This loan was taken out 3 years ago.  They debited my account at least 5 times the amount of the original loan and overdrafted my account by $350.00.  I had no choice but to close the account as I could never get the overdraft fees paid and have since filed bankruptcy.  Now they are calling again after all this time wanting more money.  They call and the phone says the caller is unknown.  They occasionlly leave a message.

If your Bankruptcy is still open but not yet discharged there is an automatic stay that was put in place that bars a creditor from attempting to collect on a debt.  If your bankruptcy has been discharged and this debt was included they are no longer allowed to attempt to collect on the debt.  If either case applies you should contact your Lawyer to see you can take any action against them.

As a side note, there are some cases where they can attempt to collect on the debt.  This would be something like you calling them for another loan(although I hope you learned your lesson and don't do this).  In this case if they said you had to pay off your old debt before they will give you a new loan that is totally legal even if the old debt was discharged.
