Blatant False Advertisement using a deceptive and misleading radio commerical.

A few days ago, I heard a very nice radio commercial from High Country Toyota. The radio commerical stated the following "From now until this Saturday all credits are waived. We will pay off your trade no matter the amount. We are also eliminating all down-payments."  

Let's examine each of these statements. To me all credits waived means either no credit checks are done or credit checks are done but they are not considered or credit checks are done to determine if the potential buyer doesn't have a bankruptcy on their credit report. Secondly, "We will pay off your trade no matter what the cost" is self-explanitory. The company will pay off your trade no matter how much you owe on it. Lastly, "We are eliminating all down payments" means you don't need to put down a down-payment on the vehicle. In short, the company via their radio commercial is offerring waiving of credits score, no down-payment and to pay off your trade no matter how much you owe on it. This is a very good deal for someone like me because my credit is damaged due to a divorce.  

Unfortunately, what you end up getting when you call the company couldn't be further from the truth. The company will not only check your credit score but you will suddenly get anywhere between 6-10 credit inquries from different banks. These are the banks that many other dealers use.

When the sales representative ran my credit, he came back to me and told me my credit score was a bit low. Well I already explained this to him and also he put me under the impression that he checking my credit score to verify that I did not have a bankrupcy on my report not to see if a bank would approve my financing. The radio commerical alluded that the company perhaps had some inhouse financing but this is not the case, they use the same banks like any dealer out there.

The agent then came back to me and asked me how much I could put down as a down-payment. He told me he needed the down-payment becaue of the negative equity on my car. He requested I put down about $5000. This is the same amount that all other dealers I've dealth with had requested.

With this said, the radio commerical promised one thing but the dealership does another thing. My view is that the dealership executed bait and switch using a radio commercial. This type of deceptive behavior should not be tolerated because it is blatant false advertisement. I've recorded the commercial and I don't hear the disclaimer "Subject to credit approval" nor the typical fast paced terms and conditions you so often hear from these types of commercial.

That is great...but

That is great that you are very satisfied, and if they did get you into a car with a great deal wonderful.

Not to take away from that, but I hope that your appreciation for their "work" didn't cloud your judgment when actually signing on the dotted line. Where you would have taken any offer regardless of what they said.

Hopefully you asked these questions when you got the car and would give the details now.

Was it truly a "new" car, or was it just new to you?

What is the Make/Model/Year if it was a Used car?

Are you sure this is a loan and not a lease?

What was the total cost of the car?

Did they add in any "extras" such as Extended Warranties?  Did they tack on any "Dealer Fees"?

Did you have a trade?  What did they give you for your trade?  Were you still making payments on the trade Did they pay it off and roll any balance into the new loan?

What is the Interest Rate?

What is the length of the loan?

What is your monthly payment?

Did you make any additional "Downpayment"? If so how much?

A few of your statements are also a little troubling. For example you seem estatic that you were paying $100 MORE per month.   To most people, especially if you have a history of having difficulty making payments, this would seem like a very unwise move in the long run. As you now need to make sure you pay that $100/month, every month for the length of the contact. If you got stuck with a 72 month loan, that means you would be paying over $7,000 more which would could more than offset the difference in interest you were paying.

Truly excellent in everything they do. Highly recommended. High Country Toyota is the place to go!

I want to take this opportunity to express my most heartfelt appreciation and gratitude to the staff of High Country Toyota. My story begins earlier this week. I heard a radio commercial and the sale pitch was excellent and it immediately indicated to me that High Country Toyota is a place where the staff is not only professional but also genuinely cares about its customers. My story isn’t so simple. I went through a divorce that completely wreaked my credit. I’ve tried multiple dealerships in the past, all of whom had a similar sales pitch and all of which after seeing my credit basically never called me back and abandoned me. High Country Toyota is completely different.

