Ms. Zeidman rented her basement to Mr. Igor Gamburg and Mrs. Elena Gamburg. Mr. and Mrs Gamburg have resided in her basement apartment since November 2012 and the last rent payment from them was for November 2013.  They have not paid any rent since. Wednesday, February 5th was her third hearing and unsuccessful attempt to evictMr. Gamburg and his wife from her house. Her main source of income was this rental unit within her home. So far(Feb.6, 2014), the expenses not paid by Mr. and Mrs. Gamburg include: three months of unpaid rent, plus administrative fees, legal fees and application fees totalling the amount of $3,414.33 and growing. 

 

Since Mr. Gamburg and his wife moved into her house on November of 2012, they avoided signing the written tenant agreement. There was a verbal contract between them which did not include free laundry facilities or parking and smoking was forbidden. Any parking was to be requested by Mr. Gamburg in advance and granted at her discretion. Mr. Gamburg and his wife led her to believe that they would sign a contract but never actually filled out or signed the lease terms. The time passed with his wife claiming that her husband’s English was better than hers, asking the Landlady to wait and the house owner did not press the issue, to her regret. Since then, Ms. Zeidman (the landlady) haslearnt that she has a classic case of the so called “pro-tenants” living in her home, rent free and abusing the The Landlord Tenants Board unfair system and she has realized that there is Nothing (legal) she can do to get rid of her “tenant’s from hell!”.

 

Mr. Gamburg’s style of intimidation and bullying include: shouting righteous rants about his entitlements, surveillance cameras, threats of liability and threatening body language. He has orchestrated a harassment campaign against her; calling the police and other authorities to make false claims of wrong doing against him, including assault, without foundation or even reasonable probability. Ultimately, Mr. Gamburg stopped paying his rent. Meanwhile, without permission he parks his vehicle in her driveway often taking both parking spaces, so that when her daughter’s father visits, he has no space to park. He has made false claims that he has suffered “three heart attacks” for which he accuses her of being responsible. Ms. Zeidman and her daughter live aware of their tenant’s ill intentions, their provocations and willingness to fabricate events in order to defame her character, mean while his sense of entitlement increases steadily. The landlady’s career, her daughter’s health and school performance have all suffered as a direct result of their current living situation with Mr. Gamburg and his wife. So far, the tenants have filled 12 applications against her in order to delay the eviction process and this abuse is largely ignored by the enabling Landlord and Tenant Board.

 

Ms. Zeidman was unable to visit her mother, who was diagnosed with cancer some months ago, because at the time, she was preparing for her first hearing, which ultimately did not take place due to a filing error.  Her second hearing attempt was adjourned because Mr. Gamburg did not attend and for her third hearing, Ms. Zeidman found herself in front of the same Board Member coaching the Tenants about their rights, ignoring the evidences that they were outright lying and living her voice mostly unheard while giving the tenants another free month ride before the next hearing take place.

Ms. Zeidman in now entrapped in a nightmare, receiving constant calls from different levels of government authorities (based on false complaints from her tenants), e-mail and letters of demands drenched in false claims and of a defacing nature. The quality of the landlady and her 12 year old daughter’s lives has considerably deteriorated. Her daughter has a chronic medical condition, which has worsened largely due to their current living circumstances, the stress they both experience, the girls’ fears about their security and the lack of income to provide for the girl’s special dietary needs.

 

I want these people exposed as well as the Tenant Landlord Board broken, bias and unfair methods and the Government lack of action on the matters of fraudulent tenants abusing the system.

My name is Monica M. I was asked (in the instructions) by Ripoff report not to sign my name. I am a woman’s rights and social justice advocate and I, not Ms. Zeidman, on my own accord, wrote the original report on Mr. Igor Gamburg and Mrs. Elena Gamburg, who are her current tenants. I did it in good faith to caution other women like her that may be targeted by these tenants in order to spare them from the stress and heart ache Ms. Zeidman  has had to endure. I have written a statement of facts to which Mr. Gamburg has replied with his typical rant of lies and defamation and I stand by every word I have written about this particular case.

First of all, I want to clarify that this case is not in court. It is in front of the Landlord Tenant Board for a hearing on eviction. If this case were to be in court, it would be for defamation of character based on all the false accusations Mr. Gamburg has made on Ms. Zeidman. All Ms. Zeidman asks is to be freed from her awful tenants and have her life returned to normal. She is a private person more concerned with being at the service of others and had indeed asked that I have this report removed or edited in order to preserve her privacy. I had asked Ripoff report to do so earlier, but have not managed to have it removed so far. 

I assure you that every accusation, including that of assault posted here by Mr. Gamburg, is false and cannot be backed up by any stretch of the imagination.  Nor can his fictitious accusation of false receipts presented by Ms. Zeidman to a police officer. (Does this even make any sense? Can you imagine a police officer asking a landlord for receipts? If you were to call a police officer over such a matter they would tell you that it’s a civic case, they would not get involved.)

Secondly, Ms. Zeidman only took a legal advisor because she thought it might speed up the process with the Landlord Tenant Board (although it hasn’t made a difference), hoping to be liberated from these tenants sooner.

In addition, there is no court order against Ms. Zeidman. This is completely false. If an inspector has come to her home, it has been because the Gamburgs insist on calling the city, the police, housing ... you name it, all in order to harass and attempt to intimidate Ms. Zeidman with little foundation, and a belief that they have impunity to make false claims against her.   

