ATTENTION all current and former employees of Business Recovery Services.. You may be owed back wages! If you worked for Business Recovery Services - Brian Hessler and did not receive at least the Arizona Minimum Wage for all hours that you worked, you may be entitled to compensation! Please read the following:

Independent Contractors: Classifying a person as independent contractor usually reduces the small business owners exposure under laws and regulations governing the employment relationship and requires a 1099 contract to be in effect.

An independent contractor is not legally considered an employee of a small business however; because of this classification, the rights and responsibilities that the small business owner has toward the independent contractor are different for those responsibilities he or she has for individuals classified as full or part time employees of the business. For example, non discrimination laws apply to the employer and its employees, but not to its independent contractors.

In exchange for using the advantages independent contractors provide, the employer substantially loses the rights to control the contractor. While the employer can still control and expect results however, the employer cannot dictate where, when, or how work is to be done. Thus, the employer loses control over the work processes, tools, and work schedules by which the work is performed. The demarcation between what constitutes an employee versus an independent contractor can be ambiguous. For example a person is more apt to be considered and independent contractor when:

A 1099 contract is involved and defines the relationship between the business owner and the contractor.

Submission of an invoice for payment for services rendered to the business owner for payment.

Usually has established a Federal Employer Identification Number (FEIN).

Responsible for his or her payroll taxes.

Work on a project with a definite completion date.

Setting ones own hours.

Possessing a high degree of skill.

Using ones own tools, materials and office.

Working on relatively short projects.

The above examples are based on common law interpretations and on a list of 20 criteria used by the Internal Revenue. Misclassification of people as independent contractors can result in substantial tax liabilities and fines for the small business owner. When in doubt always consult an employment attorney.

Also, May an employee agree to work for less than the minimum wage? No. The minimum wage is an obligation of the employer and cannot be waived by any verbal or written agreement or employment contract.

Monica is wrong!

Business Recovery Services (BRS) contracts people to perform work on BRS' behalf.  "Monica" disputed this fact, alleging that BRS in fact had employees working for BRS.  BRS filed an SS-8 form with the Internal Revenue Service (IRS) to make a final determination whether BRS workers are employees or Independent Contractors.

The IRS has responded that all BRS workers are, indeed, Independent Contractors.  Therefore, "Monica" is clearly wrong, and this determination by the IRS should bring this issue to its natural conclusion.

This guy, Brian Hessler and his company of felons, Business Recovery
Services is a crock of deceit!  They use fear tactics and bully tactics
to take money from scared people in a downturned economy.  He and his
entire staff have been verified to have rap sheets that all include
felony fraud.  Don't give him a dime!!!!  RUN RUN RUN!!!  Brian Hessler
and Business Recovery Services BRS is a FRAUD FRAUD FRAUD!!!

No Earnings Statement for Employees

Please be advised that Business Recovery Services - Brian Hessler has refused to provide the required earnings statement to his employees for the current tax year.  Appropriate legal action is now being taken against Business Recovery Services - Brian Hessler.

Please take notice that I never criticized Business Recovery Services' and/or Brian Hessler's business practices. I criticized their employment practices. There are huge differences between the two. Further, who said that I was an employee or former employee? Sounds like somone has a guilty conscious to me. However, with that said, I do, in fact, take issue with many of Business Recovery Services' and/or Brian Hessler's business practices. There are complaints filed on RipOff Report and through the Better Business Bureau which have merit.

Business Recovery Services (BRS) cannot respond to Monicas specific complaint, as BRS has never had anyone by the name of Monica who has performed work for BRS.  Therefore, BRS questions how Monica could even possibly comment on the business practices of BRS, since Monica has never performed any work for BRS.

 

Please be assured that BRS does follow all Federal, State, and Municipal laws in all of its business practices.