I dealt with two highly dedicated professionals, Mr. Jesse Woodall and Mr. Jeff Wood. At first, Jesse was having issues finding me a good deal because of my credit history. He did his best to help me out and he constantly kept me informed. Unfortunately, he wasn’t successful in finding me a good deal. Unlike, the other sales professionals I’ve dealt with in the past, Jesse continued to keep me informed and most of all treated me with dignity and respect. After hearing the news, I had decided to just give up and at that point I resigned myself for yet another rejection.

Suddenly, out of nowhere, I received a call from the Sales Manager, Mr. Jeff Wood who turned to be one of Jesse’s bosses. He followed up with me and told me was trying to work out a deal with another bank. I was surprised to hear back from them but then my surprise changed to elation because for the first time I realized I had not been abandoned. Eventually, Mr. Wood managed to secure me a deal, a very good deal. Throughout the entire correspondence with Mr. Wood, he constantly treated me with dignity and respect and was genuinely interested in trying to help me. I’m sorry happy he managed to do so, and boy did he manage to surprise me.

I was put into a brand new Toyota Camry. The term of the loan was outstanding. I was only paying $100 more a month for a brand new car with an interest rate that was less than half of what I was paying before. It turns out that after my last communication with Jesse, he never gave up on me and he went to his boss and tried to find a way to help me out. This type of dedication is hard to find now a days and I’m so grateful to Jesse that he stood by me the entire time.

To the staff at High Country Toyota, in particular to Mr. Jesse Woodall, to Mr. Jeff Wood, I express my most heartfelt appreciate and gratitude for your utmost dedicated support to me. Thank you so very much. Best regards. GREG

There's A lot You Need To Learn

 First...you were dealing with another very typical example of the slimeball pond scum which makes up the Sleazy American Car Business. Their advertising was misleading which is nothing new for dealership trash. However...YOU should have been knowledgable enough to have seen thru their pure deception. Anytime you are considered for credit, YOU WILL be checked out, no matter how much they lie to you.

The no down payment garbage is NOT in your best interests because that would get you deeper upside down in the deal. The claims they will pay off your existing car is also pure BS! For them to take your car in trade and either sell it, junk it or send to the auction, they MUST have you off the title! The ONLY way to do that is they MUST pay it off. The amount they pay off gets added into the new loan and you end up deeper upside down and pay for two cars but drive one! Here's what YOU should have discovered on your own before you even talked to them.

They are going to LIE to you about the price of the car by marketing it lower than what they want. They were going to make up the difference by adding in two BOGUS FEES. You can see that on their website. The BOGUS FEES total about $1300! No matter what official sounding names they give these BOGUS FEES, it is PURE DECEPTION and shows you without any doubt you were dealing with people who have ZERO INTEGRITY and ZERO HONESTY!

The ad you heard was a pure SUCKER AD and was aimed at those who have no clue as to what they are doing! I hope you did not reward these slimeballs by making a purchase there! Everything you stated was nothing more than a PERFECT DESCRIPTION of still another sleazy car dealer built on nothing but sleaze, fraud and deception and THAT is an obvious FACT!!!

The advertisement is neither "bait and switch" nor any sort of legal contract.

The radio commerical stated the following "From now until this Saturday all credits are waived. We will pay off your trade no matter the amount. We are also eliminating all down-payments."

First off if you really did transcribe the ENTIRE recording word for word, not only was it perhaps the worlds short commercial...about 2 seconds, but who ever wrote their copy needs to be fired as we have no idea what "all credits are waived" means. You ASSUMED it meant credit check, but that may not be true.

However, even if it does mean that they waived all credit checks. Why would you then fill out the Credit Application?

Second, the one thing in this commercial you are missing is any details. What is the monthly payment they were offering? What is the Interest Rate you would be paying? What is the price range of the cars? What is the length of the finance agreement?

Were any of those questions answered in this "commercial"? Of course not, and that is why it is too general and you would have no valid claim that somehow it was a binding contract or offer to sell.

You of course went in with your bad credit, no ability to make a down payment and the hope that someone would basically just hand over the keys to a new car. But in reality they could have told you that with those conditions you would qualify for a $6,000 car as long as you are willing to pay $1000/month for the next 18 months.