Furthermore, if any of Mr. Gamburg’s accusations were true, wouldn’t these tenants have moved by now? I mean; assault with bodily injury, carcinogenic powders in the heating system, never mind the fact that it would be harmful to Ms. Zeidman herself to live with this, (and by the way, her mother lives in another country... It is not nice to imply that Ms. Zeidman’s apartment is responsible for her mother’s illness, she has hurt enough already).  As of now no city inspector has issued any type of report.

Finally, if these “frightened” tenants have not paid rent for more than three months now, wouldn’t they have saved enough already to move elsewhere? I would certainly think so. Instead they are fighting to stay and abusing the system to postpone eviction and live rent free. I assure readers that if the tenants were the victims here, I would be on their side.

Today I have run out of patience. Attempted to solve this problem by clarifying. in the case of the Landlord Chrisyanell Zeidman-Mendoza this turned out to be useless. This woman does not understand human words.

Monica! Would you like to have someone illegally entered in your apartment? Without your permission. Against the law. May be can you let go to your apartment stranger? Let go, will walk... Or maybe you don't mind that someone did a photo when you're relaxing at home? For example, set the camera in your bathroom?

Don't know, Monica, can you agree. But my wife and I don't like it when someone invades our privacy. So today we have raised the case on the fact of illegal entrance into our apartment, as well as illegal photo-video recording. Both crimes are recorded by our video surveillance system. Earlier the landlord had illegally entered into our apartment, photographed-I had no evidence. Thanks to the officer of the police, which we strongly recommend to install this video surveillance system.

Just the facts vs. lies

I will not write about how we cheated all year, promising to repair the broken stove, lights, electricity. I'll give the facts as soon as we realized that we are dealing with a scammer:

1. October 15, 2013 we gave written notice of repair to landlord Chrisyanell Zeidman-Mendoza;

2. November 26, 2013 again was served with a written notice. In the rough shape of a response - it works, don't like - the eviction;

3. December 12, 2013 was applied applications T2 (Application About Tenant Rights) and T6 (Tenant Application About Maintenance) in the Landlord and Tenant Board.

4. The first hearing was postponed due to incorrect filling a counter statement by landlord. The second hearing was postponed because of the Landlord and Tenant Board - the notification to us was sent to the wrong address. February 5, 2014 finally hearing took place. Landlord Chrisyanell Zeidman-Mendoza is actually lost to shame. Her lawyer (she somehow has hired a criminal lawyer) left the meeting without even saying goodbye.

5. February 6, 2014, after the shame on the hearing here is a defamation of my wife and me.

Do not feel ashamed? What is that? Vendetta of Mendoza from Mexico? Do people not understand that actually she shamed herself?

Yes. I was shocked when I received a link to this essay.

It will be difficult write here for me, because my English. My language - Azerbaijan. My second language is Russian - I know it perfectly. English is my fifth language. I'll use an online translator. Know how funny are some phrases. But I know that the meaning is clear. Well, I'll start writing the truth.

This crook - Chrisyanell Zeidman - a whole year deceived us. When we asked her to give us a receipt for paid service - she organized assault on us. When the police arrived - she jilted (fraud) police officer and gave him a fake receipt. The receipt now passes as evidence in Court. February 5, 2014 finally hearing took place. My spouse and I do not need a lawyer, only interpreter. The truth is on our side. Ms Zeidman hired a lawyer. After the hearing, her lawyer has left without even saying goodbye. He was very upset, because Ms Zeidman deceived not only us, the judge and police officer. She deceived even her own lawyer. At the meeting of the Court, you can't just lie, as did Ms Zeidman at this website. To the Court you must provide proofs. We just did it. The evidence presented to the Court as Ms Zeidman three times in 5 minutes deceived (fraud) police officer. We have provided evidence that Ms Zeidman had provided false written testimony to the Court. And much more...

 

Chrisyanell Zeidman lied us, that all hers services are legitimate. She refused to repair even a broken electric stove in the kitchen. We invited the home inspector. Violations turned out much more than we could imagine. It is not clear at all, as such violations it could register this apartment and rent it out. The Court provided evidence of violations of the Fire Code, the Electrical Сode. Just yesterday, my wife fell and almost died. We reported in City Hall. Came Inspector - Chrisyanell Zeidman has not complied with a court order:
1. Walkway is covered with a layer of ice
2. Light does not illuminate walkway
Written notice of the problem with the light we were handed another October 15, 2013. There's also the requested repair within drainage of water. Last winter we had the same problem. Therefore, before this winter we have had to demand it in writing. Another suit will be applied. Ms Zeidman will again be crying again and attack us. Didn't think ыру could be so pig-headed and blunt. Why not do everything according to the law. It is much easier and safer.

Almost forgot. The home inspector found a breach in the heating system. Together with warm air we get carcinogen is a powder, which is produced by incomplete combustion of gas in a faulty heating system. If you read her essay carefully - her mother has cancer? Her daughter has health problems? At the court hearing it was obliged to solve this problem - fix heating system. What she did? You guessed it - she's not even thought to invite specialists.

A normal person just did their job, for which she receives the money. This woman decided to attack us. Frighten us. And finally, when she lost in court, she decided to disgrace us by posting our photos and names on this Web site. Ok. I will update this information after each session of the Court. Ms Zeidman has decided to make it public? She will.
