Destiny auto world was preparing to sell a vehicle to myself through quality assurance fiancing, their salesman Rich accepted our $1000.00 down payment, $800.00 in cash and $200.00 through a bank transfer and the finace company sent back the contract and denied the loan because of an insurance issue, We met with Rich to resign paperwork now that i was covered on the insurance policy on September 12th and had already fixed the issue with the insurance and he took the vehicle(with our property inside) and left us stranded in Dallas without any notice or warning as to why he was taking it, i wanted him to look at a problem with the speakers and he took off in the vehicle then proceeded to send me a text message afterwards saying the vehicle was being repossed for no insurance, we originally met with Rich on August 31st 2014 at a FedEx Kinkos location to sign the paperwork and give him the down payment, that day we gave him $800.00 in cash and he said we could take the vehicle home with us since we showed him proof of insurance with my girlfriend on the policy as a driver and the vehicle listed, which at the time he said was ok. but later on we were told that Blake was required on the policy, so after Rich taking the vehicle with no notice or warning we contacted him and set up a time to get our possessions out of the vehicle and for him to return our down payment since the contract was never finalized and nothing was sold to us and he refused to give our thousand dollars back, also during the time we had the car we had to purchase a new battery for $116.00 and a used tire for $25.00, when he returned our property he failed to return any of the paperwork that was left inside the glove box which included insurance cards and the reciept for the battery

Destiny auto world was told about my license before purchasing the vehicle and I am fully capable of getting auto insurance and have it right now, tell me why I was able to go to a reputable dealership and purchase a vvehicle succesfully, I have never driven recklessly and the vehicle was being purchased for my fiancee who I wanted to add to the loan but rich didn't want to, I was never notified of a repossession because the vehicle was never purchased in the first place, I actually brought the car to rich the day I was able to update my insurance because I had been working all week so he could look at the speakers that had started not working and he took off I  the vehicle with no warning at all, and it's very childish for a company to make false accusations about illegal activity I've never done drugs let alone done anything illegal in a vehicle so basically if you want a car go to an actual reputable dealership even though I never got my down payment back I was able to save for a few weeks to get another down payment and go to drive time and get a car with no problems and like I said I have insurance on the vehicle and me so quit lying destiny auto world

We have drafted this correspondence as a formal rebuttal to a complaint filed on 9/13/14. For future reference, be sure to make note that our office is no longer located at 1205 Summit Ave., Plano, TX 75074, so do not mail any future correspondences to this address, as we have not been recieving those notices. Instead, be sure to send all updates regarding our business to our mailing address at: Destiny Auto World Inc., P. O. Box 700184, Dallas, TX 75370 or contact us by phone at (214) 641-5004.   

As it relates to the complaint filed by Blake Dowell on 9/13/14, our firm adamantly denies all of his false and very misleading allegations.

In actuality, in purchasing a 2007 Chevrolet Impala, Blake Dowell signed a binding 'Agreement to Provide Insurance' and then failed to get insurance in a reasonable time frame. While we initially gave him over two (2) weeks to provide our company with coverage for the vehicle, he demonstrated that he is very childish, immature and irresponsible and failed to do so. Several members of our staff attempted to contact Blake time and time again to get him to follow through on his promise to get insurance, and he deliberately did not answer the phone and refused to return several messages from our office. During this process, Blake Dowell openly admitted that he had grown 'frustrated' with his inability to get insurance and therefore deliberately stopped taking calls from our office.

Meanwhile, Blake Dowell continued to drive the car with no insurance, which placed our firm at great risk. At the same time, Blake Dowell openly admitted smoking weed and partaking in other illegal and very dangerous conduct while operating the vehicle. Our staff later discovered that Blake Dowell presently has a 'suspended license' due to his reckless and irresponsible behavior in the past, and as a result was unable to get legitimate auto insurance as promised. In the end, the vehicle was repossessed for 'no insurance' and despite his repeated lies, Blake Dowell was promptly notified of the repossession and provided with a detailed explanation.

In the end, these unfortunate events were a direct result of Blake Dowell's irresponsible conduct and failure to honor a legal and binding Agreement. In effect, Blake Dowell breached his original ‘Retail Installment Contract and Security Agreement’ as well as the legally binding 'Agreement to Provide Insurance' and thus is not legally entitled to any refund.
