I was a company driver from Dec 8th 2014 to June 10th, 2015. I was an OTR team driver running coast to coast, border to border. I was not into the whole "team driving" aspect of the job because I do not like the fact that some one else affects my performance. I always ran my clock on time, made pick ups and deliveries on time (when extenuating circumstances like traffic or weather was going to run me late, I notified proper people and was re-issued a new appointment time). 

On more than one occasion, I asked to be either transfered to another truck so that I could run solo or be traded with another fleet that has a vacancy. At no time was my request given any real consideration. I usually just got replies on the Qualcomm saying there was nothing available. 

 

IMPORTANT NOTE: My team driver was a great guy but honestly had ZERO concept of what time management meant. Prime example: Once I got the load to within 370 miles of the receiver and had about 7 hours left on the appointment. Plenty of time for him to drive 5 hours, take a 30, and make delivery all while my 10 hour mandatory rest clock would be running down so I could drive out after making the delivery.  I turned the truck over to him and headed to the sleeper. I woke up 3 hours later and was alone in the truck. Upon looking around I saw that we had only moved about 100 miles in the 3 hours, and he was OFF DUTY - MANDATORY LUNCH BREAK and had been for almost 2 hours. He wouldn't answer text messages or phone calls. Finally when I could get him on the phone his response was simply "Oh, I wanted to talk to my daughter". They make headsets and earbuds (the latter of which he had and used) to make calls on when driving. 

 

Well either way I wanted to be on my own so my actions would be my own as well as any consequences from said actions. Nothing I could do but stay a team driver. 

 

About a month later I requested to go on home time because my mother had just been diagnosed with stage 4 breast cancer. Since she is my only remaning parent alive I wanted to be there for her. I was told I would be given a special 2 week extended home time to help her get her chemo set up (she does not have a car) and set things in motion for when I am out on the road. 3 days before I was to come back to work, I got an email from my health insurance company giving me options under COBRA to continue my health insurance coverage now that I was no longer employed. No sooner had I closed my email app to call England than my phone rang. A lady from Eagle Atlantic (finance company for the truck driving school loan) was letting me know that since I was no longer with England, I would be given 30 days to begin making payments on the $5,800 school loan, of which I would now be responsible for the balance of $2.220.

 

I set up payment arrangements and asked her if I would still be held to the 9 month contract (should have been 6 months because I am a veteran. Somehow they lost my DD214 and set me up on a 9 month contract.). She said that I was responsible for the remaning balance and would also be barred from working for another truck driving company until the contract expiration date of Sept. 23rd 2015.

 

The whole point of the contract was for C.R. England to pay the $5,800 school loan in return. This does not make sense to me. If I am taking over financial responsibility for the remaining balance, I should then NOT still be held to the 9 month blackball.

 

Also, as far as I am concerned, getting fired while on home time taking care of my mother who just found out she has gotten cancer is unlawful termination and therefore I should not be held to a contact of any sort. I signed up for 9 months, promised 9 months, and am STILL willing to come back and keep working. I called the rehire department and the one person responsible for rehiring former drivers is never at her desk. I have left multiple voicemails over the course of 2 weeks following the termination, left numerous messages with people that told me she was on "another line" and would return my call as soon as possible.

 

I have since gotten a copy of my DAC report from HireRight and under PREVIOUS EMPLOYERS, C.R. England is not even on it. That whole page was blank and had a line stating -no entries-. I have obviousy applied at other companies and every time they call England to get my records only to be faxed a letter stating I was a current employee, still under contact, and would not be available for hire by anyone else stating several state and federal statues informing them that should they proceed with hiring me, they would be sued.

 

If I am not being malicious, paying off my loan (even still willing to come back and finish what I started), I should not be having this hard of a time providing for my family. This makes no sense. I do not know what to do. Any help with this would be EXTREMELY appreciated. Thank you.

For one thing, cr england leagally can not do the things you wrote about. Ive been out here 25 years and Ive heard all kinds of bad thing about cr england. Why were you fired? Because of your co driver? It sounds like you where ex military. My advice to you is to contact ooida out of missouri, they love cr england, sueing them that is. But DO NOT let england push you around. They figure that you are a little pion and they are a big company. Well go after them and nail theyre a*s to the wall. Please call ooida in missouri they will help. Sincerely Oliver Margetin, 25 yrs exp.
