My mortgage has been sold to SPS to handle my loan and payments. I'm set up with on Autopay, via contract, for a Bi-Monthly autopay payment. I received a letter from SPS showing I was almost two months behind (4 payments) on my loan and being charged late fees. I called customer service and was informed my account still shows I'm active on autopay.

When I asked, "so what's the problem" I was put on hold several times but the person helping could not get an answer. I took his name and EXT and he said he'd get back in a day or two. Never did. I called his extension and got another person who knew nothing. He said the person I wanted will call when he gets back that day. He never did.

I contacted the Ombudsman via a formal complaint form. I never heard back from him either. To make things worse when I filed complaints with major government agencies such as government-run  CFPA( Consumer Financial Protection Agency) or other complaint sites they claimed they've never heard of Select Portfolio Servicing but they did take my complaint and all relevant information. 

What is really scary are the hundreds of much more serious complaints on the BBB or Consumer Affairs website and many others. This will seriously hurt my credit and accrue more and more late fees since the company ignores my situation.

You Did Not Read My Original Complaint.

So many things you comment about is explained in the original complaint. I DID NOT wait two months to check or complain. I did not go for two months without withdrawals. I think you should slow down and read the original complaint very closely. I protested because I could not get the complaint heard by SPS. DO you understand they never returned calls or emails? Other than the approach I took would be to drive to Utah to confront the problem. 

So everything you said is a  specious argument because I immediately, not after two months, tried several times and various ways to contact them. Also, you have an anger problem because I could be the most irresponsible, lazy, and neglectful person in the world but that has nothing do with the complaint or the inactions of the company.

It was not the mistake that was the original problem and I had no problem with it when I first called them. Mistakes happen. I was a mistake so I know.  But after several attempts and no replies then that's a concern. You want to put this on me, that's fine but for some reason, you ignore the whole complaint. You say it should not have gotten this far.

Did you read I called and called and emailed and got nada? Case closed on my side but you can vent all you want and I understand. In my older years I find myself just like you and I'm not happy about that. Being a Libertarian in CA is not easy. Your frustrated with many things and this is a great outlet for you. Have at it.

Calm Down

The question about checking your bank account was a legitimate one, and for you to basically go "off the rails" reminds me of a famous play. To paraphrase a line...thou dost protest too much.

Perhaps you are one of the very small percentage of people who don't use online banking.  So if you truly didn't even glance at your balance or account for almost 2-months then let's look at you not seeing it on your statement. You aren't claiming a single or even 2 missing payments.

It would be great if you would post the dates of the last 4 payments before you got the notice was supposed to have been withdrawn and the date each month you bank sends you the statements.  Then from that show that all 4 of the "missing" payments somehow would have only been seen on the January bank statement that you claim you hadn't gotten yet. Once you see that is basically impossible you will see why your reasoning is invalid.

I'm not saying that they are right, I am saying that had you been more proactive it wouldn't have gotten to this point. Once it gets to this point the responsibility starts to fall on you. 

As for you talking to anyone who will even pretend to remotely listen. Perhaps one complaint will get this resolved to your satisfaction, but the reality is that most of those agencies have zero power over the company(hence the response "We never heard from them"). The ones that do may or may not feel that your complaint is valid..and just taking your information isn't them telling you your claim is valid. 

But there is one other "obvious" question. Once you got the notice did you immediatly send them the missing payments?

Today I received an extensive explanation from SPS via the complaint made to the BBB and another from The CFPB. With the explanation came an apology that a mistake was made the late fee will be removed.

You have no idea what you are talking about because all of the agencies I've used in the past such as these have worked for me within one to two weeks.

Nobody Cares

The FTC and the BBB don't care.  The FTC is understaffed and isn't going to seriously consider your complaint given it's current nature.  The BBB is a private organization that serves its members (businesses), not the public.  And the CPFB? 

The biggest joke of them all.  You are working with one of the larger mortgage servicing companies in the country and the CPFB never heard of them?  Hilarious!!  If the CPFB actually told you that - then you should have realized what a waste of time calling them was...  I mean they have no enforcement power, but if they actually said they never heard of this company....that's what I'd expect out of our government.  ZERO.

Here's the issue:  You know when the payment is being auto-debited, right.  You knew when the auto-debit was being done prior to the mortgage being sold.  I mean if you're watching things closely and care about your credit, then you should be tracking that sort of thing.  This idea that you got a letter after 4 payments should have been taken out....and you're using that as justification is lame.  Complaining about your credit being hurt as a result....falls largely on deaf ears.

Now, is the servicing company innocent?  Absolutely NOT.  They should have been taking payments from your account if they received the information from the seller, and the whole 'I don't have an answer' is not an acceptable response at all.  However, at that point, when you figured out the first payment wasn't taken out, you should have taken your checkbook out and write a check for the missing payment and send it off. 

Alternatively, you could have provided the ABA and account number to the servicing company for an electronic check debited from your account.  If this was the 1st payment and there was a late fee, then it would have been waived.  All of this would bring you current without impinging your credit.  THEN you could go to the servicing company and legitimately find out WTH is going on.

It should never have gone this far....and that's the point.....

I was so disgusted by your final comment that I forgot the major agencies that I've contacted.  After I did all the contacts mentioned in the complaint via phone and email I then went to work writing and sending reports to government and non-government agencies.

I've spread the word on my sites such as this one and YELP, Consumers Affairs, The BBB, The FTC, and the top government agency that oversees Banks and mortgage companies for illegal activities, fraud, and unscrupulous practices. The government organization is call "CFPB or Consumer Financial Protection Bureau.

I left a couple off and tomorrow I will contact a couple more. The agencies sent the complaint with a very short time limit of having to reply within 20 days. I also plan to contact my congressperson and the one located in Utah where they do business. I already have the complaint form to fill out and send it to the Attorney General of Utah, the office of Sean Reyes.

I'm far from done and plan to see if I can get a class action going by contacting hundreds hurt on this site, the BBB, and all of the other sites. I will discuss this later in the week with a family lawyer and HUD who believe it or not also handles these types of problems. I'm retired so I start first thing every morning.

You seem to have a problem or doubt the sincerity of my complaint so why didn't you do a search within this site alone then check out the BBB and Consumer Affairs website complaints instead of ignoring the who complaint and making sarcastic remarks. "Don't tell me you don't read your bank statements".  Brilliant!

Did you read the contacts with the organization including their Ombudsman? Your question has nothing to do with the poor business practices of the mortgage company. Are you the kind of person to ask a woman who has been molested if she also wore a mini skirt that night putting the blame on her?

What is the point of your question? The fact is the act. As for bank statements, they are monthly and by the time a statement is received and since I pay bi-monthly then two payments are on that one Statement. The mortgage company wrote the letter 1/13/20 which is less than two weeks after I get a statement and the letter stated the two missed payments and the next one which they also made a mistake since the next payment is not for a full month but cut in half being bi-monthly.

They are lumping the payments into one month at a time and that's not how the contract is set up. So by the time the letter comes I've missed more payments that a bank statement from the previous month would show and I can't believe I'm taking the time to even reply to such a question.

Every payment and month were done correctly and this problem just now started. If I didn't read 6 months of bank statements it would have nothing to do with a company not correcting and continuing to accrue late payments.

It has nothing to do with call after call and email never replied to. So back to your question. YES, I read statements but I do not have any Statements from Jan and the problem started in Dec. I read the statement. Do you work for this company or just have time on your hands?

Obvious Question

When you noticed your payments not being withdrawn from your bank account what did you do?

Oh and please don't tell us that you didn't even look at your bank balance during that two month period.
