I hope you are well.

I responded to an add online about a painting company looking for subcontractors. Not yet having a general contractor's license, I messaged with hope of still getting work as an independent contractor until I passed the general contractor's test, then be added on to the company as a subcontractor.

Derek Wolfe, owner of the 360 Painting franchise in Beaverton, called me and we had a great conversation. I told him I started my business to help as many people as possible, and I wanted to connect to people who have more experience than me so I may learn and grow. Derek and I set up an in-person meeting that ended up not taking place. Instead, someone else reached out about possible work, and I was adament about meeting Derek in person first to discuss the opportunity. After Derek further ignored me, a man named Chris reached out to me and said he is the new project manager, a different project manager than I just spoke to.

I met Chris, we set up a job, and completed it, homeowners were very pleased. Chris returned to do the final walkthrough, then asked me if I am able to do it, and he left.

Next project was a larger house on more difficult terrain. They offered us less money. I stated that we will need more money for this project and also scaffolding or a lift for safety. Chris said that their company does not provide lift or scaffolding for safety and it was on me. I informed him that it is on the sales person to see and understand that in the bid, so homeowners are aware, and bid can be adjusted to include whatever safety is need to get the project done correctly.

Chris then told me that they are able to increase the pay by more than $1000, but they can not provide safety. He told me they will have to hold off on the project. I did not want to lose the project for Derek or myself, so I spoke to the homeowners and let them know I would be packing up my belongings and the project is paused. They were not happy. I explained that we will not work without the safety to complete the job.

The homeowners complained about 360 many times; lack of communication and then miscommunication when they did communicate. The homeowners told me they were willing to pay for the safety, a 60' lift, if Derek can add it to the work order. When I let Chris now what transpired, he was surprised. He said he spoke to Derek and now 360 is going to take over getting the safety equipment.

I was surprised since they said they will not and put the project on hold, now the customers agree and they step in. Chris asked if we needed 1 or 2 harnesses, because they had to be bought outright, I let him know we needed two, and they will be beneficial for 360 as they work on other projects that require lifts. Though 360 did not want to get lift and suspended the project, when the lift came, Chris asked me to take 'action shots' so they can use them for advertising.

We used the lift and completed 99.9% of the project. We followed the work order perfectly; and the work order was wrong. This required my team and I to go back on the 60' lift and up 35' to repaint for hours. When I asked Chris about the change, he said the work order changed many times and thought the homeowner was going to tell me about it. Derek Wolfe showed up for an unannounced walkthrough a couple hours before we were finished with the entire project.

He told us all was well, the homeowners needed to clean up and get ready for an event that weekend. He said that we can go back for touch ups. As I mentioned, there was 2 hours of touch ups, and if we did not have to go back and repaint for 4 hours, the entire project would have been finished. I was also told to leave the harnesses behind because 360 had to "eat the charges".

Before Derek left, I asked him to pay us in that moment. He hesitated and said he has to wait until the next day. I looked him in the eyes and said you will have the entire check for all of the work correct? He looked me in the eyes and said yes. Derek wanted to meet at a Sherwin Williams the next day and we did after he showed up late. I was excited to see him, finally speak to him in person, receive our pay, and speak about more opportunities that may be available.

Derek greeted me and gave me the check. As I started to open it, Derek said they made some adjustments. That is when I felt sick because I knew it was not the amount, I just did not know how much it was off by. When I looked, it was less than half of what we agreed to. He charged me for a day of lift rental, which was supposed to be in bid, and then added to work order, he also charged me $170 for the 2 harnesses I was told to leave behind.

In all, he shorted me $1892.42 I was upset, and mad, though I did not get disrespectful, I just read him what it said on paper he handed me and the spoke about the difference and the work we did. I initially handed it back to him and asked for the whole amount. Then Derek got disrespectful and started acting condescending to me. He was acting as if he was not going to give me the check back, asking if I wanted it or not, and then he actually said no he was not going to give it back to me. He had it in his hand and was tempting me. He said "He has dealt with subs before". So I then also felt bad for other people he has robbed and taken advantage of.

Derek knew my situation because I told him I just started the business, I am a fulltime student at Portland Community College majoring in Building Construction, trying to build an honest business helping people so I can help my family. I messaged Derek and reached out to 360 corporate, even other franchise owners with hope of getting help in this matter. Derek messaged me for a couple days, so did a Daniel from 360 corporate, both speaking about working on a solution.

They did not want to mediate outside of court, or the public, so I went online. It was to my surprise that the owner of 360 Painting corporate, Paul Flick, has his own rip off reports, and had been taking advantage of people for many years. Russell Krus, chief legal officer for Premium Service Brands, emailed me and tried to bully me with words, saying I am defaming 360 painting, when I was only telling the truth, and honestly just asking for the money that is still owed to me today 7/16/2021.

I sent out the complaint notice through CCB, which gives the other party 30 days to respond, no response, yesterday 7/15/2021 was 30 days. I messaged both Derek and Russell to ask one more time for self mediation and they did not respond. Today 7/16/2021 I officially filed the complaint and am writing this ripoff report. I have text messages of disrepect and unprofessionalism by the project manager Chris, proving wrong work order, which Derek Wolfe has since taken down. I also have Derek Wolf on video with the check.

I will be exposing Derek Wolfe, Paul Flick, Russell Kruse, and 360 painting for touting themselves as "the #1 painting franchise" and taking advantage of people. Is that how you become #1? After all this, I see Derek put an ad on craigslist, hiring, and listed "scaffolding and lift" which they told me they do not do.

This is sad and I was actually depressed for a few weeks because I could not pay my partner for the work.  Derek Wolfe still owes me $1892.42 - that is all I want for the hard, honest work my team and I put in. I hope this helps someone.

PEACE
