To Whom It May Concern:

My name is  R and I am the mother of three amazing boys. My oldest is named T and he is 13 years old. He is my step son but I have raised him since he was 4. Then I have two biological children, L , 3 years old and E, 4 months old. I recently went on a trip to Kyoto, Japan to attend my brothers wedding. I was out of the country from June 20-28th. When I returned, I had just stepped off the plane (I was in the air for over 15 hours) and came down the escalator to the conveyor belt to retrieve my luggage when I was greeted by our three boys and husband. Tand L gave me kisses and hugs. I kissed my husband and then walked over to my youngest and scooped him out of his car seat when I noticed what appeared to be a rash on his body and a swollen leg that was hot to the touch.

I asked my husband what on earth happened to E. He said he had fallen out of his swing, (my oldest was in the room and confirmed his story) but his leg never actually started swelling until that same day he picked me up from the airport. I asked about the rash and he said he thought it was a heat rash initially and had been treating it with Neosporin. I asked him why he didn't take Elliot to the Doctor after he fell out of the swing and he said he had read literature that said it was virtually impossible to break a baby's bones and it said to wait 24-48 hours to see if there was swelling. He also told me that Elliot never cried and didn't seem bothered by it. I squeezed E's leg a little to see if he had a reaction to it and he was still fixated on my face with a big beautiful smile. Regardless, E has never been a fussy baby but I turned to Tim and said we need to go to the ER right now. This is serious. I could tell myhusband was almost relieved to hear me say that as though he just had no idea what to do and was looking to me for all the right answers.

We went straight from the airport to the Emergency room at Mercy hospital. Once at the ER the situation started getting ugly. My three year old London kept crying and saying he wanted to go home. My sister showed up and started screaming at my husband. My oldest was becoming impatient. I sent my sister to take my oldest to his grandparents. I took London my 3 year old to his grandparents and went directly back to Mercy. I knew E was in the care of doctors and nurses and I felt like it was in my other children's best interest to be in a different environment so I could focus on E.

When I returned back to Mercy, my husband's face was drained of all color and he was not looking well. I asked him what was going on and he said something wasn't right that he was being interrogated and people were starting to point fingers at him as if he intentionally hurt our child. Keep in mind my husband has never been in trouble in his entire life. He only received his first speeding ticket a couple months prior to this incident. He is not only one of the kindest men I have ever met but he has always been incredibly gentle and nurturing to our children. Anyone that new my husband would tell you he was just not capable of intentionally hurting anyone or anything. The Mercy doctors came in and told me they were transporting E to Children's hospital and that an ambulance was on its way. I rode with E in the ambulance and my husband followed behind us in our car. When we got to Children's hospital things only got worse. We were met by a police officer and two DHS case workers who made false assumptions and false accusations towards my husband and me. I told them over and over again that I had literally just stepped off a plane and came straight to the ER with my children yet they didnt seem to care. I thought what I did was the right thing to do.

After being questioned, the police officer said he was taking my husband in for further questioning but not to worry, that he would bring him right back. That was not the case. I learned that myhusband was arrested that night for something he didnt do (charged with Felony Child Neglect) and put into Logan County jail. I never left E's side. I spent the night with him in the hospital and that next morning I got a phone call from a lady named M.C. that told me she needed to know the whereabouts of my two other boys because DHS was taking away custody of all three boys from me. I explained to her that I was out of the country and as soon as I realized there was something wrong with E I went straight from the airport to the hospital. She didnt care and then informed me that I should not have even been allowed to stay by E's side all night long alone. I was appalled.

Now DHS has wrongfully cited me with failure to protect my children and they have cited me with threat to harm my children. Surely there is some sort of justice in this that DHS cannot continue to get away with these wrongful accusations. I am going onto more than a month now without being with my children. I have no idea where they are staying or how well they are being taken care of. I am pleading for help from anyone that feels DHS has gone too far. My children are my life and without them I am lost.

I have enclosed several letters of character reference, doctors letters that confirm all my children were healthy and well taken care of prior to this incident, product liability information from other parents whom have had their children fall in exactly the same manner, the BabyCenter article that my husband read which advised him to wait 24-48 hours before taking our baby to the doctor, and a letter from my husband where he explains exactly what happened in his own words.
