RIPOFF COMPLAINT AGAINST DENISE BURCH, DHR, JUDGE BILLY JACKSON, LABRISCO COOK AND SARA HENDERSHOT FOR THEIR ILLEGAL HANDLING OF MY CASE, FOR ILLEGALLY TAKING AWAY MY RIGHTS, AND FOR PUTTING MY NIECE IN HARMS WAY THROUGH A SERIES OF LIES AND DECEIT!
 
Regarding the RipOff Report Complaint of August 7th, 2012 - I am "Judy" that this report refers to. The first thing I would like to mention is Dee's IQ score listed on the original report is not correct. Her actual IQ score is 63. This is listed in the court documents. This is an overall score. In some areas testing shows, as low as, in the 20's. As Dee's legal guardian and caregiver for the past 10 yrs, it is key in her case to point out she has an extreme case of ODD (Opposition Defiance Disorder) coupled with her mental challenges. These two things have allowed the state of Alabama to get away with the worse case of child endangerment I have ever seen. That being said, I will briefly tell my story.

I received full custody of my sisters two daughters after she passed away. My sister died in her home, and I was advised to let them remain to morn and heal from her death before trying to uproot, and relocate them. I had frequent phone contact with my sister's ex-husband who was caring for the girl's, but my sisters current husband (at time of death) was head of household and in charge. I received a call telling me that DEE's bio-mother and partner needed a place to live so they offered to look after the 2 girls in exchange for a place to live, so husband accepted. I did not get alarmed because these people were always hanging out there. *Just to clarify.....Dee's bio-mother signed parental rights to my sister at birth. (This was planned from conception.) My sister and I brought her home after Dee was delivered and discharged. Five years later there were court documents showing Dee's bio-mothers right were permanently terminated by the court.*
 
I continued to monitor the situation with the girls as best as I could. I did begin hearing things that had me concerned, then one day I got another call saying Dee was out of control the husband could not deal with her any longer. Then another call stating he was robbed by this group living there. Well Bio-mother, partner, and sons were told to leave. They said they wanted to take Dee with them. I knew now it was time something be done. I immediately went to Pa. and picked the 2 girls up to visit me in Al. to get them in a safe place and to investigate. I had no opposition from either husband since they knew the bio-mother taking Dee was BAD NEWS. I found a horrid story there. There were 11 people in my sisters small dbl wide home. These children had been witness to drugs, alcohol, and inappropriate sexual behavior. The bio-mothers son also has issues and her partners sons a criminal record. Anyway we got the girls and headed to Al.

By the time that trip was over I was devastated of the things I learned.......so I contacted my sister Kathleen who retained a Pa. attorney to get emergency custody then followed  up with full legal custody. I am the oldest of the sister, so the attorney had it entered on the custody order that all physical custody automatically goes to Kathleen in the event I am incapacitated or pass away, with no further court order. That day I vowed to  do all I could humanly do to help these girls. I set forth immediately getting them in school, and to a doctor. Both girls had put on a lot of weight, but Dee's body was covered with open, bleeding sores. Upon physical exam Dr. said both girls showed signs of sexual abuse. Dee was definitely in the obese range, and blood tests showed diabetic levels, high cholesterol, and high triglycerides. Dee came to me on a lot of psychiatric meds which later was found to be the cause of the sores and some other side effects. I got Dee psychiatric help and counseling. Kathleen helped me with all I could not financially do. We wanted these girls to have all that they missed. Wonderful vacations, Christmas's that they would never forget, share family events and share the precious memories of the ones that are gone. I spent the next 10 years making these girls the priority of my life. That was easy since we quickly bonded and now loved them as much as my own.

The younger sister came along beautifully going from a failing student to a straight A student at the end of last year. Now is doing pre college classes! Dee however, due to her ODD was another story. Dee could be a sweet loving girl; she was older now and the ODD caused violent behavior if she felt controlled. As a stated earlier she was not text book, because the severe ODD combined with the area of low IQ that keeps her from understanding things outside her world, led her to be arrested for assault to my granddaughter. The cause was she had gotten caught stealing. This was the most common cause of her outbursts. She has to feel she has control!

Now comes the cause of my comment: After all the years of therapy, and direction of DR. A I felt with all my heart we reached a crossroad with Dee. After getting arrested she appeared to get the message " I CAN NOT DO WHATEVER I WANT...... EVEN ADULTS HAVE RULES" Then the real nightmare began. We were all outside the courtroom waiting for Dee to go in front of Judge Jackson. After getting called in...Somehow Denise Burch and Florence DHR turned this into a dependency hearing stating an anonymous call that morning accused me of mental abuse. Denise Burch had already put her plan in action prior to that morning. Why..Is still unknown! Dee and I were very distraught. Of course NO LEGAL Representation for me. I was totally in shock from this ambush! Over a year has passed with countless hearings with Judge Jackson, meetings among Denise Burch and DHR team, all behind closed doors. Removed my guardianship, NEVER contacted second guardian Kathleen, appointed by court order, and refuses to hear our side. No proper investigation of facts that would prove this wrong doing.
 
I will end with the ultimate disaster of it all: After all the pain these players caused to this family, and mostly to her younger sister; they have placed DEE in utmost danger! All those private meetings both outside and inside of Judge Jackson's court were to place her with the bio. Mother, so they can close this case and let Alabama off the hook from financial responsibilities. In fact the DHR Attorney said it was a mood point that we were concerned about her because she was turning 19, and could go on her own at that point.  The argument was that Dee does have the mentality of a 12 yr old child. So it was not a mood point! These people knew and did not disclose that they were working to give her Bio Mother CUSTODY!!! In 6 days! My sisters court date was 7-20-2012 and the Judge blew her off day by day not wanting her to be heard in court. Trying to let him know she was now the Legal Guardian and wanted Dee. Denise Burch and Labrisca cook lied to us for 6 months saying they were trying to get her into scope 310 a nice program that would help her.

So now Dee is right back in Pa. with the very people those custody papers were protecting her from. The one that DID totally abuse this child! Now she will get paid to abuse her all over again! Denise Burch and Al. DHR have been guilty in many cases of children being removed from their family with no proof what so ever, and for lying to do so. But how can a Judge take part in such actions without even hearing both sides! What is the reason they do not want the truth in court????????????
I also would like to know why after I worked so hard to get Dee into continued educational programs that they pulled her out of school.

I also would like to know why I was not offered help financially with the so called parenting classes that was the requirement to allow me to visit Dee I am disabled and have a low income, according to an attorney later told me that they had to offer assistance for payment, so the classes could take place.  Seems to be unfair to me that - Denise Burch, or Labrisca Cook did not inform me that they had a program that would pay 100% of the fees to make it possible for us to visit and have home visits. Instead they moved her 1.5 to 2 hrs away from out home town.

I want Dee immediately removed from her birth mothers home before she gets abused again, and put into Scope 310 as was promised by Burch and Cook. I want my rights restored, and I want my sister Kathleens rights recognized. And I want the appropriate disciplinary action taken against Denise Burch, Labrisco Cook, Sara Hendershot, DHR, Judge Billy Jackson and Nancy Buckner!
