DO NOT Lease on to Kirk Trucking Service.  If you turn down loads that do not pay anything, Don Cox will be in your case big time. When my headlights needed fixed because my Hi-Beams would put my left lights out, Don Cox wanted to know why I could not load in the daytime and fix my lights before dark.  In other words run in total violation of FMSCR Rules.

Because of this my lease was terminated at 1:00 PM May 9, 2013. Why they are terminating my lease they took one of my loads off of my pay leaving me with a $28.26 pay check. The load I took from York, PA to West Mifflin, PA paid the truck $392.00. They claim it is not a forced dispatch. Just turn down loads and you find what in no uncertain terms what Don Cox thinks about that. The rates are beyond cheap, their rates are a joke..!!!!!

I do not deny hitting a bridge with the trailer. A bridge that I passed April 29 and May 8, 2013 with that exact trailer. Not counting 3 times before when leased to Amstan each time I was pulling a van. I was sitting under the bridge when I pulled out I felt the bump. Only thing I can figure something was hanging from the bridge. I had pulled vans into Long Island and the Bronx with no problem. This was a fluke.

I worked for Kirk in the early 90's fantastic company. These are not the same owners. I was stuck in Baltimore only reason I left.

Don Cox handed Dave Domer their Safety man a note to tell me he was terminating my lease. Why ? Because Don Cox wanted me to go load without fixing my headlights first. When my  lease was terminated by Don Cox, BEFORE the trailer was brought back they took a load off my pay. That is according to Millie in payroll. BEFORE the trailer was damaged. My lease was terminated at 13:00 hrs. Hours before I got my lights working..They had already got their hands in my pay. My log sheets can back up the time my lease was terminated, headlight repair, and the trailer geting hit AFTER my lease was terminated. After my lease was terminated, I legally had no obligation to return that trailer, as I no longer worked for them per Don Cox. They no choice but to pay for the trailer, after Don Cox terminated my lease at 13:00 hrs. I told  Dave Domer if my leased is canceled I do not need to bring the trailer back. He ask me not to do that, so I didn't

As for Don Cox I turned down 3 bad paying loads in a row per Chris the dispatcher. Don Cox gets on the phone wants to know why I turned down loads. I said they paid nothing. One load I would have to dead head 50 miles East turn around come back 50 miles West then go to Pittsburgh for a whooping $400.00.  What did Don Cox tell Jim Luchini that I turned 11 loads !!!! That is a very abrasive lie. 3 LOADS !!!

Their loads are from brokers that explains the cheap rates. I thought they had their own customers, I was going to pull a van to help build the business up. Had I known the TRUTH that it was brokered loads I would have pulled a flat instead.

They DO NOT have forced dispatch ?? Turn down loads like I did watch Don Cox get on the phone. He was upset when I turned down loads when I was in Chester, PA that paid nothing. I did take one from Hatfield, PA to Chambersburg, PA.

Kirk knew I was bankrupt from day one, it is the first thing I tell any company.

As for me I am not disturbed, am just stating the true facts. Right from Kirks own employees, Don Cox, Dave Domer, Millie, Chris. Kirk can twist whatever they want. As I said my log sheets for May 8 and May 9, 2013 back up what I have said about lease termination, pay taken, headlights and trailer.

 kirk trucking has been servicing the trucking industry for over 70 years while supporting many owner-operators and their families with postive results. we have always been known for competitive rates along with consistent freight for our drivers. mr crownover was on lease at kirk trucking for 8 days recently while only hauling 4 loads by his own choice as he turned downed work and had his bankruptcy hearing we were told during this time period as well. being we do not have forced dispatch he could choose to turn down or take work as is our policy.

don cox who jim c**** refers to in the article has helped numerous drivers with mechanical issues in the past that other drivers can attest to his knowledge of equipment as was a past driver for over 25 years himself. mr c**** also in the complaint does not attest to the fact while he was returning a rented van trailer again by his choice, hit a bridge deck and opened up the enclosed van trailer in the front/top bulkead with damages over $ 3,500.00 being estimated by our insurance company. kirk trucking has a reputation that i stand by daily along with all of our employees and drivers. i'm not sure what mr crownover is disturbed about, but i know he signed on, didnt work much, rented a trailer, brought it back damaged and he's worried about how a load pays that he could have turned down-go figure!
