anything.  Also, do NOT ACCEPT SPOT DELIVERY-it they attemp spot delivery, run, don't walk away.  Spot delivery is when they let you take the vehicle when there is NO SIGNED LOAN AGREEMENT between you and the lender.

As for the rude comment from Flynrider, no did they did not hold my family hostage but they did hold my driver's license and insurance card hostage when I had to give them to them to test drive the van to begin with. So before you go being all rude and judgmental remember nobody's perfect and this site is about talking about your personal experience with the sellers. I'm a young mother with two young children and they saw me coming a mile away and took advantage of me, and to be honest I was exhausted from not sleeping for over a week due to my Great-Grandmother dying and my baby teething so I wasn't thinking clearly so I didn't put up as much of a fight as I should have. And you know what I got taken, I never should have gone but I did and I made a mistake. Writing about what happened made me feel a little bit better about the whole situation and I'm not apologizing for it, but I will not be attacked for vocalizing my opinion about the dealership and the saleswoman that I dealt with. And I learned from my mistake, I will never go to that dealership again or any that I see advertised on the internet, no matter how good the deals seem. I'm only going to stick with local dealers who I know, and only those with glowing recommendations from people I know and trust. I also will take somebody who is more knowledgeable about the whole process with me so I don't get screwed over again. So as I stated I learned my lesson, I don't need to be berated by strangers for my mistake, I'm already doing that enough myself, but thanks though. I have to live with what happened and so do my children and I don't need some jerk who's trying to make himself feel better by belittling people over the internet for making mistakes feel worse than they already do.

I'll never understand this

   Are you saying that you couldn't have left unless you bought the van?  Are your legs broken?


   It boggles my mind to hear these stories of people who report being treated badly, ignored, made to wait for hours and yet they still felt compelled to hand their alleged abusers thousands of dollars for a new vehicle.


   If you think about it, buying a vehicle from someone who has pressured you and treated you badly, only encourages them to do it more.  If that method works why would they treat you well?
