South Charlotte Nissian Company will not return down payment on vechile they knew they could not get approved for a loan Charlotte, North Carolina

I was told that I was approved for a loan on a 2012 Nissian Titan truck only to later find out that it was not a approval from the lender. I was lead to believe that I put $1,500 down my deal was done. I have recently just file for bankrupty. I later found out during my research that dealers do what is call spot deliveries, I think this should be outlawed. However I went to the loan officer to try to get an approval for the loan for this truck, while thee I indicated to the loan officer that I would just as soon get my down payment returned because I did not need a truck, but wanted one. The loan officer sent my package to the manager of the dealership and said he would work the phone and get it approved. During the time I was thinking they were getting this vechile approved ( I got a call telling me they had worked things out, needed my wife income to get approved) someone broke the window on the vechile, I called my insurance company to report this, only to find I had no insurance on the vechile, I was under the impression that when the salesman took my insurance information that he made sure the vechile was added to my policy, it has alway been this way. I called and explained what happen. They were still trying to sale me a truck, just not this one, I later found out. They were very nice even telling me that they would take care of the window at no cost to me. They were trying to get me to purchase a 2008 vechile, I told them I did not want anything that old. I ask when I could get my downapyment return, i got the run around, my wife then called several times until they answered her question and gave her a time to bring the vechile in, I later call and was told I would have to pay for the window, I spoke to the same guy whom had previously said I would not have to pay for the window, he said I said that because I was trying to sell you a car only. I told him that they would get the truck back when I received my downpayment, they sent someone over that same night to get the truck, I gave them the truck, which I had not driven since I found I had no insurance nor could  the loan get approved. I went to get my downpayment back and was told I forfeit the payment because they had to come get the vechile, I explained that I could not nor would not drive a vechile without insurance.
