To Whom It Should Concern,
 
The reason for this complaint has to do with Max Muscle Sports Nutrition, located in Orange Ca, Brian Furer, the 25,000 winner of the Max Muscle Maxformation Life Challenge Contest.

Both of them are committing fraud.

Brian is committing fraud toward the company in the fact that he did not follow the rules and there is no way he made the “transformation” he did and did it clean, especially when he has 2 prior arrests in the system for possession of GHB.

Max Muscle is committing fraud toward the rest of the contestants, they are not enforcing their own contest rules and they have not only crowned a pre-handpicked champ, in this contest but did it as well at a national NPC event that they sponsored.
He entered the Contest the end of March even though he has a picture supposedly from January, and Won the middle of August.
While in the Contest he competed at 2 NPC events, one in April 17th 2013, where he placed 8th and 10th, then one on June1st 2013, about 6 weeks later and placed 3rd,
And it just so happened that Max Muscle was the main sponsor of the 2nd show where he placed 3rd. 
This whole situation does not fit.
(Now before I get into the whole back story and long you down with a bunch of questions I want to tell you what I saw on the Max Muscle site last night 8/15/13 and this morning early a.m. 8/16/13. I watched as one of the members (user name leangains) brought to light the same points I am going to tell you. He posted pictures and he posed questions to the community at large. Some people thought what he had to say was eye opening, while others simply told him it was the same thing they had thought all along, but had said nothing because they were sure such a cheat would not be the winner. This went on till about 11pm then stopped, others picked up where he left off and posted even more evidence, including the news of the arrest back in 2008. When I went to bed the site was pretty quiet and I waited to see what the morning would bring. It was really no surprise to me when I woke and found that the site had done the same thing it did last year when the member began to turn on Max Muscle, they shut down the site and would not let anyone log in, post, or even see journals. This lasted for about 2 hrs, then the site was back. The leangains account has been erased, the comments you will see on the two postings I have a picture of from the site that have no name on them are posted that leangains posted and are now unnamed because of the deleted account. I am also sure they did as they did last year, and messages have gone out to others to cease and desist this activity or they will be deleted also. These type of messages were all over the site last year.)
Now on to the point I am after.
Why would a rep tell him to take a before picture in January but not tell him about the Maxformation?
Why does he have only two pics other that his final pics, and only has 5 journal entries, especially when you look at his facebook page he loves to post pics of himself, and if you visit his "motivational page" he loves to talk about himself.
Why would Max Muscle, if they are trying to keep the Maxformation Contest on the up and up, allow Brian to enter a NPC event, especially one they sponsor and then award him 3rd place, and think no one will mind this happening.
It is pretty obvious even to the untrained eye that this guy is on something other than "protein", especially when it is clear he has a history with enhancement chemicals.
Which brings up another question, why would Max Muscle and all the people there not take the time to do some web surfing and make sure this guy was on the up and up? Come on not 1, but 2 arrests in less that 3 weeks for the same exact thing...
This is not the first time Max Muscle has been questioned on their winner. In 2010 Maria Adelus, she did not journal, there were no pics, she came in late in the game, and in the end gave her the prize.
Below is an attachment for one of the contestants during 2010 who felt he was done wrong and had the numbers to prove it.
Then last year, there was a person in the top ten who was not even registered for the contest.
And due to the harassment and bullying they allowed to go on on the site last year one contestant had to pull out of the contest and was refunded every penny he spent on supplements for the contest.
The lady that won last year Amanda Freeseman, was also very lazy in her journals, and with picture, she lost 50 lbs, but it was all lean muscle, she was exactly the same body fat % when she finished as she was when she started. There were people last year that lost just as much weight, if not more, in fat, as this lady, but also did a journal every day, put up pics weekly, did all their weigh ins, and were part of the community as a whole.
One woman in Colorado even nearly lost her home in the wild fires last summer, but she continued to journal and to work her plan, there was also a guy who lost his job, his home and was nearly in the streets with is family, but used what he had learned with the discipline in the contest to pick himself up, get another job, and home and get back on his feet, and what did they get for it? Nothing, not even a "you did good" from Max Muscle.
There have been so many people the last few years that I have been watching this community that have poured out not only their money on the supplements, but have poured out more importantly there time and energy to improve themselves just to turn around and be slapped in the face by Max Muscle as they crown the handpicked winner, someone that was picked and was helped through the "journey" before the contest even started.
I think that is the thing that angers me the most, is this company having the audacity to run a Contest every year and have people compete against themselves and each other when they know full well that the winner is already picked.
Max Muscle needs to be held accountable to the people buying their products and buying into their BS every year.

I have included some  pictures of Brian Furer, that can also be found on the Max Muscle Site, on Brian's facebook page, Brian's motivational web blog, and on the NPC site as well.
They are progressive pictures of him starting January, and ending in May, just before the Mile High Competition in Colorado.
The jump that he makes from March 26th to April 17th at the NPC Northern is just eye opening.
Then to get even more ripped and more defined from April 17th to May 30th has me in awe as to how Max Muscle could just look at that and say, "hey hard work pays off." Especially when this guy states in his profile that he works 16+ hrs a day.
The last picture is of Brian's trainer Chris Williamson, see a resemblance in body type?

