Febuary 2022, Merchant never answered a question about their Sakatraz queen honeybees offered for sale via internet with delivery via mail.

Order was placed on March 05, 2022 for a Carniolan Queen Honeybee. The order clearly stated April 20 is the desired ship date. May 20, 2022, the merchandise was never processed for shipment and the merchant became defensive blaming the customer whom paid for the honeybee and was unable to start a new beehive without a mated queen in the early spring.

The FTC Mail Order Rule clearly states the merchant is required to ship all mail order merchandise within 30 days unless there is an agreement for other delivery times. The rule also states the merchant cannot refuse to satisfy mail orders if the merchandise is available for sale. Other provissions indicate silence from the merchant is considered acceptance of the chosen ship date and the consumer is not responsible if the merchant cannot process orders due to their volume of sales.

The merchant intentionally witheld the customer's order well beyond the agreed upon ship date and refussed to satisfy the customer's paid order with excusses that the "Queen Bee" was unavailable. Merchant is still accepting orders for the exact item in question with shipping dates through August 2022.

The merchant [Lappee's Bees and Honey Farm, LLC] is negligent on several counts of mail order fraud per the FTC Mail Order rule, including selling merchandise reported as unavailable.

The consumer was injured by the merchant's refusal to ship a Live Honeybee Queen and depriving the consumer of any production of farm animals (Livestock) and making excusses blaming the consumer through electronic devices such as telephones and internet access.

In conclussion, this merchant [Lappe's] is not a repuitable supplier of honey bees due to ignorance, poor customer relations, and unfair dealings depriving the consumer of a queen honeybee offered for sale until the season has ended.

Hello,

On your order form you did list that April 20 or later is ok, referring to shipping the queen, but we do have to have an exact shipping date that is agreed upon by both you and our company, so we sent you an email at the end of March and specifically asked you to select a shipping date from 5 different shipping dates that we had.

Since we did not hear back from you regarding the shipping date, we assumed you were not ready for the queen yet and held the order. Since we are dealing with live animals, we have to have an agreed upon exact shipping date, so that both parties are aware of when the queens will ship, and to ensure that our customers have their bee hives ready for these replacement queen bees.

Once I did hear back from you regarding your queen order, and how it had been so long since you had placed your order, I did let you know that I had sent you an email earlier to select a shipping date, and that I didn't hear back from you, so our policy is to hold the order until you let us know that you are ready and we agree on an exact shipping date.

Since you responded to us with doubts regarding our queens and expressed that you expected to be disappointed with them, we decided that the best thing to do would be to refund you for your complete purchase price right away, that way you would then be able to purchase queens from another place that you would be happier with.

I am sorry for the issues that we have had, we did do the best that we could do to take care of your order, but since we had to hear from you regarding the specific shipping date, we were not able to send your queen out right away.

We did refund you right away so that you could order a queen from another source that you would be happier with. There are lots of other queen suppliers that you could have purchased from after the time that we refunded your queen.

Bottom line is, we were having issues with trying to get you to set up a shipping date, when you responded back in the way that you did, we thought it was best to not do business with you, that is why we gave you a complete refund right away, to let you find a company that you were happier with.
