Wanted to price match with 42d Street Photo NYC who offered same camera at about $300 less w/o gadgets. 

They would not honor their stated guarantee "price match guarantee" which is illegal false advertising and bait and switch, etc. Will file complaint with DA, CAJ and Consumer Fraud Bureau of State of Calif

Damages, and injunction is permitted, under CA B&P Code 17200 et seq. 

Our reporter is consumer rights lawyer. They lied to the wrong person!

Let me clue you in on a few things...

First of all just like you are incorrect about several things in your original post, you are incorrect about the response being from Best Buy due to some "sniffing" agent.

The fact is that if you spent anytime on this site you would realize that the Standard Operating Procedure when someone doesn't like a post is to accuse that person of working for the company.  However, that only turns around and makes you look silly.  As for your "sniffing" agent, take a look at the top of this site, you will see a link that says "Latest Reports".  Do you know what that shows?  That is how it was found and just like you get updates, so does anyone who posts on your report.

As for your suit, as mentioned I do not now or have I ever worked for Best Buy and except for being an occasional customer have no other ties to them.  With that said, if you are really an attorney(or know one) I am not shocked about you wanting to bring a Class Action Lawsuit because you know that if it ever got that far, the only people who make any money in this is the Lawyers.

Then in talking about the vendor you wanted to price match with.  If you want to shop there then go right ahead, just like I could care less if you ever shop at Best Buy or not, I could care less if you shop at this other site.  But before you do perhaps you should take a few minutes and look at the complaints posted about them just on this site.  Now, this site does have a policy of not allowing competetor company names, however some slip through and it appears this may be one of those cases.  As such just let me help you and in your search in the box above type in "4 2 n d" with all of the spaces removed.

Good luck and when you do file that Class Action Lawsuit I hope you come here and update it with all of the court information for all of us to follow.

Best Buy Fraud: Managers say YES to discounting!!!

The response is obviously from Best Buy themselves via a "sniffing" agent they use to cove up  fraud claims. 

Our rebuttal is that NOWHERE is the gurantee mentioned in the ad. Upon calling the store, not only did a sales person but a manager at Best Buy confirmed to us that they would honor the "price matching guarantee" in the ad, which had NO qualifications. They breached the promise. The suggestion that this unqualified vendor had suspicious business practices is pure defamation as an effort to cover up their misrepresentations.  See you guys in a class action costing Best Buy millions in attorneys fees and payouts.

Before you decide to sue, perhaps you should get your reporter/lawyer to actually read the terms of their price match guarantee.

  • We match BestBuy.com prices on in-store purchases and in-store prices on BestBuy.com purchases.
  • If we lower our price during the return and exchange period, we will match our lower price, upon request.
  • Our Price Match Guarantee covers one price match per identical item, per customer, at the current pre-tax price available to all customers.

Our Price Match Guarantee does not cover:

  • The online prices of retailers not listed.
  • Contract mobile phones sold by any online retailer.
  • Products shipped from or sold by third-party sellers (Marketplace sellers) on websites.
  • Best Buy For Business transactions and BestBuy.com Marketplace items.
  • Competitors' service prices, special daily or hourly sales.
  • Any financing offers, bundle offers, free items, pricing errors, mail-in offers, coupon offers, items that are advertised as limited quantity, out of stock items, clearance items, open-box items, refurbished items, pre-owned items, credit card offers, gift card offers, rent/lease to own items, and items for sale Thanksgiving Day through the Monday after Thanksgiving, whether offered by Best Buy or a competitor.

 

I bolded and underlined the one part that may be of particular interest to you.  By the way if you want to start talking about ripoff's, perhaps you should research the company you were trying to price match with.  You may be in for a bit of a shock.