This guy is dirty and someone has to call "foul" and hold him and Max Muscle accountable for this.
They should not be allowed to thumb their nose at their own rules and do what they want when they want.

Five journals, when doing a journal weekly or even daily was advised in the rules.

He also did not journal till the June, six months into the competition and three months after he started.
If you look at his face book and his blog, he likes to talk about himself, so why only 5 journals?

Under profile he tries to explain the "before picture", that he was told by MM trainers to take one when he started training, even though he did not sign up for the formation till March and there is no picture for March other that a grainy cell phone pic with no way to id when it was taken.

Under goals he tries to explain the "after picture, and the fact that it was taken two months before the close of the competition. He goes on to talk about the Max Muscle Mile High competition but never mentions that he placed 3rd.

8 photos in all and it is specified that there is to be a photo with each weigh in and there is to be an effort put out to show the transformation in pictures, half the pics (4) were his final pics, taken 2 months before the challenge was over.

Under measurements, he has 5 measurements, 1 in march, 2 in may and 2 in June, there is the same pic with both May postings, and the same pic with both June postings, so there is in total three pictures of his transformation.

None of this was followed, he did not journal, he has few pics, and he competes and won no less in not just one competition but 2 one of which was Max Muscle sponsored.

He has the numbers and he had a point but no one wanted to listen. Max Muscle's fix for it was to ignore it.

This one is in reference to his "fat before picture, and how I truly believe it is fake. I saw the pictures from his Real Estate Page and the summer of 2012 he was not fat. So I wanted to show you just how easy a fake before picture is, and the papers can be picked up at the newspaper office for $2 out of the archive.

Maxmuscle champ steps down

Brian Furer for one reason or another has stepped down as champ. Actually I'm ok with how things have turned out. I feel good supporting the product again. I will fully support whoever they decide to pick. I just couldn't support Brian Furer who obviously did not follow contest rules.

Brian Furer stepped down as champ, he tries to explain away all the things people were mad about.

The most interesting thing he does is he tries to explain that the GHB he was busted for in 2008, was for "a sleep disorder".

I have informatiom, from sources close to the case, that state he plead to a misdeneaner and stated the GHB was for " personal bodybuilding purposes".

Now even though Brian Fuer has stepped down, whether by his own choice, as he expresses in his letter, or by the companies request, it still does not explain this statement from Brian Furer "Sean, you and I have spoke at length about the incident I was involved in five years ago, and I will forever appreciate your support and that you believe in me." How could the head of the company be fully aware of something like this and not only be supportive but go ahead and crown him champ. They also need to explain how they could crown a champ who even in his own words "did not fulfill the requirements of the competition". He did not do anything right, but he was champ.

As I have heard so many times before, "if it walks like a duck and quacks like a duck, it is a duck." So if it looks like a scam and sounds like a scam, it is a scam.

The other thing I have discovered has to do with the hoky 3rd prize he was awarded the the NPC event.

He placed three times, 10th in class B, 7th in class B novice, and 3rd in Masters 35-42
You will notice that the guy that got 1st in Masters 35-42 (Willis Small) also got 1st in Class C and 2nd in novice class C
The guy who got 2nd in Master 35-42(Tony Schluck) also got 4th in class D and 3rd in novice class C
Neither jumped from the bottom of the list (7th and 10th were the last place in both that Brian Fuer placed in) to the top, like Brian Furer did, it does not compute.
1st or2nd in a larger group can easily become 1st, and 3rd and 4th in a larger group can easily become 2nd, but last in a large group doen not make you 3rd in a smaller group unless ther are 3 people and this group had 5.
The other two people who got 4th and 5th in the Masters 35-42, placed mid card in their other classes, so why did they not get 3rd instead? Something doe not compute.

MaxMuscle you can not just say, "okay Brian is no longer champ, everything is good." There is something going on and it clearly goes all the way to the top.

2013 Maxformation contest

 My name is Brian and I want to say that the report Michelle filed is completely accurate. I competed in this contest and was a top 10 finalist. The winner did not follow the contest rules like the rest of us did. He started the contest at 232 lbs on Jan. 2nd 2013. And finished the contest on May 30 ata bodyweight of 173 lbs with a level of muscularity that is ridiculous. He also entered a bodybuilding show April 16-17 of 2013. I can't find his bodyweight listed but he looks to be about 180-185lbs. This means from Jan. 2 to April 16 he dropped approx. 47lbs and kept solid muscle. The rules state a maxmuscle contestant can't enter NPC shows. He did this twice. The second time in June he placed 3rd and this was a Maxmuscle sponsored event. None of us stood a chance. I believe the winner was picked long ago. And it stings because those of us who played by the rules threw away our money on supplements. For me personally it was in the amount of hundreds. And I don't make a big salary. If anybody can point me in the right direction on how to pursue legal means to get a refund I would appreciate it much. Thanks.

Here is also the site and account the memeber above was apeaking of, he is correct. Did Brian lie about his weight at the end od May or did he pontaniously gain 20lbs, even if you go by the latesy activity date that gives him 2 1/2 months to gain that weight and gain zero fat.
